SB 1 (Murray-D) Million solar roofs initiative
Makes statutory changes necessary to expand the scope of the California Solar Initiative, a solar program implemented by the Public Utilities Commission (PUC), to apply to all electricity utilities, imposes specific requirements on the PUC in implementing the program, and requires developers to provide the option of solar panels on new homes.

SB 107 (Simitian-D) Renewable energy
Accelerates the Renewables Portfolio Standard (RPS) requirement from 2017 to 2010. The RPS is a program that requires investor-owned utilities to, among other things, achieve a 20 percent renewable electricity portfolio. Makes several other related changes.

SB 339 (Dutton-R) Emergency telephone systems
Requires local public agencies operating an emergency telephone system to use primary safety answering points in a triage manner so that callers would receive those services needed or appropriate to the situation that caused the emergency telephone call.

SB 386 (Campbell-R) Public Utilities Commission: inspection and audits
Requires the audits performed every three years by the Public Utilities Commission of the major electric, telephone and water corporations to conform with the Government Auditing Standards published by the Comptroller General of the United States, and where applicable, to the Generally Accepted Auditing Standards of the American Institute of Certified Public Accountants.

SB 423 (Simitian-D) Electricity: charges: charitable organizations
Permits an electric service provider to donate free electric commodity source to a nonprofit charitable organization. Requires the nonprofit to pay all nonbypassable charges imposed on other ratepayers. Sunsets on January 1, 2010.

SB 426 (Simitian-D) Liquefied natural gas terminals
Requires the California Energy Commission to evaluate and rank every proposed liquefied natural gas terminal and directs the Governor to disapprove an application for a license to construct and operate a liquefied natural gas terminal if the project is not ranked one of the two highest ranked sites.

SB 431 (Battin-R) Electricity: re-powering of facilities
Requires electric utilities, to encourage "re-powering" of existing renewable energy generators, to offer specified contract and pricing options.

SB 440 (Speier-D) Telecommunications: billing
Provides additional protections and information to mobile and wireline telephone customers regarding billing discrepancies. Attempts to ensure that cell phone customers are aware of their rights to contest charges which were not authorized and to prevent telephone companies from adversely affecting the customer while their complaints about unauthorized charges are being investigated.

SB 501 (Machado-D) Electric generation facilities
Provides technical amendments to clarify that state-assessed electrical generation property is assigned by the Board of Equalization (BOE) to a specific tax rate area, rather than a countywide tax rate area, when preparing the BOE roll of state assessed property.

SB 534 (Runner-R) Telecommunications: mobile telephony services
Requires a cellular telephone company to post information on its web site when a public hearing is scheduled to site an antenna or associated facility.

SB 628 (Dutton-R) State Energy Resources Conservation & Development Commission
Requires the California Energy Commission (CEC) to allow parties to present testimony about alleged misuse of its administrative procedures to exert economic pressure on a party to enter into a labor agreement. Requires the CEC to take certain steps to maintain its neutrality in labor disputes.

SB 632 (Dutton-R) Electrical corporations: rates
Requires the Public Utilities Commission to continue the availability of optional interruptible or curtailable service at least through December 31, 2009, and prohibits, until after that date, the reduction of the level of the pricing incentive for interruptible or curtailable service below the levels in effect on December 31, 2004.

SB 641 (Campbell-R) Electricity: electrical restructuring
Repeals the provisions of AB 1X (Keeley), Chapter 4, Statutes of 2005, suspending direct access during the term of the Department of Water Resources (DWR) contracts and instead requires the Public Utilities Commission (PUC) to permit direct access, pursuant to a "core/non-core" structure to be defined by the PUC. Requires the PUC's core/non-core structure to require direct access customers to bear a fair share of DWR's electricity costs or to accept a proportionate allocation of the electrical generation resources used by the investor-owned utilities to serve the departing customer.

SB 664 (Morrow-R) Public utilities: telegraph and telephone lines
Provides that the authorization for telegraph or telephone corporations to construct lines, as specified, does not apply to the construction or placement of towers, facilities, or other wireless repeaters, amplifiers, regenerative repeaters, or regenerators, to provide mobile telephony services, as defined.

SB 690 (Cox-R) Public contracts: utility districts: competitive bids
Establishes a threshold of $15,000 or more for specified public works contracts awarded by a municipal utility district and prescribes the procedures to be followed in the advertisement and solicitation of bids. Provides that a public work may be performed without advertising for bids, by day labor, upon unanimous consent of the district's board, and in response to an emergency, as defined.

SB 757 (Kehoe-D) Oil Conservation, Efficiency, and Alternative Fuels Act
Enacts the Oil Conservation, Efficiency, and Alternative Fuels Act. Requires state agencies to reduce the growth of petroleum demand, increase vehicle energy efficiency and increase the use of alternative fuels.

SB 769 (Simitian-D) Energy Reliability and Affordability Act
Requires the Public Utilities Commission to expand existing low-income ratepayer refrigerator replacement.

