SB 208 (Alquist-D) Transportation: Traffic Congestion Relief Program
Authorizes the California Transportation Commission to develop full funding agreements for Traffic Congestion Relief Program projects that have large unallocated balances.

Serves as the omnibus transportation bill to make the statutory changes necessary to implement the Budget Act of 2006. Provides the repayment of $920 million of the 2004-05 Proposition 42 suspension. Provides the repaynent of $495 million of the 2003-04 Proposition 42 suspension. Keeps all gas tax "spillover" funds in transportation and allocates nearly $248 million for local transit agencies, $62 million for the State Transportation Improvement Program and other Public Transportation Account needs, $33 million for budget allocations which include $20 million for farmworker transportation and $3 million for the High Speed Rail Authority.

SB 1494 (McClintock-R) Top priority transportation projects
Authorizes the California Transportation Commission to designate transportation projects of statewide significance as top priority projects. Exempts these projects from the California Environmental Quality Act and authorizes the Department of Transportation or other implementing agency to use design-build and design-sequencing procedures for the project, notwithstanding any other provision of law.

Increases the planning cycle for regional transportation planning agencies submitting updated regional transportation plans. SB 1611 (Simitian-D) Congestion management fees
Allows county transportation congestion management agencies or boards of supervisors to impose, subject to majority vote approval of county voters, a maximum $25 surcharge on the annual renewal of vehicles registered in their respective jurisdictions to fund transportation-related projects and programs, including pollution prevention programs carries out by a congestion management agency, a regional water quality control board, or a local air district.

SB 1671 (Ashburn-R) Spaceports: Mojave Spaceport
Appropriates $11 million from the General Fund to the Department of Transportation to provide a 30-year loan to the East Kern Airport District to construct the Mojave Spaceport Terminal.

SB 1812 (Runner-R) Surface transportation project delivery pilot program
Authorizes the Department of Transportation to consent to the jurisdiction of the state and federal courts with regard to the assumption of certain federal responsibilities under the National Environmental Policy Act, and waives the state's Eleventh Amendment protection against lawsuits brought in federal court for as long as the state participates in the federal surface transportation project delivery pilot program.

SCA 7 (Torlakson-D) Transportation Investment Fund
Deletes the requirement that the Governor issue a proclamation declaring that the transferring of funds to the Transportation Investment Fund will have a "significant negative fiscal impact on the range of functions of government funded by the General Fund of the State" and, instead, requires the Governor's proclamation declare that the suspension is necessary "due to a severe state fiscal hardship," and authorizes Proposition 42 funds to be loaned to the General Fund under specified conditions.

SCR 123 (Florez-D) Joint Legislative Committee on High-Speed Trains
Establishes, until December 31, 2008, the Joint Legislative Committee on High-Speed Trains. The Committee will be comprised of five members of the Senate and five members of the Assembly, as specified, and hold public hearings to receive public comment and review the work of the High-Speed Rail Authority and the plans for a high-speed train system in California. Authorizes the Senate Rules Committee and the Assembly Rules Committee to make money available to the Joint Legislative Committee on High-Speed Trains from the Senate and Assembly Operating Funds, as specified.

AB 267 (Daucher-R) Transportation project
Revises the reimbursement process and conditions for advance expenditures for the State Transportation Improvement Program (STIP) projects as follows: (1) limits the reimbursement provisions to projects programmed in the current year of the STIP; (2) requires the local or regional entity to request an allocation from the California Transportation Commission (CTC) within 12 months of its first advance expenditure on a qualified project; (3) requires CTC to approve a future allocation of funds if the project meets all of the requirements for reimbursement but funds are insufficient for a current allocation.

AB 311 (Baca-D) City of San Bernardino: parking structure funding
Appropriates $1,200,000 in federal Petroleum Violation Escrow Account funds to the Department of Transportation for allocation to the City of San Bernardino for the purposes of constructing a six level parking structure at the Santa Fe Depot.

Establishes a review process involving the Department of Transportation and specified regional transportation planning agencies for evaluating transportation planning computer models and requires selected transportation planning agencies to incorporate measures pertaining to land use transit service levels into these models.

Exempts specified levee and highway and bridge seismic retrofit projects from the California Environmental Quality Act, authorizes a master environmental impact report, as specified, for a plan adopted by the Department of Transportation (DOT) for improvements to regional segments of Highway 99, and authorizes DOT to participate in a self-certification process for transportation projects.

AB 1157 (Frommer-D) Rail Safety and Traffic Mitigation Bond Act of 2006
States the intent of the Legislature to enact legislation providing for a general obligation bond act in the amount of $500 million to be submitted to the voters for approval in order to provide funding for a program to eliminate the most dangerous railroad-highway grade crossings in the state, as identified by the Public Utilities Commission, with funds to be allocated by the California Transportation Commission.

AB 1649 (Liu-D) Metro Foothills Gold Line Construction Authority`
Changes the name of the Pasadena Metro Blue Line Construction Authority to the Metro Foothills Gold Line Construction Authority and revises the composition of its governing board's membership. Authorizes the appointing entity to remove members of the board at any time and appoint a replacement, specifies a schedule for construction of the light rail project, and requires the Los Angeles County Metropolitan Transportation Authority to submit a financial plan to the Legislature for this construction.

