AB 151 (Vargas-D) Importation of electrical energy: mitigation fee

Requires any person who imports electricity into the state from northern Mexico, as specified, to pay a $0.001 per kilowatt-hour air contaminant emission mitigation fee to the State Air Resources Board for the purposes of mitigating the environmental or health impacts of the generating facility.

Subjects the transferee to certain civil penalties for violating a measure or failing to pay a fee imposed by the district.

Prohibits, as of January 1, 2004, a cruise ship from conducting onboard waste incineration while operating within 20 miles of the California coast and requires, as of January 1, 2006, a cruise ship to use only federal on-road diesel fuel while operating within 25 miles of the California coast.

Prohibits any air district from adopting a rule or regulation that restricts or prohibits the installation of a clean-burning solid fuel appliance.

AB 729 (Lieber-D) Bay Area Air Quality Management District

Authorizes the Bay Area Air Quality Management District (District) to adopt rules and regulations to reduce and mitigate emissions of air contaminants from indirect sources of air pollution, but prohibits those rules or regulations from infringing upon any local government's authority to plan or control land use. Requires the District, not later than July 31, 2004, to adopt revised regulations to reduce fugitive emissions and flared gases from oil refineries in the state.

Prohibits the use of perchloroethylene by any dry cleaning operation after January 1, 2014, requires the State Air Resources Board to impose a $3 fee on every person that purchases a gallon of perchloroethylene for deposit in the newly created Nontoxic Dry Cleaning Incentive Trust Account (Account), and authorizes moneys deposited in the Account to be expended to fund a grant program to provide incentives for dry cleaners that utilize perchloroethylene in their operations to transition to utilizing nontoxic alternatives.

AB 927 (Campbell-R) Hydrogen refueling stations

Requires the State Air Resources Board to adopt regulations establishing statewide guidelines for the production and licensing of hydrogen fuel cell refueling stations, in collaboration with the State Department of Transportation, the State Public Utilities Commission, and the State Energy Resources Conservation and Development Commission. Requires those agencies to perform those activities utilizing existing funding resources.

Establishes a grant program to provide financial incentives to professional dry cleaners to use non-toxic alternatives to perchloroethylene.

AB 1063 (Firebaugh-D) South Coast Air Quality Management District

Authorizes the South Coast Air Quality Management District (District), to the extent permissible under federal law, to require retrofit controls on any motor vehicle, nonroad engine, or nonroad vehicle that operates substantially in that District. Requires the District, on or after January 1, 2006, to adopt mitigation fees on ports, marine terminals, shipping companies, and/or railroads, unless the Environmental Protection Agency has adopted regulations that meet the district's emission reduction targets.

AB 1090 (Longville-D) South Coast Air Quality Management District: membership

Exempts, until January 1, 2006, the appointee to the South Coast Air Quality Management District (District) from San Bernardino County from the requirement that all members of the District's governing board reside within the District.

AB 1316 (Parra-D) Smog Check II: coastal districts: study

Requires the State Air Resources Board (ARB) to conduct a study evaluating the benefit to air quality that would result from requiring all air quality management districts and air pollution control districts located along the state's coastline between the Los Angeles and the San Francisco bay area to participate in Smog Check II, irrespective of each district's attainment status with respect to state and federal ambient air quality standards. Requires the ARB to report the results of the study to the appropriate policy committees of the Legislature not later than January 1, 2005.

AB 1394 (Levine-D) Carl Moyer Memorial Air Quality Standards Attainment Program

Expands the Carl Moyer Memorial Air Quality Standards Attainment Program to authorize air districts to award grants for the replacement of heavy duty vehicle engines, the promotion of alternate fuels technology and related activities, based on a project's reductions in particulate matter. Projects are eligible for funding if they combine two transactions: (1) the purchase of a new very low-or-zero-emission vehicle, and (2) the replacement of even older, dirtier engines with the relatively cleaner engines being replaced in the first transaction.

Requires that certain asbestos abatement equipment be tested monthly and repaired, removed or replaced as necessary. Requires the State Air Resources Board to create a program for the registering and approving of independent training businesses and for those businesses to train independent testing companies to test negative air machines.

SB 745 (Ashburn-R) Environmental subdivision

Repeals the January 1, 2005, automatic termination date in the environmental subdivision statute, making the law permanent. Makes permanent language exempting an environmental subdivision from the requirement for a tentative map. For environmental subdivisions of parcels less than 20 acres, requires that the contiguous property be subject to a recorded perpetual easement and that the combined acreage of the properties be 20 or more acres. Requires the State Water Resources Control Board (SWRCB), if it determines necessary, to apply to the appropriate federal agencies to authorize the state to prohibit the release of sewage sludge from large passenger vessels (vessels), as defined, into the marine waters of the state and marine sanctuaries. Prohibits the discharge of any sewage sludge or oily bilgewater from a vessel into the marine waters of the state or into a marine sanctuary, if authorization is granted. Requires the owner or operator of a vessel that releases sewage sludge or oily bilgewater into the marine waters of the State or a marine sanctuary to notify the SWRCB within 24 hours of that release. Specifies that each violation is subject to a civil penalty of not more than $25,000. Authorizes SWRCB to develop regulations, for the purposes of carrying out this division. Exempts specified vessels.

Prohibits the California Integrated Waste Management Board from adopting any regulation that exempts a construction and demolition processing facility based on the number of tons of solid waste per day accepted by the facility. Also provides that an owner or operator of a construction or demolition processing facility is liable for taking corrective action if the owner or operator is found in violation of the facility's permit or a catastrophic emergency has directly resulted from the operations of the facility.

Specifies that the programs to which the California Integrated Waste Management Board may make grants to help prevent the disposal of hazardous waste at solid waste disposal sites include programs that maintain existing programs in rural cities and counties. Reduces a number of minor violations from misdemeanors to "wobblets" (prosecutable either as a misdemeanor or an infraction), decreases the current fine for fishing without a license, requires the Fish and Game Commission to adopt regulations related to suspension or revocation of a hunting or fishing license, requires the State Department of Fish and Game to create a statewide elk management plan and to consult with land owners about how to remedy elk damage, and creates a standard definition for a disabled veteran.

Replaces the Director of the California Conservation Corps with a three-person California Conservation Corps Commission. Requires the Governor, the President pro Tempore of the Senate, and the Speaker of the Assembly to each appoint one of the commissioners to a four-year term. Authorizes the commission to administer the corps by majority vote the commissioners to be reappointed.

Requires the Secretary of the State Resources Agency to delegate his or her responsibilities for the administration of a grant program for acquisition of land or water resources the Sierra Nevada-Cascade mountain region and allows the wildlife conservation board to provide grants, as specified.

Changes the requirement to update regulations pertaining to fish, birds, amphibians, and reptiles from at least once every four years to at least once every three years, deletes authority to the State Department of Fish and Game to establish a scientific collecting program, adds amphibians to the list of prohibited prizes in contests or tournaments, narrows the circumstances to import or possess live muskrats except under permits granted by the department, and makes numerous re-numbering, conforming, and technical changes.
