Administrative Law SB 329 (Campbell-R) - Administrative Regulations: Legislative Notification Prohibits any state agency from adopting any regulation in an area over which a federal agency has jurisdiction unless the state agency notifies the Legislature 30 days prior to the effective date of the regulation. (Died in Senate Governmental Organization Committee) SB 625 (Johannessen-R) - Administrative Regulations: Economic Impact Requires that an assessment of adverse economic impact be submitted to the Office of Administrative Law, in writing, with the notice of proposed action, and made available to the public upon request. (Died in Senate Governmental Organization Committee) SB 690 (Mountjoy-R) - Administrative Regulations: Department of Personnel Administration Exempts the Department of Personnel Administration from the Administrative Procedure Act with respect to regulations that apply exclusively to state employees excluded from the Ralph Dills Act and as of the date this bill is agreed to by the employees' recognized employee organization in a written memorandum of understanding, to all state employees, as defined. (Failed passage in Senate Governmental Organization Committee) A similar bill, AB 2570 (Margett-R), also failed passage in Senate Governmental Organization Committee. SB 739 (Polanco-D) - Administrative Regulations Allows the California Integrated Waste Management Board and the State Water Resources Control Board to adopt a regulation that is different from a federal regulation addressing the same issue, upon a finding of specified justifications. (Died in Senate Natural Resources and Wildlife Committee) SB 794* (Kopp-I) - Administrative Procedures Makes cleanup changes to the section of Proposition 103 which governs Department of Insurance hearing procedures to conform to changes made last year to the general laws of the state governing hearings contained in SB 523 of 1995. Requires the administrator of oil spill response to submit regulation licensing oil spill agents to the Office of Administrative Law for filing with the Secretary of State, as specified. Chapter 390, Statutes of 1996 SB 1507 (Petris-D) - Rulemaking Files: Public Records Prohibits an agency from removing, altering, destroying or otherwise disposing of any item contained in a rulemaking file as specified and requires the agency to maintain any rulemaking file not sent to the State Archives. Chapter 928, Statutes of 1996 SB 1910 (Johannessen-R) - Administrative Regulations Requires the Office of Administrative Law (OAL) to make the California Code of Regulations available to the public on the Internet on and after July 1, 1998 and allows OAL to contract with another state agency or private entity in order to provide this service. Chapter 501, Statutes of 1996 AB 250 (Baldwin-R) - Administrative Regulations: Review Requires the Office of Administrative Law and Secretary of Trade and Commerce to recommend to the Legislature the suspension or repeal of all state regulations determined to be more stringent than federal regulations on the same subject. (Died in Assembly Consumer Protection, Governmental Efficiency and Economic Development Committee) AB 1069 (Hauser-D) - Administrative Law: Decisions Requires that a decision made by an administrative law judge, pursuant to the Administrative Procedure Act, is to be deemed adopted by an agency unless that agency files a petition for judicial review. (Died in Senate Judiciary Committee) AB 1135 (Morrissey-R) - Administrative Regulation: State Air Resources Board Requires the State Air Resources Board, until January 1, 1999, when proposing to adopt or substantially amend any regulation, to consider and respond to public comment on the cumulative economic impact of all regulations that became effective on or after January 1, 1990 on specific private sector entities and on state and local governmental entities that may be affected by the proposed adoption or amendment of the regulation, as specified. (Died in Senate Appropriations Committee) AB 1142 (Baldwin-R) - Administrative Regulations Requires the Office of Administrative Law to review and repeal any existing regulations with specified timeframes that are not in compliance with standards required to adopt a regulation. (Died in Assembly Consumer Protection, Governmental Efficiency and Economic Development Committee) AB 1179 (Bordonaro-R) - Administrative Regulations Specifies that no administrative regulation adopted after January 1, 1997 is to apply to businesses, unless the state agency adopting the regulation makes a finding that it is necessary for the health, safety or welfare of the people of the state, and it is the most cost-effective regulatory option, except as specified. Revises the duties of the Trade and Commerce Agency Secretary as they relate to industry findings and determinations required of any state agency that proposes to adopt regulations under the Administrative Procedure Act. Requires the Office of Administrative Law to return regulations to the adopting agency when the secretary has made certain findings pursuant to specified provisions. (Failed passage in Senate Governmental Organization Committee) AB 1659 (Woods-R) - Administrative Regulations Imposes additional requirements to the regulatory process for specified agencies when considering the adoption or amendment of a regulation which costs $2 million or more in any 1 year. (Died in Senate Governmental Organization Committee) AB 1857 (Brewer-R) - Administrative Regulations Allows state agencies to adopt regulations that are different from corresponding federal regulations, as specified. (Died in Assembly Consumer Protection, Governmental Efficiency and Economic Development Committee) AB 1859 (V. Brown-D) - Administrative Regulations: Workers' Compensation Makes the Division of Workers' Compensation subject to the Administrative Procedures Act for purposes of promulgating regulations. Chapter 14, Statutes of 1996 Similar legislation, AB 1756 (Knowles-R), died in Assembly Consumer Protection, Governmental Efficiency and Economic Development Committee. AB 2772 (Cortese-RFM) - Administrative Regulations: State Personnel Board Exempts specified State Personnel Board regulations from the Administrative Procedure Act. Establishes in statutes which regulations the board must submit to the Office of Administrative Law for review and approval. Requires board regulations covering contracting-out to be subject to the Administrative Procedures Act. Chapter 935, Statutes of 1996 AB 2793 (Baldwin-R) - State Agencies: Regulatory Review Requires state agencies, starting January 1, 1998, and every 4 years thereafter, to review their regulations which affect the private sector, identify those regulations suitable for modification or repeal, and prepare a statement thereto. (Failed passage on Senate Floor) AB 2896 (Goldsmith-R) - Administrative Regulations Requires boards, departments, or commissions within the Environmental Protection Agency, the Resources Agency, or the Office of State Fire Marshal to describe their efforts, in connection with a proposed rulemaking action, to avoid unnecessary overlap or inconsistency with federal regulations contained in the Code of Federal Regulations addressing the same issues, as specified. (Died in Senate Appropriations Committee) A similar bill, AB 3146 (Brewer-R), failed passage in Senate Governmental Organization Committee.LegislatureThe 1994 elections left the Legislature with a Democratic Senate and a Republican Assembly. However, in the Assembly the Republicans were unable to replace Speaker Willie Brown with their leader James Brulte when Paul Horcher changed from Republican to Independent and voted for Willie Brown as Speaker. Assembly Member Horcher became subject to a successful recall election. It wasn't until June 5, 1995 that Speaker Brown was replaced with Doris Allen, who was elected by a 40-38 vote (39 Democrats and Allen), becoming the first woman in California history to become Speaker of the Assembly. Soon thereafter, she became embroiled in controversy with the other Republican members making her subject to a recall election. On September 15, 1995 Allen was replaced by Brian Setencich, a first-term member, as Speaker. In between events, an unsuccessful recall was made against Assembly Member Mike Machado, Majority Floor Leader James Brulte relinquished his leadership post, and Curt Pringle became the new Majority Floor Leader. HRs 1-8 were proposed Rule changes to reflect what became a 40-40 stalemate and all were defeated. In the Senate, the Republicans replaced Ken Maddy with Rob Hurtt as their minority leader. Doris Allen was successfully recalled in late 1995 and Scott Baugh was elected as her replacement. With Baugh's election, Curt Pringle made a successful attempt on January 4, 1996 to replace Brian Setencich as Speaker of the Assembly. In December of 1995, Willie Brown was elected Mayor of San Francisco. The former Speaker served in the Assembly for 30 years, half of those being Speaker of the Assembly. Carole Migden was elected in a special election to fill the vacancy caused by Willie Brown's election. Richard Katz replaced Brown as Minority Leader. In the Senate, Rob Hurtt replaced Ken Maddy as Minority Leader in 1995. Maurice Johannessen, who replaced Bill Leonard as Republican Caucus Chair in 1995, was replaced by Ross Johnson in 1996. Senator Charles Calderon replaced retiring Senator Henry Mello as Majority Leader. The 1996 Election will see the first major effect of the term limits placed upon legislative members. 