SB 203 (Pavley-D) Local transportation funds: Ventura County

Eliminates the requirement that all Transportation Development Act funds in Ventura County be used exclusively for public mass transit purposes, in effect aligning Ventura with the way existing law treats all other California counties. Requires the Ventura County Transportation Commission, beginning 9/1/14 and annually for the next four years, post on its Internet Web site a report on transit services within Ventura County. Requires that the report include a description of changes to transit routes, service levels, and ridership numbers for all transit routes within Ventura County, and include annual budget numbers for transit services provided by the Commission, Gold Coast Transit, other multiagency operators, and individual municipal operators.

SB 486 (DeSaulnier-D) Department of Transportation: performance

Requires the Department of Transportation (Caltrans) and the Transportation Agency to identify Caltrans' performance measurement benchmarks and report at least quarterly on its success in meeting these performance benchmarks. Requires the Secretary of the Agency, in consultation with the Director of Caltrans, to identify performance measurement benchmarks for Caltrans related to enhancement of public safety, system preservation and rehabilitation, efficiency and cost-effectiveness of project delivery, and environmental sustainability.

SB 628 (Beall-D) Infrastructure financing: transit priority projects

Allows a city or county to create an infrastructure financing district to implement a transit priority project without having to hold an election, and requires the local entity to use 25% of the resulting revenues for affordable housing.

SCA 4 (Liu-D) Local government transportation projects

Provides that the imposition, extension, or increase of a special tax by a local government for the purpose of providing funding for local transportation projects requires the approval of 55% of its voters voting on the proposition, if the proposition proposing the tax includes certain requirements. Prohibits a local government from expending any revenues derived from a special transportation tax approved by 55% of the voters at any time prior to the completion of a statutorily identified capital project funded by revenues derived from another special tax of the same local government that was approved by a 2/3-vote.

SCA 8 (Corbett-D) Transportation projects: special taxes: voter approval

Reduces, subject to a future vote of the people, the voter threshold from 2/3 to 55% for passage of local sales taxes dedicated to transportation purposes, if the local ballot proposition: (1) contains a specific list of projects, programs, and purposes to be funded by the tax proceeds; (2) requires an annual independent audit of the tax proceeds collected and expended; and (3) requires the governing board to create a citizens' oversight committee.

AB 466 (Quirk-Silva-D) Federal transportation funds

Requires the Department of Transportation to continue allocating federal Congestion Mitigation and Air Quality Improvement Program funds to regions pursuant to a weighted formula that accounts for population and pollution levels.

Requires the Strategic Growth Council to assist the Governor in submitting the annual five-year infrastructure plan to the Legislature, adds housing to the definition of infrastructure for purposes of the plan, and requires the proposals for funding infrastructure identified in the plan to include investment coordination opportunities related to infill and transit-oriented development.

AB 730 (Alejo-D) Monterey-Salinas Transit District

Authorizes the Monterey-Salinas Transit District to approve, with a 2/3-vote of its governing board, the issuance of up to $50 million in revenue bonds. Limits the use of revenue bonds to a project or projects not located on or adjacent to the former Fort Ord, with the exception of a project or projects located entirely within the existing right-of-way of State Highway Route 1 owned by the Department of Transportation or within the existing right-of-way of the Monterey branch rail line, owned by the Monterey County Transportation Agency.

AB 797 (Gordon-D) Transit districts: contracts

Authorizes the Santa Clara County Valley Transportation Authority and the San Mateo Transit District to utilize the construction manager/general contractor (CM/GC) project delivery method for transit projects within their respective jurisdictions under the condition that after evaluating the traditional design-bid-build process as well as the CM/GC process in a public meeting, they make a written finding that use of the CM/GC process on a particular project will result in one or more of specified objectives.

AB 863 (Torres-D) Transit projects: environmental review process

Authorizes the Department of Transportation to assume responsibilities for federal review and clearance under the National Environmental Policy Act of 1969 for a transit project, as defined, that is subject to the Act, provides that the State of California consents to the jurisdiction of the federal courts in that regard, and further provides that the Department may not assert immunity from suit under the 11th Amendment to the U.S. Constitution with regard to actions brought relative to those responsibilities under federal law.

Reiterates a number of restrictions contained in existing law related to bond funds that the Legislature appropriated for the development of high-speed rail in the San Francisco Bay Area. Prohibits funds dedicated to the San Francisco-to-San Jose Peninsula corridor from being used to expand the project beyond the agreed-upon "blended system" with existing commuter rail service, or to build a four-track system.

