SB 41 (Yee-D) Hypodermic needles and syringes

Suspends certain provisions of the Disease Prevention Demonstration Project, including the ability for a city or county to authorize pharmacists to provide up to 10 hypodermic needles and syringes without a prescription, until 1/1/15, and until then permits pharmacists and physicians to furnish up to 30 hypodermic needles and syringes for human use, without a prescription or city/county authorization, to a person 18 years or older, as specified.

SB 422 (Wright-D) AIDS/HIV: reporting

Authorizes physicians to disclose nonidentifying HIV patient information to the designated staff of the local public health agency for HIV partner services, or identifying information with the written consent of the individual. Clarifies that a local health officer and the designated local public health agency staff for HIV partner services are exempted from civil and criminal liability for alerting the specified partners of an HIV positive person, without disclosing any identifying information about the person believed to be infected with HIV. Authorizes a local health officer or designated local public health agency staff to expunge any identifying information of a potentially exposed partner only after efforts have been made to contact, alert, and refer the partners for testing and treatment.

SB 531 (Rubio-D) HIV testing: search warrants

Requires a defendant to be tested for the human immunodeficiency virus (HIV) within 48 hours of a search warrant being issued authorizing the administration of the test if the victim of a forcible sex offense requests the testing. Requires the local health officer to disclose the HIV test results as soon as practicable to the victim and defendant.

Allows the Department of Public Health (DPH) to authorize entities meeting specified criteria to provide clean hypodermic needle and syringe exchange programs in any location where DPH determines conditions exist for the rapid spread of deadly or disabling disease spread through the sharing of unclean hypodermic needles and syringes. Requires the Department of Health Care Services (DHCS) to conduct a three-year pilot project to determine the feasibility of developing a blended per-capita payment rate for services provided to enrollees with HIV or AIDS in Medi-Cal primary care case management. Requires DHCS to pay these rates to a Medi-Cal primary care case management plan or successor Knox-Keene plan for beneficiaries with HIV or AIDS.

AB 1348 (Mansoor-R) AIDS/HIV: pupils: parental consent

Among other provisions, prohibits a pupil to receive comprehensive sexual health education, HIV/AIDS prevention education, or assessments related to that education without the prior written consent of his/her parent or legal guardian; requires each school district to advise the parent or guardian that his/her child will not receive comprehensive sexual health education or HIV/AIDS prevention education without the prior written consent of a parent or legal guardian; and, requires an alternative educational activity be made available to pupils whose parents have not given prior written consent to receive such instruction or assessments.

AB 1192 (Garrick-R) Immunization information: pertussis

Requires the Department of Public Health (DPH) to make available on its Internet Web site the following information for use by hospitals: the signs of pertussis; the availability of a vaccine to protect against pertussis; and the recommendation of the federal Centers for Disease Control and Prevention that those with close contact with newborns receive vaccination against pertussis. Permits hospitals to distribute this information to the parents of newborn children. Prohibits anything in this bill from requiring a hospital to provide or pay for vaccination against pertussis.

Imposes a Quality Assurance Fee (QAF) on specified hospitals for 30 months (from 6/30/11 until 12/31/13), and uses the resulting revenue to draw down federal funds to provide supplemental payments to private hospitals in fee-for-service Medi-Cal, Medi-Cal managed care, and for acute psychiatric days, and to provide specified funding amounts from the QAF per quarter for children's health coverage until 12/31/13. Requires county and University of California hospitals to be paid direct grants (not Medi-Cal payments), funded from the QAF. Establishes the Low-Income Health Program Medicaid Coverage Expansion Out-of-Network Emergency Care Services Fund (LIHP Fund), and requires monies in the LIHP Fund to be used for medically necessary hospital emergency services for emergency medical conditions and post-stabilization care furnished by private hospitals and nondesignated public hospitals outside of the LIHP coverage network. Reduces disproportionate share hospital replacement payments and supplemental payments from the Private Hospital Supplemental Fund to hospitals by specified amounts in 2012-13 and 2013-14. Appropriates $13.6 billion to the Department of Health Care Services for purposes of this bill.

AB 366 (Allen-D) State hospitals: involuntary antipsychotic medication

Revises the procedures governing the involuntary administration of antipsychotic medication to state hospital patients. Commencing 7/1/12, (1) provides that where a court finds a defendant incompetent to stand trial, the court shall determine if the defendant has the capacity to make decisions concerning medication, (2) provides that where the defendant consents to take medication and then withdraws consent during treatment, the Department of Mental Health (DMH) may conduct a certification process to determine if there are grounds to involuntarily medicate the defendant until a court hearing is held within 21 days, (3) provides that where an incompetent to stand trial defendant does not consent to take medication and the court does not authorize involuntary medication, DMH may also conduct an involuntary medication certification process pending a court hearing within 21 days, and (4) grants the defendant a right to hearing before an administrative law judge as part of the certification process.

Requires county and University of California hospitals to be paid direct grants (not Medi-Cal payments), funded from the QAF. Establishes the Low-Income Health Program Medicaid Coverage Expansion Out-of-Network Emergency Care Services Fund (LIHP Fund), and requires monies in the LIHP Fund to be used for medically necessary hospital emergency services for emergency medical conditions and post-stabilization care furnished by private hospitals and nondesignated public hospitals outside of the LIHP coverage network. Reduces disproportionate share hospital replacement payments and supplemental payments from the Private Hospital Supplemental Fund to hospitals by specified amounts in 2012-13 and 2013-14. Appropriates $13.6 billion to the Department of Health Care Services for purposes of this bill.

