AB 53 (Dymally-D) Office of HIV/AIDS Prevention and Education
Renames the Office of AIDS the Office of HIV/AIDS Prevention and Education, and requires that the Department of Public Health (DPH) establish within the Office six regional HIV/AIDS centers, as prescribed. Requires DPH to fund culturally and linguistically appropriate outreach programs in each of those regional centers designed to significantly increase rates of early HIV/AIDS testing, and provides individuals who test positive for HIV or AIDS with appropriate referrals for care and medical treatment. Requires DPH to work collaboratively with community-based organizations focused on HIV/AIDS prevention services, and to utilize all available private services and existing partnerships to conduct outreach to populations that typically have little or no exposure to HIV/AIDS information.

AB 66* (Dymally-D) Inmate HIV testing
Requires HIV testing for consenting prison inmates and state hospital patients within 60 days of their entering the facility, and for those due to be incarcerated for at least a year, at least 60 days prior to their discharge. Inmates who test positive for HIV will receive post-test counseling as well as a care and treatment plan appropriate for his/her diagnosis and the opportunity to be housed in a specialized housing unit. Their parole officers will be notified as well, and both the parole officers and the institutions' medical officers will be authorized to inform the inmates' spouses or domestic partners that they may have been exposed to HIV. Requires the Department of Corrections and Rehabilitation to develop, in conjunction with HIV-positive or hepatitis B or C infected inmates' parole and probation officers and county local health officers, plans to refer inmates to local treatment services.

AB 110 (Laird-D) Drug paraphernalia: clean needle and syringe exchange
Permits a public entity that receives General Fund money from the Department of Public Health (DPH) for HIV prevention and education to use that money to support clean needle and syringe exchange projects (NEPs) that are authorized by the public entity, and permits the money to be used for, but not limited to, the purchase of sterile hypodermic needles and syringes. Requires funds allocated for the purchase of sterile hypodermic needles and syringes to be based upon epidemiological data as reported by the health jurisdiction in its local HIV prevention plan submitted to DPH, and requires local health officers in jurisdictions with NEPs to include information on the use of public funds for NEPs in their annual report, detailing the status of the project to their boards of supervisors or city councils.

Increases a continuous appropriation from the Medical Providers Interim Fund from $2 billion to $4 billion for use by Medi-Cal providers between July 1 and September 1 in any year during which a state budget has not been passed by June 30.

AB 272 (Garcia-R) HIV tests
Requires that any woman seeking an annual gynecological examination or family planning appointment be provided with information on HIV and AIDS, and requires that the woman be offered the option of being tested onsite, if available, or provided referral information to other testing locations. Requires, if the woman chooses to be tested for HIV, the physician or other health care professional attending the woman at the time the results are received to ensure that the woman receives information and counseling, as appropriate, to explain the results and the implications for the woman's health, including any follow-up care that is indicated.

SB 568 (Wiggins-D) Criminal procedure: mental competence
Defines "treatment facilities" to include a county jail for the sole purpose of administering antipsychotic medication pursuant to a court order. Upon the concurrence of the county board of supervisors, the county mental health director, and the county sheriff, the jail may be used to provide medically approved medication to defendants found to be mentally incompetent and unable to provide informed consent due to a mental disorder, pursuant to this chapter. In the case of Madera, Napa, and Santa Clara Counties, the concurrence shall be with the board of supervisors, the county mental health director, and the county sheriff or the chief of corrections, and states the maximum period of time a defendant may be given antipsychotic medications in a county jail "treatment facility" shall not exceed six months.

Requires DHS to review the plan or procedure as well as the hospital's compliance with it during surveys for compliance with state or federal statutes or regulations. Authorizes the Director of DHS to levy administrative penalties for violations. Requires the Office of Statewide Health Planning and Development to conduct a comprehensive study that identifies the needs for hospital and health facility non-nurse professional and technical staffing and to report its findings to the Legislature and the Governor by 12/31/08.

AB 113 (Beall-D) Hospitals: emergency medical services: reduction/elimination
Authorizes a county board of supervisors to designate a general acute care hospital as an "essential community facility" (ECF), and creates certain authorizations and requirements related to the ECF designation. Defines an ECF as a hospital that has been determined by the county as essential in promoting the public health and safety. Prohibits a county-owned hospital from being designated as an ECF. Requires an ECF hospital that provides emergency medical services and plans to reduce or eliminate services to notify local health authorities and all health plans that contract with the hospital 180 days in advance of a reduction or closure. Requires an ECF hospital to furnish a performance bond in an amount determined by the county board. A performance bond provided, pursuant to this bill, must be issued by specified insurance companies, pursuant to state and federal law, and requires a hospital that fails to provide the 180 days notice, required by this bill, to provide funds supported by a bond to the county to mitigate the impact of the hospital's closure on the community.