10 Senate Members will be termed out along with 22 Assemblymen. SB 1507 (Petris-D) - Legislative Records Requires Senate and Assembly Committees to preserve all legislative records relating to legislation assigned to the committees that are in its custody or to lodge the records with the State Archives, as specified. Chapter 928, Statutes of 1996 SB 1647 (Leslie-R) - Legislature: Regular Session Requires the Legislature to convene in regular session on the first Monday in March of each calendar year. (Died in Senate Rules Committee) SCA 1 (Alquist-D) - Unicameral Legislature Provides for a modified single-house parliamentary system of government with a Governor elected by a majority of the Legislature. (Died in Senate Rules Committee) SCA 2 (Kopp-I) - State Budget: Legislative Actions Requires the Legislature to pass a State Budget by midnight on June 30. Provides for forfeiture of pay by the Members of the Legislature if the Budget is not passed by that time. Provides that the Budget Bill be passed by a majority vote rather than 2/3 vote of the Legislature. (Died on Senate Inactive File) SCA 11 (Campbell-R) - Legislature: Exclusion of Members Excludes members of the Legislature from serving when convicted of bribery, perjury, forgery, malfeasance in office, or other high crimes. (Died in Senate Rules Committee) SCA 26 (Thompson-D) - Budget Bill: Legislative Vote Provides requirement for enactment of a Budget Bill with a majority vote and requires statutes enacting Budget Bills to go into effect immediately. (Refused passage on Senate Third Reading) SCA 27 (Leslie-R) - Legislature: Regular Sessions Limits the matters to be considered by the Legislature at a regular session in December of each even-numbered year, or in an odd-numbered year, to the Budget Bill for the ensuing fiscal year, revenue acts for that Budget Bill, and acts necessary to provide expenses of the session. Reduces time period in which bills other than the Budget can be heard or acted upon from 31 days after introduction to 11 days. (Died in Senate Rules Committee) SCA 31 (Haynes-R) - Legislators Sets annual salary of Legislators at $52,500 and allows the California Citizens Compensation Commission to continue to adjust the salary schedules. Changes the legislative sessions and definition of reimbursable living expenses, and the budgetary process. (Died in Senate Rules Committee) SCA 39 (Killea-I) - Legislative Sessions ACA 49 (Isenberg-D) - Legislative Sessions Provides that the Legislative session end on July 31 of each year. Gives the Governor 45 days to sign or veto bills and return them to the Legislature. Between sessions, the Legislature will be constitutionally authorized to hold overnight hearings and studies as it deems necessary and appropriate committees in the house of origin could hear and act on legislation 10 days after a bill is in print. Requires bills to pass the house of origin by May 1. Bills not passed by May 1 of the first year of a biennial session from house of origin may not be heard in the other house until the following year. In any event, bills introduced in the first year must pass out of the house of origin by January 31 of the second year. Allows the Legislature to meet 5 days in the fall to consider veto legislation. (SCA 39 died in Conference Committee and ACA 49 failed passage on the Senate Floor) SR 11 (Polanco-D) - Qualifications of Senate Members Sets up a procedure whereby a person elected to the Senate must take the oath of office by a specified timeframe or become disqualified from holding the office of Senator, as specified. (Died in Senate Rules Committee) SR 45 (Lockyer-D) - Secretary of Senate: Greg Schmidt Elects Gregory Palmer Schmidt to be Secretary of Senate replacing Rick Rollens who resigned for family reasons. (Read and Adopted) AB 116* (Speier-D) - Legislative Oversight: Reports Extends the sunset date from January 1, 1995 to January 1, 2000 to provide that no state or local agency be required to prepare and submit any written report to the Legislature or Governor, unless exempted or certain circumstances exist. Chapter 970, Statutes of 1996 AB 673 (Hoge-R) - Legislative Sessions: Part-Time Sets up procedures for a part-time Legislature. (Died in Assembly Rules Committee) AB 879 (Rogan-R) - Bill Limitation Provides for a bill introduction limitation of 30 for each Senator and 25 for each Assembly Member. (Died in Senate Rules Committee) AB 1719 (Isenberg-D) - Public Officers: Compensation Requires the salary payable to a Member of the California State Legislature, the Governor and other state constitutional officers be reduced by the amount of any state or local monthly retirement allowance they are receiving. (Failed passage on Assembly Floor) AB 2555 (Thompson-R) - Legislative Members: Jury Service States intent of the Legislature that each member of the Legislature perform jury service during each term he or she serves in the Legislature. (Died in Assembly Judiciary Committee) AB 3041* (Assembly Rules Committee) - Legislature: Independent Audits Requires that the Assembly Committee on Rules and the Senate Committee on Rules contract and conduct annual audits of their respective operating funds separately, as specified. (Died in Senate Rules Committee) ACA 1 (Burton-D) - Legislators: Retirement Allows members elected or serving after November 1, 1990 to participate in the Public Employees' Retirement System. (Died in Assembly Public Employees, Retirement and Social Security Committee) ACA 5 (Brulte-R) - Legislature: Procedures Adds to the California Constitution specific requirements relating to the internal affairs of the Legislature, including procedures relating to the organization of the houses and the committees thereof. Governor would preside until a Speaker is chosen, and would have a vote only for the election of the Speaker, as specified. (Died in Assembly Rules Committee) ACA 27 (Goldsmith-R) - Legislature: Time of Oath Taking Requires that when a Member of one house of the Legislature is elected to a full or partial term in the other house, he or she must take the oath of office for the office in the other house within 60 calendar days following the issuance of the certificate of election. Provides that failure to do so would create a vacancy in the state seat. (Died in Assembly Rules Committee) HR 18 (Bowler-R) - Assembly Elections: Recall Costs Specifies that the Assembly is to reimburse the election costs to counties for recall elections of Assembly Members from the Assembly Operating Fund. (Died in Assembly Rules Committee)Affirmative Action LegislationOne issue which has come to the forefront in California is the repeal of affirmative action programs. On July 20, 1995, the University of California Regents, with the Governor's urging, repealed affirmative action programs in the University of California system. The California voter will be voting at the 1996 General Election on Proposition 209 which prohibits discrimination or preferential treatment of individuals or groups on the basis of race, gender, color, ethnicity or national origin by California public entities in employment, education or contracting. SB 576 (Dills-D) - State Employees: Hiring Goals: Disabilities Requires the State Personnel Board to survey the number of people with disabilities in each state department and compare those numbers with the ratio of disabled persons in the workforce to establish hiring goals for state agencies and departments starting in 1996-97. (Died