Requires interest to be paid on a loan of revenues subject to either Article XIX or XIX A of the California Constitution if the loan is not repaid during the same fiscal year in which it was made, requires the loan made pursuant to Article XIX or XIX A to be made pursuant to a statute establishing the terms for repayment and prohibits the enactment of a statute making a new loan pursuant to Article XIX or XIX A prior to the full repayment of each previous loan under Article XIX or XIX A, respectively, and prohibits a loan from being authorized by a statute during more than two fiscal years within any period of 10 consecutive fiscal years. Authorizes tax revenues subject to Article XIX or XIX A to be loaned to other state funds or accounts in addition to the General Fund.

SB 1416 (Battin-R) Air resources: gasoline supply
Requests the University of California to conduct a study on the impact of allowing gasoline that does not comply with reformulated fuel standards established by the Air Resources Board and authorizes any gasoline that does not meet California standards, but is approved for sale by the federal Environmental Protection Agency, to be imported into and sold in the state.

SB 1601 (Lowenthal-D) Air pollution: marine ports: emissions
Requires the marine ports of Long Beach, Los Angeles and Oakland to include, as a condition of any new lease or significant renegotiated existing lease between the marine port and any entity to lease any part of port property or any right-of-way, an express condition that the lessee use best available control technology for reducing particulate matter and nitrous oxide emissions form specified sources (i.e., ocean-going vessels, harbor craft, cargo handling equipment, on-road heavy-duty vehicles and certain locomotives).

SB 1675 (Kehoe-D) Vehicular air pollution: renewable diesel fuel
Requires all diesel fuel sold or offered for sale in the state to contain at least two percent biodiesel, and two years thereafter, five percent biodiesel.

SB 1839 (Perata-D) Smog check: Inspection and Maintenance Review Committee
Deletes the requirement that the Inspection and Maintenance Review Committee (Committee) review the protocol for the pilot program which exempts certain vehicles from the biennial certification requirements and provides that the Committee and its various functions and responsibilities remain in effect only until December 31, 2005. Makes conforming changes with regard to the functions of the Committee.

AB 184 (Cogdill-R) Air quality: high polluter vehicles
Establishes a vehicle replacement program at the Department of Consumer Affairs through which vehicles that meet certain air emissions standards can be donated to the program to be made available to replace high-polluter vehicles voluntarily turned in to the program by the other person.

AB 679 (Calderon-D) Air resources: diesel fuel
Prohibits the Air Resources Board (ARB) from adopting any regulation that excludes the importation of compliant diesel fuel, as defined, by entities that do not have refineries in California, requires the ARB to convene a panel of interested parties to develop a test protocol for the evaluation of the ARB diesel fuel, and to recommend a subsequent test program that measures the emissions benefits of ARB diesel fuel, and requires ARB to complete the test program and submit results to the Legislature by December 31, 2007.

AB 898 (Maze-R) Air pollution: smog check: technicians
Requires the Department of Consumer Affairs, with respect to the qualification tests for smog check technicians, to do the following: (1) review the qualification requirements imposed on smog check technicians in other states and make the requirements imposed in this state as consistent as possible with those in other states; (2) establish prerequisite training for smog check technicians and permit an individual who completes 60 hours of that training to take a qualification examination, and (3) revise the qualification requirements to permit an applicant to become a smog check technician by completing the prerequisite training and passing the smog check qualification examination that would be required to be as consistent as possible with those in other states and appropriate for a smog check technician.

AB 1012 (Nation-D) Vehicular air pollution control: clean alternative fuels
Requires the Air Resources Board to adopt regulations to ensure that one-half of new passenger and light-duty trucks, beginning in 2020, sold in California are clean alternative vehicles.

AB 1678 (Saldana-D) Ports and harbors: vessels: air pollution
Requires the Port of San Diego, on or before, January 1, 2007, to provide a report to the San Diego Air Pollution Control District, including: (1) an inventory of air emissions from stationary and mobile sources; (2) an assessment of the number of vessel port visits per year; (3) a standard for ship electrification, as defined, and (4) an economic feasibility study of various air pollution reduction measures, including, cold-ironing, as defined, and a timeline for implementing these measures.

AB 1870 (Lieber-D) Air pollution: motor vehicle inspection and maintenance
Requires the Department of Consumer Affairs, Bureau of Automotive Repair, to include a visual smog check test to determine presence of smoke in automobile exhaust. Makes changes to the consumer assistance programs available to motor vehicle owners whose vehicles fail smog check.

AB 1901 (Shirley Horton-R) Air pollution: truck retrofit revolving loan program
Establishes the Truck Retrofit Revolving Loan Program at the Energy Resources, Conservation and Development Commission to provide loans to businesses to retrofit large trucks with a SmartWay Upgrade Kit designed to improve the trucks' energy efficiency and reduce emissions of pollutants and greenhouse gases.

Requires the Bureau of Automotive Repair to develop and administer a voluntary program to replace high polluter vehicles with donated low-emission motor vehicles and donated vehicles that meet existing smog inspection and maintenance regulations.
