SB 494 (Kehoe-D) Vehicular air pollution control: clean alternative fuels
Requires the Air Resources Board (ARB), in consultation with certain other state entities, to adopt regulations by 6/30/09, that become operative by 1/1/10, to ensure that commencing 1/1/15, 25% of new passenger vehicles and light-duty trucks sold in California are clean alternative vehicles, and that commencing 1/1/20, 50% are clean alternative vehicles. Requires the ARB, in developing the regulations, to consider technological and economic feasibility of the regulations, develop and enforce compliance options for eligible clean alternative vehicles, and ensure that clean alternative fuel is made available at retail outlets whenever the ARB determines that the sufficient number of vehicles capable of using that fuel has been reached.

SB 587 (Runner-R) Air quality: permit requirement: exemptions
Exempts printing, coating, adhesive application, or laminating equipment, from existing permit requirements. Limits this exemption to: (1) equipment whose volatile organic compound emissions are no greater than three pounds per day or 66 pounds per calendar month; (2) equipment that employs ultraviolet or electric beam type materials and the total amount of inks, coatings, adhesives, or organic solvents used in this equipment, including in the cleanup, is no more than six gallons per day or 132 gallons per calendar month; and (3) equipment that employs ultraviolet or electric beam type materials that contain no more than 50 grams of volatile organic compounds per liter of material and use cleanup solvents containing no more than 50 grams of volatile organic compounds per liter of material. Also corrects an erroneous cross-reference.

SB 857 (Correa-D) Air pollution
Allows the San Joaquin Unified Air Pollution Control District and the South Coast Air Quality Management District to prepare a study and report to the Legislature, as specified, on the dollar amount that would be appropriate to authorize a tax credit for the purchase or replacement of qualified property, as defined, that is placed into service for the purpose of reducing air pollution.

SB 895 (Florez-D) Air quality
Increases the reserve amount in the Carl Moyer Air Quality Standards Attainment Program from 10% to 20% of program funds. Requires a scoring system to be used to determine which multidistrict projects to fund, and provides that projects that achieve the lowest cost per ton of emission reductions shall be assigned more points for priority.

SB 974 (Lowenthal-D) Ports: congestion relief: air pollution mitigation
Imposes a fee on container cargo imported and exported through the ports of Long Beach, Los Angeles, and Oakland in an amount not to exceed $30 per 20-foot equivalent unit. Requires that 50% of fee revenues be used to develop infrastructure projects that reduce congestion and 50% of revenues be used to mitigate the air quality impacts associated with the movement of freight in and out of the three ports. Specifies the processes for determining which congestion relief and mitigation projects shall be funded with fee revenue.

SB 1760 (Perata-D) Energy: greenhouse gas emissions
Creates the Climate Action Team (CAT), consisting of representatives from specified state agencies that shall be responsible for coordinating the states overall climate policy. Requires the CAT, on or before 1/1/10, and annually thereafter, to prepare, adopt, and present to the Legislature, a strategic research, development, and demonstration plan that establishes priorities and identifies key expenditure categories for research, development, demonstration, and deployment funds to be expended by the state agencies represented on the CAT for the following fiscal year. Requires the CAT, on or before 1/1/10, and biennially thereafter, to prepare and adopt a climate change impact adaptation and protection plan that includes specified information. Requires research, development, and demonstration funds that are administered by the Department of Transportation and allocated for clean technology, environmental protection, and public interest energy research to be expended consistent with the plan.

Defines "clean alternative fuel" as a nonpetroleum fuel, including electricity, hydrogen, natural gas, propane, and any other fuel derived from renewable resources, that on a full fuel-cycle and energy-equivalent basis does not increase the emissions of greenhouse gases, toxic air contaminants, criteria air pollutants, water pollutants, or any other substances known to damage human health or the environment, in comparison to the production and use of a petroleum-derived fuel.

Requires the master, owner, operator, agent, or person in charge of a vessel carrying, or capable of carrying, ballast water to maintain on board the vessel, in written or electronic form, records that include the manufacturer and product name of the ballast water treatment system on board the vessel, the name of the organization that has approved the system and the approval or certification number of the system, and the number of tanks and the volume of each tank that is managed using the system. Requires the master, owner, operator, agent, or person in charge of the vessel to provide that information to the State Lands Commission in electronic or written form using a form developed by the Commission upon the vessel's departure from a California port or place of call.