in Assembly Public Employees, Retirement and Social Security Committee) SB 940 (Campbell-R) - Education: Race Neutral Determinations Prohibits, except under court orders, public schools or institutions from considering a person's race with respect to admission of that person to the educational institution, a decision to provide financial assistance to that person, and an evaluation of that person's academic performance. (Died in Senate Education Committee) SB 983 (Campbell-R) - Postsecondary Education Faculty: Employees Prohibits public institutions of higher education from using a person's race, color, religion, sex or national origin as a criterion for either discriminating against or granting preferential treatment to that person in faculty employment. (Died in Senate Education Committee) Similar legislation is AB 833 (Richter-R) which died in Assembly Higher Education Committee. SB 1657 (Dills-D) - Public Utilities: Disabled Veterans Preference Requires the Public Utilities Commission to establish, by January 31, 1997, a reasonable participation goal for disabled veteran business enterprises for contracts for construction, professional services, materials, supplies, equipment, alteration repair or improvement. Vetoed by the Governor SCA 10 (Kopp-I) - Civil Rights Prohibits state and local governmental agencies from discriminating against, or granting preferential treatment to any individual or group on the basis of race, sex, color, ethnicity, or national origin in the areas of public employment, public education, and public contracting, as specified. (Died in Senate Governmental Organization) Similar legislation is ACA 2 (Richter-R) which died in Assembly Judiciary Committee. SCR 41 (Polanco-D) - Public Contracting Requests the Secretary of State and the Consumer Services Agency to establish an Interagency Advisory Council of Small and Disadvantaged Business in Public Contracting to assist state agencies in providing access to public contract opportunities in state government for California's small and disadvantaged firms. (Died in Senate Governmental Organization Committee) AB 193 (K. Murray-D) - State Contracts: Participation Goals Requires state agencies to conduct periodic outreach activities to encourage minority, women or disabled veteran-owned enterprises to become qualified to bid on state contracts. (Died in Assembly Utilities and Commerce Committee) AB 211 (Richter-R) - Public Officers and Employees: Employment Preference Repeals affirmative action requirements concerning minorities and women at state agencies, school districts and community college districts. Prohibits any public officer or employee from giving any preferences on the basis of race, sex, color, ethnicity or national origin to any person for hiring or promotional purposes, except that socioeconomic factors may be considered when evaluating applicants for entry level jobs. (Died in Assembly Higher Education Committee) AB 384 (Goldsmith-R) - Public Agency Contracts Repeals the authorization in the meeting of minority and women business enterprise participation goals in the state contracting bidding process. Repeals authorization for local agencies to require contract bidders to meet goals for hiring minority, women and disabled veteran-owned businesses. (Failed passage on Assembly Floor) A similar bill was SB 938 (Campbell-R), which died in Senate Governmental Organization Committee. AB 727 (Richter-R) - Education: Race Neutral Determinations Prohibits public schools and colleges from considering a person's race, except as ordered by a court as a matter of federal law or state constitutional law, in determining admission or financial assistance in higher education or in evaluating academic performance. (Died in Assembly Higher Education Committee) AB 1001 (Kuehl-D) - Sexual Orientation Adds sexual orientation to a state requirement that public schools, colleges and universities ensure their program are free from discrimination based on ethnicity, religion, age, gender, color or physical or mental disability. (Failed passage in Assembly Education Committee) AB 1243 (Lee-D) - State Contracts Requires an awarding department, in evaluating a contract bid, to determine whether or not potential subcontractors that the bidder states were contacted in an effort to meet participation goals, were, in fact, actually contacted. (Died in Assembly Utilities and Commerce Committee) AB 1676 (Lee-D) - Public Service Contracts: Progress Payments Allows all state departments, agencies or authorities to make advance payments of up to 25% of the annual allocation to be made pursuant to a public service contract to a nonprofit organization or a small minority, women or disabled veteran-operated business enterprise with which it has contracted for the delivery of services. (Died in Assembly Consumer Protection, Governmental Efficiency and Economic Development Committee) AB 2468 (Brulte-R) - Civil Rights Prohibits preferential treatment on the basis of race, color, sex, ethnicity or national origin in public employment, public education and public faculty employment. (Failed passage on Assembly Floor) ACA 16 (K. Murray-D) - Diversity Goals Adds a provision to the State Constitution specifically allowing the Legislature to establish diversity goals for state and local government activities, programs and contracting. (Died in Assembly Utilities and Commerce Committee)State GovernmentSB 96* (Greene-D) - Negotiable Notes Provides clarification as to the State Treasurer's authority to issue revenue bonds in the form of commercial paper. Chapter 23, Statutes of 1996 SB 168 (Hughes-D) - Teachers' Retirement Board: Composition Changes the status of 4 members of the State Teachers' Retirement System (STRS) Board from being appointed by the Governor to being elected by members of specified STRS constituent groups. (Died in Assembly Public Employees, Retirement, and Social Security Committee) SB 174 (Killea-I) - California Constitution Revision Commission Extends the sunset date of the California Constitution Revision Commission from July 1, 1996 to January 1, 1997. Permits the commission to supplement its August 1, 1995, report to the Legislature as it deems necessary. Appropriates $149,000 from the General Fund for the commission's general operations through the 1996 calendar year. Makes other changes. (Died in Assembly Appropriations Committee) SB 189 (Alquist-D) - Controller: Warrants Provides that, on and after January 1, 1996, whenever any warrant is unpaid for 1 year after it becomes payable, sufficient unapplied moneys having been available, the Controller would be required to cancel the warrant. (Died in Senate Governmental Organization Committee) SB 279 (Lewis-R) - Expenditure of Public Moneys: Statewide Measures Precludes public officials from expending public monies to challenge any statewide ballot measure. (Died in Senate Rules Committee) SB 286 (Polanco-D) - State Procurement: Performance Based Procurement Establishes Performance Based Procurement as an alternative acquisition mechanism to the existing competitive bid method, to be used by state government in its acquisition of electronic data processing and telecommunications goods and service, as specified. Vetoed by the Governor SB 322 (Costa-D) - California Debt Limit Allocation Committee Codifies an existing practice by placing the Director of the Department of Housing and Community Development and the Executive Director of the California Housing Finance Agency as nonvoting members of the California Debt Limit Allocation Committee (CDLAC). Double- joined with AB 2599 (Thompson-R), which adds a nonvoting local representative on CDLAC. Chapter 832, Statutes of 1996 SB 482 (Calderon-D) - State Real Property: Department of General Services Creates a new process for pre-qualifying sites and acquiring state office buildings for 15 specified agencies in Sacramento through lease-purchase and lease with option to purchase. The Legislature would receive an estimate of the project costs. Authorizes the issuance of revenue bonds, as specified. (Failed passage on Senate Floor) SB 611 (Killea-I) - State and Local Finance Consolidates, eliminates and renames financing authorities, commissions and committees within the purview of the State Treasurer's Office, as specified. (Died in Senate Budget and Fiscal Review Committee) Similar legislation is SB 1345 (Boatwright-D) which was vetoed by the Governor. SB 786* (Polanco-D) - Earthquake Safety: Public Buildings Appropriates $171,800,000 from the 1990 