AB 481 (Lowenthal-D) High-speed rail

Grants the High-Speed Rail Authority (HSRA) similar property management authority as granted to the Department of Transportation. Excludes high-speed rail rights-of-way from Department of General Services property management authority and instead provides for HSRA to manage the property. Enables the Chief Executive Director of HSRA to lease to public agencies or private entities the airspace above or area below high-speed rail rights-of-way as long as these leases do not impact safety, and allows HSRA to sell excess high-speed rail rights-of-way through a competitive process, or without seeking competitive bids under the same conditions as the Department of Transportation.

SB 31 (Padilla-D) Outdoor advertising displays: arenas

Allows a qualifying arena to place up to two displays at approaching highway off ramps and treat them as though they are arena displays as long as the displays are authorized by a local ordinance as of 1/1/19. Requires the Department of Transportation to review and certify that the proposed displays and sign ordinance meet the minimum statutory requirements. Specifies that if an advertising display is subject to a notice from the United States Department of Transportation, the Federal Highway Administration, or any other applicable federal agency to the state that the operation of that display will result in the reduction of federal aid highway funds, then the authorization of that display shall cease and the display owner shall remove all advertising copy from the display within 60 days after the state notifies the display owner of the receipt of the federal notice.

Requires the relinquishment be subject to an agreement by the City to accept the relinquishment.

SB 444 (Hueso-D) State Highway Route 86: relinquishment

Authorizes the California Transportation Commission to relinquish to the Cities of Brawley, El Centro, Imperial and the County of Imperial, specified portions of State Highway Route 86 under certain conditions. Redesignates a specified portion of State Highway Route 86 as a part of State Highway Route 78 following relinquishment, and requires the relinquishments to be done at no cost to the state, unless the Commission makes a finding of need.

Amends the redevelopment agency exemption to the Outdoor Advertising Act to reflect the elimination of redevelopment agencies. Specifies that the applicable city, county, or city and county shall annually, by December 31, certify to the Department of Transportation that the advertising copy of the advertising display its advertising businesses or activities operating within the boundaries of the redevelopment project area and that at least 10% of the advertising copy, up to a maximum of 100 square feet, is used to display the address or location of the business or activity, or to identify the route to the business or activity from the nearest freeway off-ramp. Clarifies that if the United States Department of Transportation, the Federal Highway Administration, or any other applicable federal agency provides notice to the state that the operation of that display will result in the reduction of federal aid highway funds, then the authorization of that display shall cease and the display owner shall remove all advertising copy from the display within 60 days after the state notifies the display owner of the receipt of the federal notice.

Restricts, as of 7/1/14, the hours of operation of any high occupancy vehicle (HOV) lane on State Highway Route (SR) 134 between SR 170 and SR 210 and HOV lanes on SR 210 between SR 134 and SR 57 in Los Angeles County to the times of day with heavy commuter traffic, as determined by the Department of Transportation (Caltrans). Requires Caltrans to report to the Legislature on the traffic impact of limiting operations of these HOV lanes by 1/1/16. Allows Caltrans to reinstate 24-hour HOV lanes on or after 5/1/15, if it determines that restricting the hours of operation has created an adverse impact on safety, congestion, or the environment, and submits a notice of such determination to the Legislature.

Exempts a highway worker, as defined, from the provisions of current law which requires that a pedestrian upon a roadway yield the right-of-way to all vehicles upon the roadway so near as to constitute an immediate hazard, unless the pedestrian is within a crosswalk, pedestrian tunnel, or overhead crossing, and prohibits a pedestrian from crossing the roadway at any place except in a crosswalk.

AB 747 (Levine-D) State Highway Route 131: relinquishment

Authorizes the California Transportation Commission to relinquish to the Town of Tiburon the portion of State Highway Route 131 within its town limits, upon terms and conditions the Commission finds to be in the best interest of the state. Provides that the relinquishment will become effective immediately following the county recordation of the relinquishment resolution, and specifies that following the effective date of relinquishment, the relinquished segment will no longer be a state highway and may not be considered for future adoption as a state highway. Requires the Town of Tiburon to ensure the continuity of traffic flow, including any traffic signal progression, and to provide signage directing motorists to the continuation of the highway.

AB 60 (Alejo-D) Driver's licenses: eligibility: required documentation

Requires the Department of Motor Vehicles to issue driver's licenses to persons who are ineligible for a Social Security Number (SSN) if additional documentation is provided, as specified. Provides that an applicant who is unable to provide satisfactory proof of legal presence in the U.S. may sign an affidavit attesting they are ineligible for a SSN and unable to provide proof of legal presence. Requires the Department to accept the affidavit in lieu of a SSN and specifies that the affidavit is not public record.