Permits the Public Utilities Commission to expend up to $2 million for the nonrecurring installation costs for high-speed broadband services for specified community-based organizations.

SB 951 (Escutia-D) Public Utilities Commission: compensation
Provides that the provisions pertaining to participant and intervenor compensation are to be liberally construed to promote participation. Contains legislative findings that articulate an interest in a more comprehensive effort to hear from the public.

SB 984 (McClintock-R) Greenhouse gas emissions reductions: powerplants
Requires the California Energy Commission to perform an assessment of life-cycle costs and environmental impacts of existing and proposed electric generation technologies, including fossil, nuclear, renewable, and hydroelectric, as specified.

SB 1003 (Escutia-D) Energy resources: liquefied natural gas terminals
Requires the California Energy Commission to establish a permitting process for the siting and construction of liquefied natural gas facilities.

SB 1017 (Campbell-R) Solar energy: taxation
Makes the credit relating to the use of solar or wind energy systems, as defined, applicable for taxable years beginning on and after January 1, 2004, and before January 1, 2017. Continues the exclusion for an active solar energy system, as defined, until January 1, 2018, for property tax lien dates for the 1999-2000 to 2016-17 fiscal years, inclusive.

SB 1048 (Machado-D) Electrical restructuring: distributed energy resources
States legislative intent to develop distributed generation projects to generate electricity using natural gas that is a by-product of oil production, as such projects reduce air pollution and economically benefit electricity consumers and owners of facilities that generate electricity.

SB 1059 (Escutia-D) Electric transmission corridors
Authorizes the California Energy Commission to designate electric transmission corridor zones, according to a specified process, in which high-voltage electric transmission lines may be built in the future.

SB 1169 (Cox-R) Municipal utility districts: purchases
Repeals the January 1, 2007 automatic termination date in the statute that allows municipal utility districts to use a "best value at the lowest cost acquisition" process to award contracts of more than $50,000 for the purchase of supplies and materials, and makes the repeal permanent for those that used the process prior to January 1, 2006.

SB 1368 (Perata-D) Electricity: emissions of greenhouse gases
Requires the State Energy Conservation and Development Commission (ECDC) to set emission (e.g., pollution) standards for those entities providing electricity in the state. Requires the Public Utilities Commission to prohibit electricity providers and corporations from entering long-term contracts which do not meet the ECDC's standard.

SB 1554 (Bowen-D) Local publicly owned electric utilities: cost responsibility
Prohibits the imposition of exit fees on customers of a local publicly owned electric utility (POU) by prohibiting the Public Utilities Commission from imposing a cost responsibility surcharge on a customer of a POU if the customer's service location has not previously received service from an investor owned utility.

SB 1597 (Denham-R) Taxation: Emergency Telephone Users Surcharge Act
Provides that monies raised pursuant to the Emergency Telephone Users Surcharge Act shall be held in trust for future 911 emergency service projects.

SB 1651 (Maldonado-R) Telephone records: obtaining
Makes the willful obtaining of another person's telephone calling pattern record or list, without the consent of that person, a public offense punishable by fine or imprisonment, or both. Authorizes a person to bring an action against an individual or legal entity.

SB 1665 (Figueroa-D) Telephone records: unauthorized procurement
Makes it a crime to knowingly procure, attempt to procure, solicit, or conspire to procure, a telephone calling pattern record or list, of another person, without the written authorization of the customer. Makes it a crime to knowingly sell, offer to sell, or conspire to sell, a telephone calling pattern record or list. Authorizes a customer and a telecommunications service to bring an action.

Requires load-serving entities to provide public disclosure of procurement-related filings, including resource adequacy and renewable portfolio standard requirements, comparable to that required of an electrical corporation.

SB 1705 (Ashburn-R) California Environmental Quality Act: negative declaration
Authorizes a lead agency to adopt a negative declaration or mitigated negative declaration for a proposed project to upgrade, replace, or modify an energy infrastructure, that is (1) undertaken along an existing every corridor, or utility right-of-way, (2) at a minimum, returns the habitat on the energy corridor or utility right-of-way to preexisting conditions or enhances the habitat environment, and (3) the project proponent posts with, or submits to, the lead agency a bond in an amount sufficient to cover the project costs of performing the habitat restoration.

SB 1727 (Kehoe-D) Public utilities: electrical corporations
Creates an exception from the definition of an "electrical corporation", where electricity is generated on private real property and privately distributed across a highway, to an immediately adjacent private real property, solely for its own use or the use of tenants and not for sale or transmission to others. Makes conforming changes for those using cogeneration, land fill gas technology, and digester gas technology for the generation of electricity.

Requires the Public Utilities Commission to report on the impact the repeal of the Public Utility Holding Company Act of 1935 will have on California consumers and strategies that could reduce negative impacts.