Earthquake Bond Act for 20 specified projects that have been recommended by the State Architect and the Department of General Services (DGS). Appropriates an additional $1,685,000 to DGS to cover its support costs in administering these projects and to conduct additional building surveys on 50 buildings. (Died in Senate Budget and Fiscal Review Committee) SB 854 (Killea-I) - State Contracts: Discriminatory Jurisdiction Requires the Director of Trade and Commerce to prepare a list of all jurisdictions that enforce a preference that discriminates against a business entity whose principal place of business is in this state in the procurement of goods or services. Requires the Director of Trade and Commerce to deliver a copy of this list to the Director of General Services. Prohibits a state agency from entering into a contract with a foreign business enterprise that has its principal place of business located in a discriminatory jurisdiction contained on the list prepared by the Director of Trade and Commerce. (Died in Senate Governmental Organization Committee) SB 974* (Alquist-D) - State and Local Governments: Performance Audits Creates the Performance Audit Joint Task Force, consisting of the Governor and the Controller. The task force will, in consultation with the State Auditor, Director of Finance, Joint Legislative Budget Committee, Joint Legislative Audit Committee, and the Legislative Analyst, periodically identify state agencies, programs or practices that would likely benefit from performance audits, as specified. (Died in Senate Governmental Organization Committee) SB 1225 (Johannessen-R) - Infrastructure Financing Authorizes state and local governmental agencies to enter into agreements with private entities to construct, maintain, and operate infrastructure facilities. The private entity would build, finance, and operate the project for up to 35 years after which title to the project would revert to the governmental agency. This proposal would be applicable to various infrastructure projects, as specified, for which a user fee could be charged for operation. Requires the governmental agency to use a "competitive negotiation process," as specified, for selection of the contractor, however, makes it explicit that existing "competitive bid" requirements are not applicable. Permits the use of a language other than the common language, as specified. Requires a state agency to delineate as a separate line item in its budget all costs related to the preparation, translation, printing, and recording of documents, records, brochures, pamphlets, flyers, or other informational materials in languages other than the common language. Repeals the authority of any state or local government, in connection with the sale and issuance of bonds, or acquisition, or carrying of any investment or program of investment, to enter any contracts that the state or local government determines to be necessary and appropriate to place the investment in whole or in part, on the interest rate, currency, cash- flow, or other basis desired by the state or local government. Chapter 175, Statutes of 1996 SB 1605 (Leslie-R) - California State Library Foundation Allows the State Librarian, in consultation with an advisory committee, to annually award a gold medal for excellence in the humanities and science to an individual or organization for publication of a work that has enriched the collection of the State Library. Authorizes the State Librarian to enter into an agreement with the California State Library Foundation to provide copies and reproductions of rare and valuable State Library materials to the public for a fee consistent with the cost of providing these services. Chapter 213, Statutes of 1996 SB 1641 (Marks-D) - Pilotage Adds "inland pilots" to an existing provision of law that exempts certain vessels from all pilotage charges unless a pilot is actually employed. Makes it explicit that specified vessels must use a licensed pilot or inland pilot. Chapter 1115, Statutes of 1996 SB 1763* (Senate Budget and Fiscal Review Committee) - State Government Authorizes the Department of General Services to enter into a performance budget contract that would include the authority, notwithstanding existing statutes and regulations, to contract for personal services comparable to state service, to waive provisions of the State Civil Service Act and provisions governing personnel administration, and to procure goods from the private sector even though the goods may be available through the Prison Industry Authority. Exempts state agencies from a requirement that all state printing be done in the Office of State Printing, as specified. Chapter 191, Statutes of 1996 SB 1770* (Johnston-D) - State-Owned Property Requires the Department of General Services (DGS) to undertake and complete an environmental impact report (EIR) on the area surrounding the State Capitol, known as the Capitol Area. The EIR will be used to determine the cost effectiveness of consolidating state offices for various Sacramento-based agencies into new site locations. Does not apply to activities conducted in relation to the negotiation or renegotiation of a contract for legal services. Chapter 1146, Statutes of 1996 SB 2118 (Monteith-R) - Building Standards: Fire Safety Requires adopted building standards to include all floor-level exit sign technologies identified and permitted by the model building code that the California Building Standards Code is based upon. Vetoed by the Governor SB 2168 (Johannessen-R) - Public Acquisitions Establishes the Best Value Purchasing Act that would apply in lieu of existing provisions governing the procurement of goods and services, with limited exceptions. Provides that for certain paper, the minimum content standard shall be no less than 20% of fiber weight of postconsumer materials, beginning December 31, 1994; and increases the standard to 30%, beginning December 31, 1998. Chapter 319, Statutes of 1996 AB 621 (Brulte-R) - Office of Child Development and Education Creates the Office of Child Development and Education to be administered by a secretary appointed by the Governor and confirmed by the Senate, as specified. Chapter 1004, Statutes of 1996 AB 1390 (W. Brown-D) - State Government: Performance Audits Changes the dates by which state fiscal agencies must complete an inventory of state agencies with strategic plans and recommended strategic plans are completed. Creates a state task force to establish a plan to conduct performance audits of agencies with completed strategic plans and requires that the audits begin, from funds appropriated for such purposes, on or after July 1, 1996. Identifies areas that the audits would address. Chapter 860, Statutes of 1996 AB 2300 (McPherson-R) - Joint Exercise of Powers Provides a specified exemption for described insurance and risk pooling arrangements within a joint powers agreement by public agencies which conduct fairs or exhibitions, from approval by the Department of General Services. Chapter 373, Statutes of 1996 AB 2379 (Margett-R) - State Mandates Requires the state to reimburse local governments, other than schools, for any acts or orders enacted after 1996 which reduce local revenue by creating exemptions, prohibiting the imposition of fees, taxes or assessments or reducing or redistributing state subventions. Limits the disclaiming of reimbursement for voter-approved mandates to those initiated by the voters. Vetoed by the Governor AB 2457 (Figueroa-D) - State Procurement: Forced, Convict, and Indentured Labor Requires state contracts to specify that no foreign-made equipment, materials, or supplies furnished to the state pursuant to the contract may be produced by forced labor, as defined, convict labor, or indentured labor under penal sanction, as specified. Chapter 1149, Statutes of 1996 AB 2570 (Margett-R) - State Civil Service: Administrative Regulations Modifies current law which exempts the Department of Personnel Administration (DPA) from the Administrative Procedure Act, and establishes a separate law governing administrative procedure for internal personnel administration. Clarifies existing law regarding DPA's responsibility to hold hearings. (Failed passage in Senate Governmental Organization Committee) AB 2599 (Thompson-R) - California Debt Limit Allocation Committee: Housing Allocation Adds a representative from local governments as a non-voting member of the California Debt Limit Allocation Committee. Chapter 831, Statutes of 1996 AB 2796 (Baldwin-R) - State Funds