SB 234 (Hancock-D) Goods Movement Emission Reduction Program

Requires the California Air Resources Board (ARB) to disperse eligible funds from the Highway Safety, Traffic Reduction, Air Quality, and Port Security Bond Act of 2006 for projects that provide shorepower for vessels to applicants on a quarterly basis, and also authorizes ARB to withhold 10% of reimbursable costs until the project demonstrates its ability to power a vessel at berth.

Amends the Health and Safety Code to expand the criteria by which the Air Resources Board must analyze and report as part of their economic assessments of adopting, amending, or repealing of any regulations, to require estimates of lost revenue or savings to the state as a result of accelerated depreciation due to the regulation rendering equipment "obsolete" before the equipment had been fully depreciated.

SB 358* (Cannella-R) Air quality: income tax: gross income: exclusion

Excludes from gross income any amount provided to a person by the Air Resources Board, an air pollution control district, or an air quality management district for the purpose of air pollution reduction. The basis of property for determining gain or loss on the sale or disposition, as well as for determining depreciation, will be reduced to the extent the property was acquired with any amount excluded from gross income.

SB 535 (De León-D) Greenhouse Gas Reduction Fund

Requires the California Environmental Protection Agency to identify disadvantaged communities for investment opportunities, as specified. Requires the Department of Finance (DOF), when developing a specified three-year investment plan, to allocate 25% of the available monies in the Greenhouse Gas Reduction Fund to projects that provide benefits to disadvantaged communities, as specified, and to allocate a minimum of 10% of the available monies in the Greenhouse Gas Reduction Fund to projects located within disadvantaged communities, as specified. Requires the DOF, when developing funding guidelines, to include guidelines for how administering agencies should maximize benefits for disadvantaged communities. Requires administering agencies to report to the DOF, and the DOF to include in a specified report to the Legislature, a description of how administering agencies have fulfilled specified requirements relating to projects providing benefits to, or located in, disadvantaged communities.

SB 669 (Rubio-D) Greenhouse gas reduction: carbon sequestration

Requires the State Energy Resources Conservation and Development Commission to coordinate the development of performance standards and other operational measures for carbon capture and storage sites that are consistent with the goals of protecting groundwater and preventing the emission of carbon dioxide to the atmosphere. Requires the Air Resources Board to establish an accounting protocol for sequestered carbon dioxide.

SB 800 (Hancock-D) Voluntary Greenhouse Gas Emission Offset Program Fund

Creates the Voluntary Greenhouse Gas Emission Offset Program Fund, and provides that funds received by the state on a voluntary basis from the federal government, individuals, businesses, organizations, industry, or other sources for the mitigation of climate change impacts related to greenhouse gas emissions be deposited in this Fund.

SB 1018 (Senate Budget And Fiscal Review Committee) Air pollution: Budget Trailer Bill

Enacts the Energy, Resources, Environmental Protection, and Agriculture 2012-13 Budget Trailer Bill which, among other provisions, establishes new legislative oversight and controls over the Air Resources Board including the creation of a separate expenditure fund for proceeds from the auction or sale of allowances pursuant to the market-based compliance mechanism (cap-and-trade program); the establishment of a separate Cost of Implementation Fee account for oversight and tracking of funds; oversight of actions taken on behalf of the State of California related to market-based compliance and auctions, specific to the Western Climate Initiative and Western Climate Initiative, Incorporated; and provides for return of certain funds to ratepayers of Investor Owned Utilities from funds related to the auction or sale of allowances.

SB 1455 (Kehoe-D) Alternative and vehicle technologies: funding programs

Extends until 12/1/23, various fees and surcharges related to the clean air, fuel, tire recycling, and vehicle programs of the Air Resources Board (ARB), the California Energy Commission (CEC), the Department of Resources Recycling and Recovery, and the State Bureau of Automotive Repair. Prohibits ARB from moving forward with implementation of the Clean Fuels Outlet regulation, and instead directs funds from the Alternative and Renewable Fuel and Vehicle Technology Fund for the construction and operation of a hydrogen fueling network in California. Requires CEC and ARB to report on the status of the state's alternative transportation fuel use in the Integrated Energy Policy Report.