Requires that a nurse practitioner be issued a Board number prior to prescribing drugs and devices, and allows revocation or suspension or denial of a Board number for incompetence or gross negligence. Deletes the prohibition against a physician and surgeon supervising more than four nurse practitioners at one time.

Requires children removed from their homes as a result of abuse or neglect, and children removed from their homes as a result of being a "delinquent minor," to receive specified Child Health and Disability Prevention program health assessments and oral health services. Requires the county welfare department, at a hearing to terminate jurisdiction over a dependent child, as specified, to submit a report verifying that assistance in understanding the child's health care needs and locating health care providers that will be able to meet those needs has been provided to the child, and requires the Department of Health Care Services, to the extent federal financial participation is available, to extend Medi-Cal benefits to "independent foster care adolescents," as defined, while in foster care or guardianship, until the child reaches the age of 21 years, as specified.

Deletes the prohibition that the inability, in and of itself, of a prospective foster parent to meet a child's varying needs does not preclude a prospective foster parent from obtaining a foster family home license. Limits the state's share of the wage to 50% of the maximum aid payment for the family of the adult participating in the subsidized employment program, and limits state participation to county programs providing a maximum of six months of wage subsidies for each participant.

AB 92 (Garcia-R) School meals: pupil nutrition
Requires each schoolsite that meets the qualifications of the federal severe need reimbursement to offer breakfast, beginning with the 2008-09 school year. Authorizes the California Department of Education (CDE) to grant a waiver of the breakfast requirement if the local school governing board declares that providing breakfast is financially infeasible for the school and local education agency (LEA), even with a school breakfast start-up or expansion grant. Further specifies that prior to granting the waiver, CDE must provide the LEA with technical assistance to attempt to overcome barriers to offering school breakfast, and requires schools offering the federal school breakfast program for the first time to receive priority in funding for school-breakfast start-up grants.

Requires the Secretary of the Health and Human Services Agency, in coordination with other organizations and state agencies, to prepare and provide to the Legislature, by 7/1/08, a study to determine the benefits to the public health of eliminating saturated and artificial trans fat from food facilities. Requires the study to include, but not be limited to, (1) identification of the types and uses of products containing saturated and artificial trans fats in food facilities, (2) identification of substitutes for products containing saturated and artificial trans fats, prices of substitutes compared with the products containing saturated and artificial trans fats, and an examination of the available supply of substitute products, (3) examination of the percentage of meals consumed outside the home in California and the dollar amount of those meals, and (4) examination of the various negative health effects related to the consumption of artificial trans fats, and an estimated cost of health care related to the treatment of those effects.

AB 1603 (Caballero-D) Emergency services: cities
Provides that, notwithstanding any other provision of law or any prior statement of intent to not provide ambulance transportation service, any city, district, or other local government agency that currently provides paramedic service may elect to provide ambulance transportation service within its geographic jurisdiction, provided that this service complies with guidelines established by the emergency services agency for the county in which that city, district, or other local government agency is located.

Requires the State Public Health Officer in the Department of Public Health to appoint a State Public Health Nurse at the Chief Deputy Director level or higher.

AB 1634 (Levine-D) California Healthy Pets Act
Prohibits any person from owning or possessing any cat or dog over the age of six months that has not been spayed or neutered, unless that person possesses an intact permit. Establishes an intact permit fee in an amount to be determined by a local jurisdiction, and requires the revenue from these fees to be used for the administration of the local jurisdiction's permit program. Makes a violation of these provisions punishable by a prescribed civil penalty. Requires all revenues derived from these civil penalties be used for funding the outreach efforts in connection with, and the administration and enforcement of, these provisions, and to the extent funding is available, free and low-cost spay and neuter programs, and outreach efforts for those programs, which shall be required to be established by each local animal control agency. Authorizes, until 1/1/12, a local jurisdiction or its authorized local animal control agency to allow for issuance of an intact permit for one male and one female dog per household in order to allow the dogs to produce a single litter of offspring, subject to specified criteria. Authorizes the imposition of an intact permit fee for these purposes, in an amount determined by the local jurisdiction, to be used for funding the administration of the local jurisdiction's permit program. Provides that these provisions shall become operative on 4/1/08.

Authorizes, upon declaring the emergency, the public agency to perform all or any portion of the services specified in the contract, as specified.
