The following legislation was enacted to assist domestic partners and enhance protections for those being discriminated based on sexual orientation: SB 1441 (Kuehl) prohibiting sexual orientation discrimination by state entities and recipients of state aid; SB 1827 (Migden) requiring registered domestic partners to file personal income tax returns, as either (a) married filing joint or (b) married filing separate; AB 1207 (Yee) revising the Code of Fair Campaign Practices, to which candidates may voluntarily subscribe, to specify that a candidate will not use or permit any appeal to negative prejudice based on a candidate’s actual or perceived race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status age, sexual orientation, or sex, including gender identity; AB 2051 (Cohn) establishing training and services for lesbian, gay, bisexual, and transgender victims of domestic violence; AB 2800 (Laird) enacting the Civil Rights Housing Act of 2006 to specifically place anti-discrimination protections of the Fair Employment and Housing Act within various codes relating to housing; and AB 2920 (Leno) requiring the Department of Aging to ensure equal access to programs and services funded through the Older American Act, and that all programs administered by the department and the Area Agencies on Aging account for the needs of lesbian, gay, bisexual, and transgender elders.
Vetoed legislation of note included SB 1437 (Kuehl) prohibiting instruction, or the adoption of any instructional material, that reflects adversely on persons due to sexual orientation; SB 1441 (Kuehl) prohibiting sexual orientation discrimination by state entities and recipients of state aid; SB 1471 (Kuehl) providing for the California Community Sexual Health Education Act; AB 606 (Levine) providing for the Safe Place to Learn Act requiring the Department of Education to develop, and school districts to adopt, a model policy, and take other actions to prevent or remedy discrimination and harassment based on specified characteristics including actual or perceived gender identity and sexual orientation; and AB 1056 (Chan) providing for the Tolerance Education Pilot Program.