Prohibits any authority being conferred on the Air Resources Board to impose any regulatory obligations on publicly-owned water utilities for purposes of greenhouse gas emissions related to electricity imported for the publicly-owned water utility's own use for the sole purpose of obtaining, transporting, and distributing water to its service area from an out-of-state water source unless the state board allocates to publicly-owned water utilities allowances, credits, or other forms of price mitigation received by publicly-owned electric utilities.

Authorizes the Air Resources Board, in lieu of assessing penalties for a violation of an air pollution control law administered by the Board, to require a person who has violated that law to spend an amount equivalent to the amount that would have been assessed for the violation toward actions to comply with the air pollution control law that was violated or toward a supplemental environmental project, as defined.

AB 146 (Dickinson-D) Air Resources Board: membership

Increases the size of the Air Resource Board from 11 to 12 members. Requires that one member be from the Sacramento Metropolitan Air Quality Management District, the Placer County Air Pollution Control District, the Yolo-Solano Air Quality Management District, the Feather River Air Quality Management District, or the El Dorado County Air Pollution Control District.

Requires the ARB to report annually on the status of the cap-and-trade program until 2016.

Requires the Air Resources Board, for purposes of specified provisions relating to mobile source emissions reductions, as applied to the reduction of emissions of diesel particulate matter, oxides of nitrogen, and other criteria pollutants from certain in-use, diesel-fueled vehicles, to define "low-use vehicle" for purposes of tax-exempt nonprofit organizations as a vehicle that will be operated fewer than 5,000 miles in the state in any compliance year, as specified.

AB 347 (Galgiani-D) CA Global Warming Solutions Act of 2006: early actions

Amends the California Global Warming Solutions Act to specifically require the Air Resources Board to ensure that the cement manufacturing, glass manufacturing, soda ash manufacturing, and steel production sectors receive appropriate credit for taking early action through energy efficiency or energy reduction improvements.

AB 382 (Nestande-R) Air inspectors: administrative and civil penalties

Makes a prohibition regarding funding for usable projects inapplicable for a shore side electrical power infrastructure project that is administered by a California port, and requires that the individual segments of these projects be a part of an adopted terminal plan submitted to the Air Resources Board, and authorizes the Board for a specified purpose to allow a recipient agency for shore side electrical power infrastructure to average vessel calls made across multiple berths within a terminal.

AB 1099 (Bonnie Lowenthal-D) Emissions standards: commercial motor vehicles

Prohibits the Department of Motor Vehicles from registering commercial vehicles of a 1996 or older model year with a gross vehicle weight rating of more than 26,000 pounds. Provides an exception for commercial vehicles registered prior to 1/1/12, as long as those vehicles are continuously registered or certified nonoperational after that date, and for construction trucks that have been granted an extension for compliance with specified regulations.

AB 1176 (Williams-D) Toxic air contaminant: pesticides

Requires the Director of the Department of Pesticide Regulation to complete at least one report per year on the health impacts of a pesticide which may be determined to be a Toxic Air Contaminant (TAC), and requires at least two pesticides per year go through the TAC determination process.

AB 1180 (Bradford-D) California Global Warming Solutions Act of 2006: compliance

Requires any offset protocol adopted as part of a cap-and-trade program for reducing greenhouse gas (GHG) emissions to target high warming potential gases, be approved by a third-party registry, be monitored for GHG reductions in real-time, and be capable of providing at least one million tons of carbon dioxide equivalent GHG reductions each year.

Specifies the terms for a lease of structures for shore protection for private property adjacent to tidelands or submerged lands by allowing the State Lands Commission to only lease these structures to a littoral owner for a term of 99 years, with the consideration for the lease adjusting no more than once for an unspecified number of years, based on any change in the California Consumer Price Index.

SB 195 (Cannella-R) Environmental quality: CEQA

Provides that impacts, potential impacts, or cumulative impacts on the environment of a project that is subject to an environmental regulation are deemed to be insignificant for the purposes of the California Environmental Quality Act unless a preponderance of evidence demonstrates that the specific impact, potential impact, or cumulative impact is significant after giving full effect to the environmental regulation. Requires the lead agency, as defined, to prepare a negative declaration or a mitigated negative declaration if there is a preponderance of the evidence in the record that a project or a revised project would not have a significant environmental impact. Requires the preparation of an environmental impact report if the lead agency finds, in light of the whole record, that a project, based on a preponderance of the evidence, will have a significant environmental impact that could not be avoided through a revision of the project.