AB 64 (Donnelly-R) Vehicles: fifth-wheel travel trailers

Makes an exception to the vehicle length limits for fifth-wheel travel trailers, allowing them to be up to 48 feet in length, provided the kingpin to the rear axle (KP-RA) length is no more than 40 feet for a fifth-wheel with two or more axles, or 38 feet for a fifth-wheel with a single axle. Requires a fifth-wheel manufacturer include in the delivery documents the information necessary to register the fifth-wheel, including its overall length and declaration that its KP-RA length is in compliance with the limitations above.

Requires DMV to refuse to renew the registration of a motor vehicle with a compressed natural gas fuel system if DMV has not received an inspection report confirming that the vehicle has received a cylinder and tank bracket inspection in the last three years or if the cylinder attributed to the vehicle is past the expiration date on record with DMV.

SB 791* (Wyland-R) Motor vehicle fuel tax: rate adjustment

Deletes the duty of the Board of Equalization to adjust annually the excise tax on gasoline, and instead requires that by March 1 of each year, the Department of Finance calculate the gasoline excise tax rate to equal the revenue loss attributable to exempting gasoline from state sales tax. If this calculated rate is less than or equal to the current rate, then that rate shall take effect automatically on July 1. If this calculated rate exceeds the current rate, then the increased rate will only take effect if included in a bill passed by 2/3-vote of both houses of the Legislature, otherwise the rate will remain unchanged.

Requires the Metropolitan Transportation Commission to report biannually to the Legislature and the public at large on the progress in implementing the policies and programs of the sustainable communities strategy, establishes additional requirements for a sustainable communities strategy adopted on or after 1/1/14, within the jurisdiction of the Metropolitan Transportation Commission, and imposes additional duties relating to a sustainable communities strategy on the Metropolitan Transportation Commission, the San Francisco Bay Area Air Quality Management District, and the San Francisco Bay Conservation and Development Commission.

SB 793 (Lara-D) Air pollution: oceangoing vessels

Specifies that, pursuant to existing "at-berth" regulations, a vessel exceeding hours of service limitations because testing and inspection of vessel equipment have not validated safety shall be subject to minimum allowable penalty rates if repairs necessary to complete the inspection have been ordered or scheduled at the earliest practicable time. Requires the Air Resources Board to consider circumstances beyond the control of a vessel fleet if, upon initial visit to a port, the Board finds that equipment testing compliance efforts are affected by delays in construction, technical issues, and requirements of third parties.

Requires the Agency to establish a freight advisory committee consisting of a representative cross section of public and private freight sector stakeholders, as specified. Defines "medium-speed electric vehicle" as a vehicle that can attain a speed of no more than 45 MPH on a paved, level surface, has a gross vehicle weight rating of less than 3,000 pounds, is propelled solely by an electric motor, and contains a vehicle identification number that meets international standards. Requires that medium-speed vehicles must meet specified safety requirements, and subjects medium-speed vehicles and their drivers to provisions of state law applicable to motor vehicles and their drivers.

Requires a person who requests the confidentiality of his/her home address to provide the Department of Motor Vehicles (DMV) with a current employment address for purposes of processing the service and collection of a traffic, parking, or toll road violation. Requires that the applicable statutory time periods for processing the service and collection of traffic, parking, or toll road violations be tolled until DMV provides the law enforcement agency, governmental agency, or issuing agency with the person's current employment address. Requires a person who has requested the confidentiality of his/her home address to notify DMV of any change in his/her employment address within 10 days.

AB 600 (Bonta-D) Intermodal marine terminals

Clarifies the extent to which parties in the drayage marketplace, such as the shippers, terminal operators, and truckers, are able to contract for drayage services for the movement of intermodal marine equipment, as defined. Establishes restrictions upon intermodal marine terminals relative to parking violations or citations issued to intermodal motor carriers. Requires intermodal marine terminals, beginning 1/1/15, to ensure that outstanding cargo charges, including but not limited to demurrage charges, be paid electronically by the responsible party or that party's agent prior to transport of the container. Establishes restrictions on intermodal marine terminal operators from imposing additional charges if a loaded container is not available for transport by an intermodal motor carrier.

AB 1194 (Ammiano-D) Safe Routes to School Program

Modifies the Safe Routes to School (SR2S) program. Adds a non-infrastructure element to the state SR2S program including, public awareness campaigns and outreach to press and community leaders, traffic education and enforcement in the vicinity of schools, student sessions on bicycle and pedestrian safety, health, and environment, and funding for training, volunteers, and managers of SR2S programs. Specifies that 20% of the program funds are to be used for non-infrastructure-related activities and up to 20% of these funds are to be used for a statewide technical assistance resource center. Provides the Transportation Agency discretion to transfer the responsibility to administer the SR2S program from the Department of Transportation to the California Transportation Commission.