Specifies that revenues derived from fines and penalties collected by state agencies must be deposited in the General Fund and not be expended unless the Legislature authorizes that expenditure in the Budget Act or other legislation. AB 2992 (Napolitano-D) - Controller: Duties Requires the State Controller to transfer the balance in the Computer Software Refund Fund (CSRF) to the General Fund, not later than March 15, 1997. Abolishes the CSRF after the transfer is made. Makes technical changes to allow the controller sufficient time to transmit funds to the counties pursuant to the Timber Yield Tax Law. Deletes obsolete requirements of the controller related to the certification and discharge of accounts of persons indebted to the state. Chapter 309, Statutes of 1996 SB 366 (Rogers-R) - Local Government Finance Reallocates, from 3 counties to 4 community services districts, funds that were provided to law enforcement agencies throughout the state, but excluded these 4 districts. Chapter 704, Statutes of 1996 SB 417 (Hurtt-R) - Local Agencies' Investment Maturities Limits the maximum maturity of local agency investments, other than pension funds, deferred compensation funds and self-insurance funds. Specifically, 90% of the invested surplus funds would mature within one year. The remaining 10% of the funds would mature within 3 years. These latter funds could be reinvested for another 3 years, after which the funds would have to be spent for their intended purpose. Also limits the maturity for collateralized mortgage obligations and other specified investments for pensions, self-insurance funds and deferred compensation funds to 5 years, and to 1 year for other invested funds. Chapter 6, Statutes of 1996 SB 700 (Hayden-D) - Redevelopment: Northridge Earthquake Modifies the referendum procedures with respect to redevelopment activities conducted as a result of a disaster or Governor declared emergency within the City of Los Angeles. Expands the powers provided to project area committees. Allows project area committees to be created to replace any previously existing advisory committee. (Failed passage in Assembly Local Government Committee) SB 805 (Monteith-R) - Commission on State Mandates Membership Expands the membership of the Commission on State Mandates to 7 members by providing for the appointment by the Governor and approval by the Senate of 2 additional members. Specifies that those members shall serve a 4-year term subject to renewal, and receive a per diem allowance. Chapter 154, Statutes of 1996 SB 807 (Monteith-R) - Air Pollution Districts Allows an air pollution district to enter into a compliance agreement or mutual settlement agreement with noncomplying facilities in lieu of the imposition of criminal or civil penalties, as specified. (Died in Senate Local Government Committee) SB 836 (Lewis-R) - Air Pollution: South Coast District Declares specified existing rules and regulations of the South Coast Air Quality Management District void, and requires the district to provide for an immediate partial rollback of the district's Rule 2202, requiring large employers in the district to mitigate mobile source emission generated in the region. Amends the worksite employee threshold to be raised to 250, and allows an increase to 500 under specified conditions. Allows the State Air Resources Board to adopt regulations which define specified terms relating to employer-based trip reduction. Requires these terms to be used by air quality districts, county congestion management agencies, and other local agencies with employer-based trip reduction regulations or ordinances. Chapter 993, Statutes of 1996 SB 850 (Hayden-D) - Land Use: Developments Makes cities and counties that knowingly issue development permits within hazardous areas liable for hazard related injuries and death, as specified. Chapter 33, Statutes of 1996 SB 864* (Craven-R) - County Government: Treasury Oversight Provides a variety of technical clean-up changes relating to local agency investment policy. Chapter 156, Statutes of 1996 SB 867 (Craven-R) - Local Agency Investments Limits the terms of a re-purchase or reverse re-purchase to one year or less. Limits the type of securities that may be subject to a re-purchase or reverse re-purchase agreement, and stipulates that the market value of the securities purchased under a re-purchase agreement is required to be at 102% or greater of the dollars invested to be adjusted quarterly. (Died in Senate Appropriations Committee) SB 1001 (Craven-R) - Educational Revenue Augmentation Fund Requires county auditors to limit educational revenue augmentation fund (ERAF) revenues for special education to a county's proportionate share of $2.5 million. Requires auditor to allocate the funds of any additional ERAF revenues remaining after making special education allocations to the county and cities and special districts within the county in proportion to the amount each agency shifted to ERAF. Requires Department of Finance to annually adjust Proposition 98 state appropriations to schools to prevent net fiscal effect on school and community college districts. Chapter 1111, Statutes of 1996 SB 1058 (Johannessen-R) - Mello-Roos Districts: Land Use Documents Provides that a local agency may not require, as a condition of application for, or approval of, a general plan amendment, specific plan, rezoning, tentative map, parcel map, or final map, that the applicant or landowner agree to the establishment of, or annexation of the applicant's property to, a community facilities district. (Died in Senate Housing and Land Use Committee) SB 1073* (Costa-D) - Housing Elements Extends the deadlines for local jurisdictions to revise the housing element requirements of their general plans. Chapter 39, Statutes of 1996 SB 1081 (Leslie-R) - Land Use: Frontier Counties Designates specified counties as "frontier counties". Requires the Department of Housing and Community Development to report to the legislature its recommendations for adapting housing element requirements to suit the unique needs of those counties. Chapter 438, Statutes of 1996 SB 1167* (Craven-R) - Local Government Finance Freezes the property tax transfers from cities, counties, and special districts to K-12 schools at the 1994-95 level, and requires the funds which otherwise would be allocated to schools be allocated to other local agencies. (Died in Senate Appropriations Committee) SB 1187 (Maddy-R) - Tidelands Revenues: Local Apportionments Requires under certain conditions, 25% of state revenues from oil and gas wells from state tidelands be paid to the city or county within whose boundaries the revenue is generated, up to $200 million per year (adjusted annually to reflect Consumer Price Index increases) for up to 20 years. Chapter 613, Statutes of 1996 SB 1268 (Costa-D) - Resource Conservation Districts Authorizes the Department of Conservation to make grants to resource conservation districts. Chapter 994, Statutes of 1996 SB 1272 (Killea-I) - Local Governmental Finance Deletes certain investments that are presently permissible for local agency surplus funds and funds generally, as specified. Prohibits an investment structured to pay interest at other than a fixed rate at regular intervals, and prohibits an investment made on behalf of any other local agency, with specified exceptions. (Died in Senate Local Government Committee) SB 1273 (Killea-I) - School Districts: Funds Specifies that the provision generally pertaining to the deposit of money in the county treasury is not to be construed to impede the ability of, or prohibit a school district from, investing surplus funds as otherwise authorized by law. (Died in Senate Education Committee) SB 1274 (Killea-I) - Municipal Bankruptcy Provides that any municipality in this state is authorized to be a debtor and file for adjustment of debts pursuant to specific provisions of federal law relating to municipal bankruptcy. SB 1278 (Killea-I) - Local Governmental Finance Prohibits a securities broker-dealer from acting as a combined broker, underwriter and lender to local governments with investment pools of surplus funds, and provides that a single broker- dealer may not act as the underwriter, broker or lender on no more than 20 percent of a local agency's total investments. Specifies the duties of a financial professional. (Died in Senate Financial Investment and International Trade Committee) SB 1366 (Beverly-R) - Transactions and Use Taxes: City of Avalon Permits the City of Avalon to levy a