SB 241 (Cannella-R) Environmental quality

Enacts the California Environmental Quality Act Litigation Protection Pilot Program of 2011 that prohibits court review of a lead agency's certification of an environmental impact report or adoption of a mitigated negative declaration, as well as a lead or responsible agency's project approval, for 125 projects that are selected by the Business, Transportation and Housing Agency over a five-year period. For a project to qualify for the exemption, the lead agency must certify to the Agency that there is an expectation that an environmental impact report will be certified for the project within 12 months. The Agency's selection of projects is also exempt from judicial review.

SB 639 (Cannella-R) Environmental Protection Agency: regulations

Requires the California Environmental Protection Agency, the entities that comprise that Agency, and the Division of Occupational Safety and Health, when proposing to adopt, amend, or repeal an administrative regulation, to complete an economic impact analysis of that action prior to the adoption, amendment, or repeal. Requires the economic impact analysis to contain the projected cost of the action to the General Fund, the projected total economic impact of the action, including the cost to private sector employers and the estimated number of jobs to be lost, a description of all feasible regulatory alternatives and a cost-benefit analysis of each alternative, and a summary of written comments, as specified. Requires the Agency to subject the report to a review by an independent entity, as defined, and to make the economic impact report available on the Agency's Internet Web site.

Prohibits the owner or operator of a large passenger vessel or an oceangoing ship with sufficient holding tank capacity from releasing, or permitting anyone to release, from the vessel, graywater into a marine sanctuary. Replaces the reference to a "vessel" with reference to a "large passenger vessel or oceangoing ship." Defines the term "marine waters of the state" to mean waters within the area bounded by the mean high tide line to the three-mile state waters limit, from the Oregon border to the Mexican border, for purposes of provisions relating to the operation of a large passenger vessel or an oceangoing ship with sufficient holding tank capacity.

Requires OPR to develop a list of mitigation measures that a project may incorporate to reduce the project's projected trip generation and vehicle miles traveled. The FFPE allows the State Board of Forestry and Fire Protection to exempt small property owners from Timber Harvest Plan requirements under limited circumstances: any trees harvested must be under 18 inches in diameter, the professional forester submitting the plan must consider habitat preservation, and the average size of tree on the property must increase under any work. The FFPE does not apply to the Lake Tahoe Basin and contains specific prohibitions on the cutting of older trees.

Requires a person that manufactures a reusable bag to print or attach a warning label on the reusable bag containing specified information. Provides that a violation of this requirement by the operator of a supermarket is an infraction. Modifies the Electronic Waste Recycling Act of 2003 and Recovery Act (E-Waste Act) fraud prevention and audit functions within the Department of Resources Recycling and Recovery (CalRecycle). Clarifies that CalRecycle shall not pay an electronic waste recycling payment or recovery payment for covered electronic waste (CEW) generated outside of the state and subsequently brought into the state. Requires CalRecycle to establish documentation requirements for demonstrating that CEW was generated in California and eligible for payment. Requires CalRecycle to pay a CEW collector or recycler upon completion of its review of a payment claim for 90 days or less. CalRecycle may examine a payment claim to validate its completeness, accuracy, truthfulness, and compliance with applicable laws and regulations. Permits CalRecycle to conduct a selective audit of authorized collectors, covered CEW recyclers, or manufacturers to determine whether recovery or recycling payments are being paid by CalRecycle according to the requirements of the E-Waste Act.

SB 34 (Simitian-D) California Water Resources Investment Act of 2011

Creates the California Water Resources Investment Act of 2011. The Act finds that it is necessary to establish a sustainable revenue source to fund the public benefits of water related projects and programs by imposing a charge on all retail water suppliers consistent with the following principles: (1) funding of public benefits should be guided by the beneficiaries pay and polluters pay principles; (2) decisions regarding funding of public benefits of water related projects and programs should be made by the public receiving those benefits; and (3) it is desirable for the revenue source to fund the public benefits of water related projects and programs to be equitable, comprehensive, unavoidable, affordable, understandable, easy to administer, and stable.