Provides that for taxable years beginning on or after 1/1/08, and ending before 1/1/13, there shall be allowed as a credit against the net tax of a "qualified taxpayer" an amount, as specified, for "qualified costs" paid or incurred for "qualified capital equipment" placed in service in California, certified by the California Climate Action Registry or the Air Resources Board, to result in measurable reductions in greenhouse gases.

Requires ARB, beginning 1/1/09, to impose an undetermined fee (the amount to be established by ARB), on the sale, or lease for one year or longer, of a new passenger motor vehicle that meets specified requirements. Requires ARB to conduct a study to determine the amount of air pollution, including, but not limited to, greenhouse gas emissions, created by the vehicles that are to be assesses a fee and the cost of mitigation for that air pollution, and adopt a system for assessing those vehicles for their fair share of air pollution a fee sufficient to fund that mitigation.

Establishes a fee to be paid at retail stores by consumers of cigars and cigarettes based on the amount and impact of environmental smoke, also known as secondhand smoke, released during smoking of cigarettes and cigars. Requires the Department of Public Health to adopt regulations to establish specific fees per cigar and cigarette to be assessed.

Authorizes a lead agency to prepare a short form environmental impact report for a project subject to the California Environmental Quality Act if the project meets specified criteria, including that the project is a qualified urban use, is within the area designated in a qualified programmatic plan for the type of proposed development, is consistent with the land use designation for the area and applicable standards of population density and building intensity, provides housing or employment near specified areas, and incorporates specified mitigation measures. Requires that a short form environmental impact report include specified information and comply with specified procedural requirements of the California Environmental Quality Act for an environmental impact report.

SB 429 (Ducheny-D) Environmental quality: land use controls
Requires the California Environmental Protection Agency, the California Integrated Waste Management Board, the State Water Resources Control Board, each California regional water quality control board, the Department of Toxic Substances Control, and specified local agencies, as specified, to notify the building, planning, or engineering department in the affected city or county if it takes certain actions with regard to approving a remedial action, removal action, closure, corrective action, or any other type of environmental cleanup action, finds that the property subject to the action is not suitable for unrestricted use, and requires that the property be subject to a land use control, or if it enters into, or imposes, a specified instrument or agreement restricting land uses.

SB 631 (Ashburn-R) State Water Resources Control Board
Changes the current prohibition for persons seeking membership to the State Water Resources Control Board (SWRCB) or a regional water quality control board (RWQCB) to instead prohibit any person from being on either the SWRCB or RWQCB if he/she receives, or has received during the previous two years, 25% or more of his/her income directly or indirectly from any person subject to specified waste discharge requirements or applicants for specified waste discharge requirements.

Provides that a discussion or analysis of alternatives, growth-inducing impacts, and cumulative impacts will not be required in the short form environmental impact report.

Replaces a general reference for ballast water requirements in a State Lands Commission report with a specific implementation schedule; extends the implementation date for ballast water requirements for new vessels with ballast water capacity less than 5000 metric tons from 1/1/09 to 1/1/10; and changes the date for the Commission to submit a review of the ballast water report to the Legislature from/before 1/1/09, to/before 1/1/10.

AB 19 (DeVore-R) Water quality: Santa Ana region
Establishes the Santa Ana Regional Water Quality Improvement Project and the Santa Ana Regional Water Quality Improvement Board, comprised of specified members, for the purposes of carrying out the act. Authorizes a city or county to allow a discharger within its jurisdiction, upon the request of the discharger, to become subject to regulation by the Santa Ana Regional Water Quality Improvement Board in lieu of the regional water quality control board for purposes of the act. Establishes the Santa Ana Regional Water Quality Improvement Fund and authorizes the developer of a development project, if the developer has become subject to regulation by the Santa Ana Regional Water Quality Improvement Board, to agree to pay a fee to the appropriate city or county, based on the acreage and density of the proposed development project, for deposit in the fund. Authorizes the Santa Ana Regional Water Quality Improvement Board, upon appropriation by the Legislature, to expend funds in the fund for research relating to urban runoff to be conducted by certain educational institutions, as specified, for formulation of mitigation measures for proposed development projects, and for mitigation projects that are approved by that board for the purposes of improving water quality within the region, including projects to mitigate the impacts of urban runoff. Requires the Santa Ana Regional Water Quality Improvement Board to prepare and submit to the Legislature, not later than 12/31/10, a report that describes the implementation of these provisions and the extent to which dischargers have become subject to the jurisdiction of that board, and that includes related recommendations. Sunsets on 1/1/13.