transactions and use tax at a rate of 0.5% to fund the Avalon Municipal Hospital and Clinic, subject to 2/3 voter approval. Chapter 1069, Statutes of 1996 SB 1389 (Craven-R) - Local Agencies: Open Meetings: Levy Powers Requires local agencies to obtain a majority or 2/3 voter approval for certain local taxes. Clarifies that local agencies are exempt from existing requirement for 45 days' public notice and an additional public meeting for local general tax proposals if that tax proposal is subject to voter approval. (Failed passage in Assembly Local Government Committee) SB 1434 (Kelley-R) - District Dissolutions in San Diego County Makes special provisions for any proposal involving one or more district dissolutions of specified water districts within San Diego County, including requiring the conducting authority in San Diego County to call an election if required. Specifies the form of the ballot question on the reorganization. Sunsets January 1, 2002, unless deleted or extended by subsequent statute. Chapter 352, Statutes of 1996 SB 1471 (Russell-R) - Recording Delinquent Taxes and Assessments Requires a local agency to record a "Notice of Intent to Remove Delinquent Special Tax Installment from the Tax Roll" document (known as a "notice of stripped assessment"), when foreclosing on delinquent benefit assessments or special taxes. Requires the notice to contain specific information prior to receipt of "Proof of Recordation" and removal of the delinquency from the property tax roll. Chapter 625, Statutes of 1996 SB 1504 (Calderon-D) - Open Meetings: Local Agencies Modifies the Ralph M. Brown Act (Open Meeting Law). Subjects a body that receives funds from a local agency and has a governing board which includes a member of the local agency's legislative body to the Ralph M. Brown Act only if the local agency's member is appointed as a full voting member by the local agency. Chapter 1134, Statutes of 1996 SB 1513 (Kelley-R) - Sewer Revenue Bonds for Water Recycling Expands the definition of "works" authorized under the Sewer Revenue Bond Act to include treatment facilities, pumping facilities, storage facilities, and distribution and dispersal facilities for water recycling. Applies to bonds issued or reissued on or after January 1, 1997. Chapter 75, Statutes of 1996 SB 1518 (Hurtt-R) - Legislative Control of South Coast Air Quality Management District Budget Requires any district having an annual budget of $50 million or more, which includes the South Coast Air Quality Management District, as of July 1, 1997, to transmit its revenues to the Treasurer for deposit in the Air District Fund. Permits the fund money to become available, upon legislative appropriation, for administration of each such district. (Failed passage in Senate Local Government Committee) SB 1538 (Johnson-R) - Compensation for Local Regulations Prohibits a city or county from adopting an ordinance or regulation that discontinues a legal, nonconforming use of a restaurant or retail food establishment or limits the manner of hours of operation of a lawfully established and operating restaurant or retail food establishment, on or after June 1, 1996 unless certain conditions are met. (Died in Senate Housing and Land Use Committee) SB 1554 (Kelley-R) - Public Health Facilities Provides that city, county or district medical professional staff that are members of the public hospitals governing board can contract with the board, under certain circumstances, without being deemed to have a conflict of interest. Chapter 447, Statutes of 1996 SB 1563* (Wright-R) - Property Tax Allocations to No and Low-Income Tax Cities Requires that if a "no or low property tax city" acquires a subsidiary district, then all of the property tax revenues from the district would be allocated to the city according to certain provisional requirements. Chapter 211, Statutes of 1996 SB 1565 (Senate Local Government Committee) - Local Government Omnibus Act of 1966 Enacts the Local Government Omnibus Act, and makes changes to local government laws to correct problems discovered with state statutes that affect cities, counties and special districts. Chapter 400, Statutes of 1996 SB 1566 (Monteith-R) - Redevelopment and Agricultural Land Provides that agricultural and open space lands that are enforceably restricted, as defined, are not to be included within a redevelopment area. Permits a redevelopment agency to include nonenforceably restricted agricultural land, larger than 2 acres, in a project area upon specified findings to include such property. Adds redevelopment agency reporting requirements. Chapter 617, Statutes of 1996 SB 1574 (Beverly-R) - Mosquito Abatement District Board Membership Allows any member of a city council to be appointed to the board of mosquito or vector control district as a city, county, or at-large member if that person is qualified under current law. Chapter 115, Statutes of 1996 SB 1590 (O'Connell-D) - Validation of Local Taxes Prohibits the retroactive application of the decision of the California Supreme Court in Santa Clara County Local Transportation Authority v. Guardino. Establishes that the Guardino decision would not be applicable to or control any tax levied or increased by an ordinance or resolution adopted before December 14, 1995. Prohibits filing of any action contesting validity of bill's provisions 30 days after effective date of bill. (Failed passage in Senate Local Government Committee) SB 1602 (Lewis-R) - South Coast Air Quality Management District Board Reduces the membership of the South Coast Air District's Governing Board from 12, appointed as specified, to 9 members, 5 of which are to be elected and 4 of which are to be appointed, as specified. Makes changes to quorum requirements and imposes new District residency requirements on all members of the board. (Failed passage in Senate Local Government Committee) SB 1603 (Lewis-R) - Indirect Source Controls Defines indirect source. Prohibits, generally, regulations that are designed to reduce indirect source emissions. Authorizes air pollution control districts to establish programs to identify gross polluters and requires vehicles to be tested at test-only stations. Chapter 569, Statutes of 1996 SB 1708 (Alquist-D) - Subdivisions: Solar Energy Systems Requires tentative subdivisions to be designed, to the extent feasible, for future active heating or cooling opportunities. (Died in Assembly Housing and Community Development) SB 1748 (Senate Housing and Land Use Committee) - Housing and Land Use Omnibus Act of 1996 Enacts the Housing and Land Use Omnibus Act of 1996 to effect 20 relatively minor noncontroversial changes to the statutes that affect housing, land use and redevelopment issues. Chapter 799, Statutes of 1996 SB 1817 (Hurtt-R) - Air Pollution Districts Rules and Regulations Requires air pollution control districts and air quality management districts to establish procedures to identify duplicative, overlapping or conflicting regulations, policies and procedures of those established by federal law. Requires district review of its rules and regulations at least once every 3 years, and requires district compliance with federal law. (Died in Senate Local Government Committee) SB 1842 (Petris-D) - Alameda-Contra Costa Transit District: Directors: Special Taxes Authorizes the Alameda-Contra Costa Transit District to levy special taxes on a portion of a district that is completely within the boundaries of a city or on a portion of a district that is completely within the boundaries of cities that border one another. Requires approval by a 2/3 vote of those voters residing within that designated portion and voting on the measure. Chapter 1058, Statutes of 1996 SB 1861* (Johnson-R) - Redevelopment: Tustin Marine Corps Air Station Authorizes the adoption of a redevelopment plan for the Tustin Marine Corps Air Station Redevelopment Project. Chapter 165, Statutes of 1996 SB 1865 (Craven-R) - Bonds: Local Agencies Removes language relating to the requirement that a public agency that will own or operate public facilities, financed by a joint powers authority's bond issuance, becomes a member of the authority. Chapter 834, Statutes of 1996 SB 1874 (Alquist-D) - General Plans: Safety Elements Requires Division of Mines and Geology to review draft safety elements and amendments to determine if they incorporate seismic hazards identified under the Seismic Hazards Mapping Act. Chapter 300, Statutes of 1996 SB 1914 (Johannessen-R) - Cities of West Sacramento and Davis Construction