Provides for a legislative hearing and notification for new long-term water contract terms and conditions prior to final approval by the parties; (3) within the Fish and Game Code, provides for the elimination of the Salton Sea Restoration Council on 1/1/13. Requires the Department of Fish and Game to provide certification of the full mitigation of identified significant environmental impacts and for a fee structure to fully cover all costs of the department prior to administering permits to operate vacuum or suction dredge equipment; and (4) provides necessary cleanup to provisions related to the San Gabriel and Lower Los Angeles Rivers and Mountains Conservancy relative to appointment of state personnel.

Authorizes the Secretary to request additional information before determining that a proposal is complete, and upon receipt of a proposal from the Secretary, requires the Director of the Department of Fish and Game to consult with the tribe to develop memoranda of understanding or other agreements to, among other things, provide access to the tribe for traditional hunting and gathering and cultural activities. If multiple tribal governments or groups submit proposals to the Secretary. Requires the Secretary to prioritize the proposals for negotiation, as provided.

Provides that the illegal take of trophy deer, elk, antelope, or bighorn sheep shall be subject to a fine from $5,000 to $40,000 and/or imprisonment for up to one year. Provides that the illegal take of trophy wild turkey shall be subject to a fine from $2,000 to $5,000 and/or imprisonment for up to one year. Provides that any person who uses a signaling device to take a bear with the intent to sell bear parts is subject to a fine of $10,000 per bear part in possession.

Amends the 2012-13 Budget Act, adopted on 6/15/12 in AB 1464 (Blumenfield-D), Chapter 21, Statutes of 2012, which among other provisions, extends the encumbrance period by two years to allow the Department of Parks and Recreation to expend $6 million for water, wastewater, and sewer system capital outlay projects in state parks; and authorizes up to $2 million from the State Parks and Recreation Fund for park operations at Del Norte Coast Redwoods State Parks, Samuel P. Taylor State Park, and Tomales Bay State Park. Fees for these parks are collected by the National Parks Services per federal agreements and deposited in the Fund.

AB 1478 (Blumenfield-D) State parks: Budget Trailer Bill

Enacts the State Parks 2012 Budget Trailer Bill. Specifically, (1) prohibits the Department of Parks and Recreation (DPR) from closing or proposing the closure of a state park in the 2012-13 and 2013-14 fiscal years; (2) provides a one-time appropriation of $10 million from revenues generated by the DPR to be allocated to match contributions from donors and local partner agreements for the 2012-13 and 2013-14 fiscal years; (3) provides a one-time appropriation of $10 million to parks that remain at-risk of closure in order to maintain a two-year moratorium on park closures; (4) provides a one-time appropriation of $500,000 to ensure that all ongoing internal and external investigations into the DPR are fully funded; (5) provides a $10 million one-time appropriation of bond funds for capital improvements projects to prevent full or partial park closures; (6) establishes criteria for membership positions on the State Park and Recreation Commission including requirements for cultural and park management experience. Requires the appointment of two ex officio legislative members by the Speaker of the Assembly and Senate Rules Committee, respectively. Allows the Commission a more direct oversight role of the DPR, particularly over DPR's deferred maintenance backlog; (7) appropriates $240,000 from existing funds to allow the Commission to evaluate DPR's deferred maintenance obligations, hold public hearings on the subject, provide advice to DPR on budgetary matters, and to conduct workshops; and (8) clarifies funds appropriated to the California State Park Enterprise Fund, established to enable the DPR to set revenue targets and goals, are transferred appropriately from the State Parks and Recreation Fund. Provides for annual accounting and reporting.

Establishes the Coho Salmon Habitat Leading to Preservation Act (Coho HELP Act) which, in order to prevent the extinction of coho salmon, provides the Department of Fish and Game (DFG) an expedited mechanism to approve specific types of voluntary on-the-ground habitat restoration projects that benefit coho salmon. Appropriates $37,500 from the Hatchery and Inland Fisheries Fund to DFG, for the remainder of the fiscal year, in order to fund an engineer position employed on a half-time basis, to aid in urgent review of coho projects. Repeals the Coho HELP Act on 1/1/18.