SB 796 (Blakeslee-R) State hospitals: prohibited items: misdemeanor penalty

Provides, (1) except as specified, a person who possesses with the intent to deliver, or delivers, to a patient in a state hospital a wireless communication device, tobacco products or currency, except as authorized, is guilty of a misdemeanor, punishable by a fine not to exceed $1,000 for each item, (2) notwithstanding the above provisions, if a person visiting a patient in a state hospital, upon being searched or subjected to a metal detector, is found to be in possession of any of these items, the item shall be subject to confiscation but shall be returned on the same day the person visits the patient, unless the item is held as evidence in a case where the person is cited for smuggling contraband, as specified, and (3) notice of this provision shall be posted in all areas where visitors are searched prior to visitation with a patient.

Requires a certified Traditional Chinese Medicine (TCM) traumatologist, when engaging in manipulation techniques to realign the musculoskeletal and ligamentous relationship, to be supervised by a physician and surgeon who has completed an orthopedic residency program. Requires the extent of the relationship between a TCM traumatologist and orthopedic surgeon regarding manipulation techniques to be determined by the Committee after the certification standards are defined by the Committee and adopted by the Board.

SB 632 (Emmerson-R) Pharmacy

Prohibits a pharmacist from substituting "tamper resistant" opioid analgesics, as defined, for other drug products, including generic drugs, if the prescription orders one of the "tamper resistant" types opioid analgesics. Requires the Board of Pharmacy to establish a list of "tamper resistant" opioid analgesics according to certain qualifications. Authorizes a pharmacist to substitute a prescribed opioid analgesic for one that is on the list created by the Board. Allows mandated reporters to report known or suspected elder abuse over the Internet, and requires an Internet report to contain the same information elements as a telephone report. Allows a written abuse report that is currently required as a follow-up to the telephone report to be submitted through a confidential Internet reporting tool, if the county or long-term care ombudsman program chooses to implement such a system. Requires that county ombudsmen who implement the Internet reporting option report to the relevant legislative policy committees on the effectiveness of this reporting tool.

Requires the Health and Human Services Agency to ensure that the design of the review system recognizes and is coordinated with existing performance review and accountability systems. Directs the Agency to draft an information sharing plan to enable the exchange of information and data necessary to evaluate health and human programs and promote the adoption of best practices.

Makes findings and declarations regarding medical marijuana, and provides that it is the intent of the Legislature to improve the Compassionate Use Act of 1996 and the state’s medical marijuana program by establishing a comprehensive and multidisciplinary commission that is empowered to address issues regarding the legality and implementation of the Compassionate Use Act of 1996 and the state’s medical marijuana law. Provides that nothing in the Compassionate Use Act of 1996 authorizes a qualified patient or person with an identification card to engage in the smoking of medical marijuana under any of those specified circumstances, including within 600 feet of the grounds of a school, recreation center, or youth center, unless the medical use occurs within a residence or within a medical marijuana cooperative, collective, or dispensary.

Repeals provisions in existing law which permits the Department of Justice to employ a physician to interview and examine any patient in connection with the prescription possession or use of a controlled substance, requires the patient to submit to the interview and examination, and permits the physician to testify in prescribed administrative proceedings.

Requires, if a request for a certified copy of a birth, death, or marriage record is made in person, that the requester produce government-issued photo identification, in addition to the existing requirement of a statement sworn under penalty of perjury. Specifies that a child, grandparent, grandchild, sibling, spouse, or domestic partner of a registrant, who requests a certified copy of a registrant’s birth, death, or marriage record, must be an adult or emancipated minor in order to satisfy the definition of an authorized person for that purpose.

Revises the definition of acceptable nutritional guidelines for this purpose, increasing from 35% to 50% of food, and 50% of beverages, that must meet these guidelines. Requires, beginning 1/1/14, or upon expiration of an existing contract, whichever occurs later, any food sold in a state-owned or state-leased building to meet the standard criteria for food and nutritional guidelines for concessions as determined by federal guidelines.

Enacts the Toxin-Free Infants and Toddlers Act, which, except as specified, prohibits, on and after 7/1/13, the manufacture, sale, or distribution in commerce of any bottle or cup that contains bisphenol A, at a detectable level above 0.1 parts per billion, if the bottle or cup is designed or intended to be filled with any liquid, food, or beverage intended primarily for consumption by infants or children three years of age or younger. This prohibition will cease to be implemented for an item, on the date that a prescribed notice is posted regarding the Department of Toxic Substances Control's adoption of related regulations.

Authorizes, until 1/2/18, the sale of certified safe and sane fireworks from 9 a.m. December 26 through January 1 pursuant to a license issued by the State Fire Marshal, if authorized by a city, county, or city and county ordinance or resolution that may also restrict the hours of use of those fireworks. Requires, until 1/1/18, the State Fire Marshal to establish and collect an additional fee on permits issued to licensees in an amount necessary to enforce applicable laws with respect to training and education regarding dangerous fireworks. The fees will be deposited in the State Fire Marshal Dangerous Fireworks Training and Education Fund, which the bill establishes. Monies in this Fund will be continuously appropriated without regard to fiscal years to the State Fire Marshal for the purpose of training local fire and law enforcement agencies, as specified.