AB 169 (Levine-D) Public resources: ballast water management
Requires the master, owner, operator, agent, or person in charge of a vessel carrying or capable of carrying ballast water to maintain on board the vessel, in written or electronic form, records that include the manufacturer and product name of the ballast water treatment system on board the vessel, the name of the organization that has approved the system and the approval or certification number of the system, and the number of tanks and the volume of each tank that is managed using the system. Requires the master, owner, operator, agent, or person in charge of the vessel to provide that information to the State Lands Commission in electronic or written form using a form developed by the Commission upon the vessel's departure from a California port or place of call.

Allows certain taxpayers to claim a credit against the net tax equal to the costs paid or incurred during the taxable year to clean up a polluted brownfield property located in California to a satisfactory level. Identifies a taxpayer entitled to the credit as a qualified "brownfield" property owner that operates a small business. Requires the cleanup to be evidenced by a written certification of completion, which is defined as an evaluation by the Department of Toxic Substances Control of the effectiveness of a removal or remedial action conducted by a responsible party to reduce or eliminate actual or potential public health and environmental threats posed by a hazardous substance release site if the action itself is not overseen by the Department of Toxic Substances Control, and permits unlimited carryover of any unused credit.

Expands the California Beverage Container Recycling and Litter Reduction Act to include all plastic bottles, excluding food, and redefines the term "beverage" to include nut, grain, or soy drinks that contain any percentage of juice, and specifies that vegetable juice be sold in a beverage container 16 ounces or less is subject to the act until 1/1/10, and that vegetable juice in a beverage container of 32 ounces or less shall be subject to the Act after that date. AB 904 (Feuer-D) Recycling: food containers
Enacts the Plastic and Marine Debris Reduction, Recycling, and Composting Act which prohibits a takeout food provider, on and after 7/1/12, from distributing single-use food service packaging to a consumer, unless the single-use food service packaging is either compostable packaging or recyclable packaging. Requires a person who produces single-use food service packaging and distributes that single-use food service packaging in this state, on and after 7/1/11, to maintain and provide, upon request to any person, a list of the single-use food service packaging distributed by that person that is recyclable or compostable. Provides for the imposition of a civil penalty, of not more than $100 per day upon a person violating these requirements, and provides that the total penalties assessed annually upon a person violating these requirements shall not exceed $10,000. Requires the California Integrated Waste Management Board (CIWMB) to publish annually a list setting forth any penalties that have been levied against a violator of this act. Requires the CIWMB to deposit all penalties paid pursuant to the act into the Marine Debris Reduction Account, which the bill creates in the Integrated Waste Management Fund in the State Treasury. Authorizes the CIWMB to expend the moneys deposited in the account, upon appropriation by the Legislature, to provide public education and assist local governmental agencies in efforts to reduce plastic waste and marine debris, and for the board's costs of implementing the Act.

Requires a city or county, on and after 1/1/15, to divert 60% of all solid waste through source reduction, recycling, and composting activities. Establishes specified waste reduction targets for the state. Defines "illegal dumping" for purposes of the act as meaning the act of disposing of solid waste at a location that is not a permitted solid waste facility or is not otherwise authorized for the disposal of solid waste pursuant to the act or regulations adopted by the California Integrated Waste Management Board. Requires the owner or operator of a business that contracts for solid waste services and generates more than four cubic yards of total solid waste and recyclable materials per week to arrange for recycling service, consistent with state and local laws and requirements, to the extent that these services are offered and reasonably available from a local service provider. Requires specified local agencies, by 1/1/11, to adopt commercial recycling ordinances that include certain minimum requirements.

Prohibits, on and after 7/1/11, a store from providing plastic carryout bags to customers unless the store demonstrates an increased diversion rate, as defined, of 70% in the number of plastic carryout bags provided by the store during a specified period. Requires a store that is not complying with the diversion rate requirements to provide a plastic carryout bag to a customer only if the store charges the customer not less than $0.25 per bag. Requires a store charging customers for plastic carryout bags to demonstrate that any revenue collected, excluding the cost of the bags and a reasonable financial return, is used by the store to implement specified plastic carryout bag recycling, plastic carryout bag cleanup, and plastic carryout bag waste reduction programs. Requires the California Integrated Waste Management Board (CIWMB) to administer and enforce the plastic carryout bag provisions. Requires a store that imposes a charge for a plastic carryout bag to pay a specified fee to the CIWMB for deposit in the Integrated Waste Management Account and authorizes the CIWMB, upon appropriation by the Legislature, to expend those moneys for purposes of administering and enforcing the plastic carryout bag provisions. Extends these provisions indefinitely.

