Provides that if an employer fails to remit $500 or more in wage withholdings, the employer's violation is a misdemeanor and shall be punishable by imprisonment in a county jail for a period of not more than one year, by a fine of not more than $1,000, or both.

SB 400 (Jackson-D) Employment protections: victims of domestic violence

Expands the protections given to victims of domestic violence and sexual assault who take time off to obtain any relief (such as a temporary restraining order) to victims of stalking. Prohibits an employer from discharging, retaliating, or discriminating against an employee because of his/her known status as a victim of domestic violence, sexual assault, or stalking, as specified. Requires an employer to provide reasonable accommodation for an employee who is a victim of domestic violence, sexual assault, or stalking, as specified.

AB 263 (Roger Hernández-D) Employment: retaliation: immigration-related practices

Prohibits an employer or any other person or entity from engaging in unfair immigration-related practices, as defined, for the purpose of retaliation against any person who exercises any rights under the Labor Code; authorizes a civil action by an employee or other person who is the subject of an unfair immigration-related practice; and authorizes a court to order the appropriate government agencies to suspend certain business licenses held by the violating party for prescribed periods based on the number of violations. Requires a court to consider prescribed circumstances in determining whether a suspension of all licenses is appropriate; expands the protected conduct to include a written or oral complaint by an employee that he/she is owed unpaid wages; authorizes a private right of action for equitable relief, damages, and penalties by an employee against an employer who engages in unfair immigration-related practices; and establishes a three-tier license suspension and revocation scheme for first and subsequent violations. Clarifies that an employer is prohibited from discriminating, retaliating, or taking adverse action against an employee or job applicant who has engaged in prescribed protected conduct relating to the enforcement of the employee's or applicant's rights and provides up to a $10,000 penalty for violations thereof. Specifies that an employee is not required to exhaust administrative remedies or procedures to enforce this prohibition, and clarifies the procedures under which the Labor Commissioner investigates potential violations.

Permits an individual nonexempt employee to request an employee-selected flexible work schedule providing for workdays up to 10 hours per day within a 40-hour workweek, and allows an employer to implement this schedule without the obligation to pay overtime compensation for those additional hours in a workday. Requires the Division of Labor Standards Enforcement in the Department of Industrial Relations to enforce this provision and adopt regulations.

Establishes, for matters where the classification of a driver of a taxicab is to be determined, a presumption, rebuttable by clear and convincing evidence, that the driver of a taxicab is an independent contractor rather than an employee of the taxi company. Specifies, in order of decreasing significance, the factors used in rebutting the presumption, and specifies the factors that may not be considered as evidence of employer-like control by a taxi company.

Requires that a person agree in writing prior to completing an accredited business school based in the U.S. to establish a qualifying small business and employ residents of an economically impacted area in order to be eligible to participate in the Program. Establishes that the maximum allowable amount of loan repayment is $105,000. Requires the Board to recover the funds awarded plus interest if a program participant does not complete his/her contractual service obligation.

AB 1392 (Assembly Insurance Committee) Unemployment insurance: work sharing plans

Conforms state law to new federal requirements for the Work Sharing Program, as specified. Prescribes requirements for employees to be eligible for work sharing compensation, as defined. Requires that work sharing compensation be charged to employers' experience rating accounts in the same manner as unemployment compensation. Prohibits, among other things, employees from being eligible to receive any benefits pursuant to these provisions unless their employer agrees, in writing, and their bargaining agent agrees, in writing, pursuant to any applicable collective bargaining agreement, to voluntarily participate in the work sharing program.

Repeals the requirement that a copy of a prescription is a necessary element of a claim for reimbursement for a medication provided to an injured worker. Provides that any entity submitting a pharmacy bill for payment, on or after 1/1/13, and denied payment for not including a copy of the prescription from the treating physician, shall have until 3/31/14 to resubmit those bills for payment.

Creates the Self-Insured Group Security Fund (SIG Fund), a separate security fund for Self-Insured Groups (SIGs). Requires that the SIG Fund is governed by a seven-member board, as specified, one being the Director of the Department of Industrial Relations. Provides, until 7/1/14, the Self-Insurers' Security Fund must assume the workers' compensation obligations of all insolvent self-insured employers, including SIGs. Provides, after 7/1/14, the SIG Fund has the right and obligation to obtain reimbursement from every member of the insolvent SIG, up to the amount of the workers' compensation obligations, including administrative and legal costs. Creates an alternative process by which SIGs can secure their incurred liabilities in the SIG Fund whereby the SIG Fund posts a composite deposit that collectively secures the aggregate liability of SIGs.

SB 527 (Block-D) Workers' compensation: public employees: leaves of absence

Adds lifeguards employed by the City of San Diego on a full-time, year-round basis to the class of public safety employees who receive special, enhanced temporary disability benefits when they are unable to work due to illness or injury that arose out of, or in the course of, employment.

SB 626 (Beall-D) Workers' compensation

Expands the Commission on Health and Safety and Workers' Compensation to 10 members, adding another employer representative and an injured worker representative. Lifts the 24 visit cap on chiropractic, occupational therapy, and physical therapy visits and deletes the prohibition of a chiropractor serving as a primary treating physician. Allows a physician to continue to serve as the primary treating physician, even if additional treatment is denied, as long as the physician continues to comply with reporting requirements set by the Administrative Director of the Division of Workers' Compensation. Requires that all review of appropriate treatment in utilization review, Independent Medical Review, and medical provider network be conducted by medical professionals who hold the same California license as the requesting physician. Removes the confidentiality requirement of independent reviewers in the Independent Medical Review process. Allows for review of the Independent Medical Review decisions by the Workers' Compensation Appeals Board or the any higher court. Allows increases to permanent disability impairment ratings due to psychological disorders arising from a compensable injury.

AB 454 (Dickinson-D) Workers' compensation benefits: prevailing wages

Requires that when temporary disability benefits or permanent disability benefits are determined for average weekly earnings on a public works project they will be taken at the wages actually paid or the prevailing wage that was applicable to the work performed by the employee, whichever amount is greater. Provides that a Workers' Compensation Appeals Board determination of whether a project was a public work or, of the applicable prevailing wage, or both, has no effect in any other judicial or administrative proceeding.

AB 1315 (John A. Pérez-D) Green Collar Jobs Council

Adds the Speaker of the Assembly and the President Pro Tempore of the Senate as members of the California Workforce Investment Board and the Green Collar Jobs Council (GCJC). Authorizes the GCJC membership to include representatives from other state agencies, higher education, local workforce investment boards, industry representatives, philanthropic, nongovernmental, and environmental groups, as appropriate. Eliminates the GCJC's requirement to develop a strategic initiative and instead requires the GCJC to develop, and annually update, a common framework consisting of specified elements to address workforce needs arising from changes in the energy, building and construction, transportation, and other industries impacted by state policies to reduce greenhouse gas emissions.