Contracts Extends and makes applicable to the Cities of West Sacramento and Davis, until January 1, 2001, current law which allows specified counties, upon approval of their respective boards of supervisors, to solicit, design and build bids for building construction projects under $50 million. Chapter 356, Statutes of 1996 SB 1928 (Johnston-D) - Air Pollution Districts: Rules and Regulations Makes a number of changes to air quality emission requirements to provide more flexibility to stationary source polluters for reducing emissions. Chapter 442, Statutes of 1996 SB 1940* (Leslie-R) - Property Tax Allocations to Volunteer Fire Districts Requires county auditor to allocate additional property tax revenues to "volunteer fire protection" districts as defined. (Died in Assembly Appropriations Committee) SB 1953 (Mello-D) - Monterey County: Courthouse Construction Fund Amends procedure for the courthouse construction fund for Monterey County. Provides that deposits collected in the Monterey County Courthouse Construction Fund shall continue through the 30th year after the initial year for which the surcharge or additional penalty, as defined, is collected, or through the 30th year after any borrowings are made for any courthouse construction. Chapter 317, Statutes of 1996 SB 1954 (Mello-D) - Local Government Finance Makes changes with regard to restrictions on the investment of Mello-Roos funds, the Mello- Roos Act, and the distribution of court fine and forfeiture moneys in Santa Cruz County between 1990 and 1995. Chapter 1161, Statutes of 1996 SB 1958 (Mello-D) - Transactions and Use Taxes: Counties Libraries Expands the taxing authority of all 58 counties, authorizing a county to levy a 0.125 or 0.25% sales tax, for not more than 16 years, for public library construction, acquisition, programs, and operations. Requires any county imposing a tax under these conditions to put to a vote of the people all taxes that are levied by the county and any other taxing jurisdiction within the county and were not approved by the voters in a manner consistent with the California Supreme Court decision in Santa Clara County Local Transportation Authority v. SB 2038 (Rogers-R) - Air Pollution Offset Transfers Renumbers an incorrectly numbered paragraph of the Health and Safety Code relating to criteria to be met for emissions offsets used in an air basin other than the originating air basin. Chapter 269, Statutes of 1996 SB 2070 (Hurtt-R) - Air Pollution: South Coast District Imposes requirements on the South Coast Air Quality Management District (District) to reduce its level of revenues and expenditures. Makes reductions in number of District staff employees. (Failed passage in Senate Local Government Committee) SB 2072 (O'Connell-D) - Local Government - County Boundary Changes Requires county boards of supervisors of affected counties or the county boundary commission to file a description and map of new boundaries with the Secretary of the Senate and the Chief Clerk of the Assembly. Prohibits any boundary change to take effect for purposes of assessment or taxation unless notice is filed by January 1 of the year when the assessments or taxes will be levied, when a county boundary is changed. Chapter 182, Statutes of 1996 SB 2111 (Beverly-R) - Water Utilities Sale or Lease Revises procedures whereby a municipal corporation may lease, sell or transfer a public utility owned and operated by it for furnishing water. Chapter 169, Statutes of 1996 SB 2112 (Leonard-R) - City of San Bernardino Redevelopment Agency Repeals statute which prohibits the mayor of a charter city in San Bernardino County from vetoing any order or resolution of the redevelopment agency or the community development commission. Chapter 1119, Statutes of 1996 SB 2113 (Haynes-R) - Local Agency Contracts: Eligibility Prohibits a local agency from directly suspending, debarring, or otherwise prohibiting a person from bidding on public works or services unless convicted in the last 3 years of specified violations of state or federal antitrust law. (Died in Senate Local Government Committee) SB 2130 (Hurtt-R) - Air Pollution: School Districts Prohibits regulation of air emissions from any school district, community college district or office of education by the South Coast Air Quality Management District. Chapter 903, Statutes of 1996 SB 2169 (O'Connell-D) - Local Agency Investments Makes changes to provisions relating to local government finance. Permits local agencies to deposit surplus funds with the treasurer of any county. Changes existing law to include out-of- county depositors as entities to which the county owes a fiduciary responsibility. Vetoed by the Governor SB 2170 (Mountjoy-R) - Air Pollution: Market-Based Incentive Programs: Recordkeeping Requires market-based incentive programs to promote the "privatization of compliance". Allows stationary air pollution sources to use computer and electronic media for compliance with emissions monitoring and recordkeeping requirements. Limits the South Coast Air Quality Management District's ability to restrict petitions for variances. Prohibits all districts with a market-based incentive program from issuing variances from emission caps. Chapter 618, Statutes of 1996 SCA 13 (Hurtt-R) - Local Government: Taxes and Assessments Requires a 2/3 vote on general and special taxes, as well as certain benefit assessments. SCA 36 (O'Connell-D) - Special Taxes with Majority Voter Approval Permits any local jurisdiction to impose any special tax with majority voter approval, if that jurisdiction is otherwise authorized by law to impose the tax, exclusively to fund transportation, public safety, or education projects and services. Permits jurisdictions to pay for debt issued to fund the projects and services authorized. (Died on Senate Floor) SCA 38 (Hurtt-R) - State and Local Taxes: Illegal Levies: Refunds Provides that if a state or local law imposes a tax, assessment, or fee determined by a court to be invalid, the amount collected unlawfully must be refunded with interest and remaining amounts returned by means of a reduction in a tax rate or tax rates in the future. (Died in Senate Local Government Committee) SCA 39 (Killea-I) - Legislature: Statutes Provides for joint election of Governor and Lieutenant Governor. Makes changes to the legislative session dates, hearings and rules. Requires the Governor, beginning in the 2000-2001 fiscal year, to submit with the budget a statement of policy goals and outcome-base performance measures. Requires a balanced budget beginning fiscal year 1998-1999, and requires the budget to contain a minimum 2% General Fund Reserve. SB 13XX (Kopp-I) - Local Agencies: Financial Affairs Requires that financial services contracts for bond counsel, underwriters and related service providers be awarded by competitive bid or, under specified circumstances, competitive negotiation. Requires that borrowing decisions involving at least $100,000 be discussed as a separate agenda item. Restricts to 1-year renewable periods the current authority of the local governing body to delegate investment decisions to the local treasurer. (Died at Assembly Desk) SB 15XX (Kopp-I) - Local Agencies: Financial Responsibility Makes local governing bodies, county treasurers, broker-dealers and investment advisers fiduciaries in the investment of public funds. Establishes priority obligations of safety, liquidity and yield when investing public funds. (Died at Assembly Desk) SB 19XX (Kopp-I) - Trustees for Bankrupt Local Agencies Allows the Governor, whenever any municipality files as a debtor under federal bankruptcy law, to appoint a trustee to oversee that municipality. Requires the Governor to issue an executive order indicating the specific powers to be assumed by the trustee. Provides that a municipality may only file under the federal bankruptcy law with the approval of the Local Agency Bankruptcy Committee that would consist of the Controller, the Treasurer, and Director of Finance, as specified. (Died at Assembly Desk) SB 20XX (Kopp-I) - Public Financing Allows the state, or any county or local agency, to suspend for up to 3 years from contracting with any financial securities broker, dealer, advisor or investment firm in any capacity who has been, or is, the subject of regulatory proceedings involving false or misleading statements, fraud, or other violations of federal or state securities law within the past 24 months. (Died in Senate Appropriations Committee) SB 21XX (Kopp-I) - Local Government