AB 401 (Levine-D) Fuel cell customer-generators
Removes the January 1, 2006 repeal date of the standard tariff to provide for net energy metering, for eligible fuel cell customer-generators, as defined, thereby making the tariff requirement operative indefinitely. Under the bill, a fuel cell electrical generating facility, would not be eligible for participation in the tariff unless it commenced operation before January 1, 2010, and a fuel cell customer-generator would be eligible for the tariff only for the operating life of the eligible fuel cell electrical generating facility. Prohibits the combined statewide cumulative rated generating capacity used by the eligible fuel cell customer-generators in the service territories of all electrical corporations from exceeding 112.5 megawatts.

AB 650 (Cogdill-R) Electrical restructuring: aggregation
Authorizes certain irrigation districts and municipal utility districts to act as community choice aggregators. Provides procedures for a city, county, or city and county to opt out of a community choice aggregation program proposed by an irrigation district or a municipal utility district.

AB 701 (Nava-D) State buildings: energy and design criteria
Requires all state buildings on which construction or renovation is begun on or after January 1, 2006, to obtain a Leadership in Energy and Environmental Design (LEED) Platinum rating, as developed by the United States Green Building Council (USGBC) no later than January 1, 2015. A minimum score, as set forth in "Version 2.1" of LEED that USGBC published in March of 2003, shall determine compliance with this bill.

AB 737 (Jerome Horton-D) Property tax revenue allocations: public utilities
Requires that all property tax assessed value of a public utility plant and associated equipment be allocated entirely to the county in which the facility is located, and that the revenues derived from the tax be allocated to the county and to school districts and cities within the county, as applicable.

AB 745 (Blakeslee-R) Public utilities: eminent domain
Exempts privately-owned natural gas companies and electric companies from certain public notice and hearing requirements at the Public Utilities Commission (PUC) before the natural gas companies can condemn land as part of an eminent domain proceeding if the condemned land is to be used for PUC authorized natural gas storage.

AB 974 (Nunez-D) Electrical transmission infrastructure
Increases the reporting of information on transmission capacity. Directs the Public Utilities Commission to expedite approval of transmission projects.

AB 993 (Canciamilla-D) Energy resources: energy efficiency training
Requires the Chancellor of the California Community Colleges to encourage one or more Economic and Workforce Development Program regional centers to develop a course of training on energy efficiency for facilities managers, and incorporate this training into one of the program's existing initiatives.

AB 1009 (Richman-R) Electricity: time-of-use pricing tariffs
Requires the Public Utilities Commission (PUC), in consultation with other related entities, to develop time-of-use electricity pricing tariffs and require real-time meter for customers of investor-owned utilities. Implementation of the tariffs would be phased in; starting with the largest users by January 1, 2007, and encompassing all customers by January 1, 2014.

AB 1010 (Oropeza-D) Telecommunications: mobile telephony services
Requires providers of mobile telephone service to provide a minimum 21-day grace period to new customers, during which the customer may rescind the agreement.

AB 1082 (Ruskin-D) Telecommunications: consumer protection
Requires the Public Utilities Commission to develop and enforce consumer protection rules for telecommunications service, including mobile telephony services. Prescribes circumstances under which telephone and telegraph corporations may release certain information regarding residential subscribers without their express consent.

AB 1206 (Jerome Horton-D) Telecommunications: new area codes
Requires that the telephone number utilization study be performed within 18 months of the approval of the new area code. Applies these provisions to any pending area code decision that has not been fully implemented as of January 1, 2006. This includes the recently approved 310 area code decision.

Permits the Public Utilities Commission to establish two specific grant programs to provide advanced telecommunications network services to community technology programs and public libraries that deliver education services to pupils and health care facilities. Permits any funds repaid to the California Teleconnect Fund from the General Fund to be used for these programs.

Deletes a rebuttable presumption, and instead requires a local public entity that appropriates electric, gas, or water public utility property to prove a more necessary use by clear and convincing evidence that the public utility has continually failed to comply with governing rules and regulations.

AB 1411 (DeVore-R) Telephone corporations: reimbursement of overcharges
Requires the Public Utilities Commission (PUC) to require that a telephone corporation that erroneously bills and collects charges in an amount greater than those authorized by the PUC, upon the request of the consumer that paid the overcharge, reimburse the consumer for the overcharge, along with interest at the rate of the percentage change in the Consumer Price Index for the previous 12 months, plus one percent.

Authorizes state governmental agencies to utilize private sector investment capital to study, design, construct, finance, and operate fee-producing infrastructure facilities, as specified.

Allows electricity generated from an existing hydroelectric facility that generates more than 30 megawatts of electricity to count toward the California Renewable Portfolio Standard.

AB 1621* (Klehs-D) Electrical corporations: Bay Area Rapid Transit
Provides, notwithstanding the provisions creating a dedicated rate component for the recovery of the unamortized balance of the regulatory asset awarded to Pacific Gas and Electric Company, that electricity provided to the Bay Area Rapid Transit that is purchased from a federal power marketing agency or its successor or from a local publicly owned electric utility, is not subject to fixed recovery amounts and fixed recovery tax amounts.