AB 2071 (Karnette-D) Plastic bags: plastic food/beverage containers: enforcement
Permits a city, county, or the state to impose civil liability in the amount of $500 for the first violation, $1,000 for the second violation, and $2,000 for the third and any subsequent violation of the Public Resources law that prohibits the sale of a plastic bag that is labeled compostable, biodegradable, degradable, or implies that the bag will break down, as specified, unless at the time of the sale the bag meets specified standards for those terms. Permits a city, county, or the state to impose civil liability in the amount of $500 for the first violation, $1,000 for the second violation, and $2,000 for the third and any subsequent violation of the Public Resources law that prohibits the sale of a plastic food or beverage container that is labeled compostable, biodegradable, degradable, or implies that the container will break down, as specified, unless at the time of the sale the container meets specified standards for those terms. Authorizes civil penalties collected under the provisions of this bill to be paid to the office of the city attorney, city prosecutor, district attorney, or Attorney General, whichever office brought the action and permits the expenditure of those funds, as specified.

Prohibits, on and after 7/1/08, a person from manufacturing, processing, or distributing in commerce a product containing diacetyl. Authorizes the Director of the Office of Environmental Health Hazards Assessment, with the concurrence of the Secretary of the California Environmental Protection Agency, to grant a temporary waiver from the prohibition of two years with a renewal period of two additional years. States that a waiver may be granted if the manufacturer submits a petition requesting a deferral of the prohibition and the Director of the Office of Environmental Health Hazards Assessment makes a written finding that: (1) the prohibition will cause substantial economic hardship to users of diacetyl; (2) there is no feasible alternative to diacetyl; and (3) that there will be appropriate mitigation to the greatest extent practical.

Exempts from the requirement that bedding products be resistant to open-flame ignition those products for which the Bureau of Home Furnishings and Thermal Insulation (Bureau) finds that resistance to open-flame ignition cannot be achieved without using those prohibited chemicals or components. Requires seating furniture and retail polyurethane foam to comply with Bureau regulations specifying the degree of fire or flame retardance. Requires, commencing 7/1/09, residential upholstered furniture offered for sale in this state to meet or exceed a specified cigarette ignition resistance standards instead of a flame retardance test of the filling materials, unless exempted by the Bureau. Requires all seating furniture, mattress sets, futons, and other bedding products to be labeled with a permanent label attachment, as specified, commencing 7/1/09. Requires, commencing 7/1/10, the Department of Toxic Substances control (DTSC) to develop and adopt a methodology, and to utilize that methodology in consultation with the Office of Environmental Health Hazard Assessment (OEHHA) and any other designated agency, for the coordination and conduct of an alternatives assessment to review the life cycle impacts of components, chemicals, or classes of chemicals used to adopt regulations in consultation with the chief of the Bureau that prohibit or limit the use of a component, chemical, or class of chemicals in the products under the jurisdiction of the Bureau, if it determines through the alternatives assessment that the component, chemical, or class of chemicals is of high concern for human, animal, or environmental health. Requires, commencing 1/1/15, any component or chemical used to meet the fire retardancy standards set by the Bureau to first be certified by the Director of DTSC to be in compliance with the alternatives assessment requirements. Requires DTSC to maintain a list of certified components and chemicals and to provide that list to the Bureau, and requires the Bureau to post the list on its Internet web site. Requires, beginning 7/1/10, the DTSC, in consultation with the OEHHA and any other designated agency, to commence an alternatives assessment of brominated fire retardants and chlorinated fire retardants used to meet the fire retardancy standards of the Bureau. Provides that monies in the Bureau of Home Furnishings and Thermal Insulation Fund shall be available, upon appropriation by the Legislature, to DTSC to implement these provisions.

Prohibits smoking on any state coastal beach or state park unit except in adjacent parking lots. A violation of this section is an infraction and punishable by a $250 fine. Authorizes the Department of Parks and Recreation, or another state agency, to develop and post signs to provide notice of the smoking prohibition. New signs could only be posted when existing signs are being replaced.