Finances: Deposits Makes changes in the laws governing local agencies' deposits and investments, including allowing local agencies to deposit money in a credit union. Extends conflict-of-interest laws currently in place for credit unions to banks and associations. Chapter 364, Statutes of 1996 AB 1055* (Caldera-D) - Taxation Allows counties to recover additional property tax administration costs from local entities that receive property tax revenues. Chapter 1073, Statutes of 1996 AB 1056*(Caldera-D) - Property: Redevelopment Project Areas: Public Nuisances: Historical Resources: Environmental Impact Reports Enacts intent language on the benefits of urban renewal. Exempts any structure located in the Downtown Central Business Redevelopment Project Area of the City of Los Angeles from current law prohibiting demolition of historic buildings damaged by earthquake, and exempts such structures from existing State Office of Historic Preservation waiver process. Provides that the act does not apply if the structure has been declared to be a public nuisance by Los Angeles Department of Building and Safety during the period from January 1, 1996 to July 31, 1996. Makes findings of the need for this special law in light of California Constitutional requirement that all laws apply generally. Chapter 929, Statutes of 1996 AB 1191 (Takasugi-R) - Local Government Finance: Public Safety Provides that factors used to allocate Public Safety Augmentation Funds to the cities would be recalculated to reflect actual data. Provides that these funds are to be allocated by the county to the cities no later than the 7th of each month. Chapter 784, Statutes of 1996 AB 3296 (Brewer-R) - Property: Document Recording: Planning and Zoning Hearings Requires charter cities' zoning procedures to include the same procedures that counties and general law cities must follow. Permits specified counties to accept digitized images for recording. Eliminates the requirement of a local safety member to make contributions to PERS if he or she has reached the maximum service retirement benefit of 80% of final compensation. States that individuals accepting a career executive assignment appointment with no previous state civil service employment shall have no right of return to the state civil service upon termination of the career executive assignment appointment. Permits SPB or appointing authorities to make inquiries during the examination process regarding military discharge status and criminal convictions that are related to job requirements. The provisions of this bill become operative on July 1, 1997, and inoperative on July 1, 1998, and repealed on January 1, 1999 unless a later statute is enacted to extend these provisions. (Sent to interim study) AB 3254 (Kaloogian-R) - Public Employees: Benefits Requires the industrial disability allowances of persons who first become members on and after January 1, 1997, to be reduced. Provides that a person who first becomes a member on and after January 1, 1997, who is offered a position within the member's capacity to perform shall not be retired for disability. Requires the amount a person who first becomes a member on and after January 1, 1997, receives in disability benefits be reduced by the amount received in salary from an employer other than the county. Allows racing associations and horsemen to form purse-supplementing agreements which offset any impact cardrooms operated by the racing associations may have on a racing meeting, whether or not the cardroom is at the track site. (Died in Conference Committee) SB 1469 (Johannessen-R) - Bingo Increases the amount of winnings from $250 to $2000 for bingo games conducted by certain organizations for charitable purposes. (Died in Senate Governmental Organization Committee) SB 1800 (Polanco-D) - Indian Gaming With respect to gaming activities other than horseracing, requires the Governor to negotiate and execute a tribal-state compact with any Indian tribe requesting the Governor to do so if the scope of gaming does not exceed the scope of gaming authorized by this bill. Prohibits the Governor from negotiating any compact that permits gaming or any lands that were not within the boundaries of an Indian reservation on October 17, 1887 or title to which was not held in trust by the U.S. for the benefit of the tribe on October 17, 1888. Allows electronic gaming devices and non-house-banked card games to be operated under a tribal-state compact. Declares that the phrase "casinos of the type currently operating in Nevada and New Jersey," as used in Section 19 of Article IV of the California Constitution, does not include tribal government gaming facilities operating under a tribal-state compact. SB 1861* (Johnson-R) - Redevelopment: Tustin Marine Corps Air Station Contains provisions that prohibit the redevelopment agency for the Tustin Marine Corps Air Station from providing direct or indirect assistance to a gambling enterprise, as specified. Chapter 165, Statutes of 1996 SB 1887* (Lockyer-D) - Gambling Repeals the Gaming Registration Act, and recasts the provisions, in enacting the Gambling Control Act, as specified. Creates the Division of Gambling Control within the Department of Justice. Authorizes the division to regulate legal gambling in this state, as specified. Creates the California Gambling Control Board and delegates specified duties to the board. Designates the Governor as the state officer responsible for negotiating and executing, on behalf of the state. Creates within the State Treasury the Gambling Control Fund, as specified. Makes other technical and substantive changes to the act. (Died at Senate Desk awaiting concurrence in Assembly amendments) Similar legislation is AB 3181 (Isenberg-D). The most significant differences between the two bills is that this bill provides for the full-time commission in the event that casino-type gaming is legalized in California and the provision in AB 3181 requiring a 2/3, rather than majority vote, to pass new ordinances allowing gambling. AB 19 (Tucker-D) - Gaming Repeals and recasts the Gaming Registration Act. Creates within the Department of Justice, the Department of Gambling Control. Creates a 5-member California Gaming Control Commission, with a 5-year term of office. States that the purpose of the bill is to regulate businesses that offer lawful forms of gaming, as specified. (Died in Senate Appropriations Committee) AB 1049 (Tucker-D) - Indian Gaming Repeals the provision that designates the California Horse Racing Board as the state entity responsible for negotiating with a tribe for the purpose of entering into a compact governing horseracing activities on Indian lands, and instead designates the Governor as the state officer responsible for negotiating and executing, on behalf of the state, compacts with federally recognized Indian tribes for conducting Class III gaming on Indian lands in the state. (Died in Assembly Governmental Organization Committee) AB 1133 (Hoge-R) - Gambling Allows California-based publicly-traded companies to be licensed by the Attorney General for ownership and operation of gaming clubs in California, even if those companies have an interest in gaming operations not authorized by California law outside of the state, as specified. (Died in Senate Governmental Organization Committee) AB 2063 (Isenberg-D) - Redevelopment Project Funding Prohibits a redevelopment agency from providing any form of direct or indirect assistance to a development or business for the acquisition, construction, improvement, rehabilitation, or replacement of property that is or would be used for any kind of gambling or gaming, including facilities for that purpose, other than the California State Lottery, as specified. Chapter 136, Statutes of 1996 Similar legislation is SB 1626 (Kopp-I) which was vetoed by the Governor, and SB 1861* (Johnson-R),.Chapter 165, Statutes of 1996. AB 2770 (Cannella-D) - Bingo Authorizes a city, county, or city and county, to impose and collect an additional monthly fee for law enforcement and public safety costs that are directly related to bingo activities incurred by the city, county, or city and county. This fee will not exceed the actual costs incurred in providing the service. Chapter 283, Statutes of 1996 AB 2839 (Hoge-R) - Department of Motor Vehicles: Records: Indian Tribes Requires that specified Department of Motor Vehicles information be made available to an Indian tribe for background checks on specified employees relative to the Indian Gaming Regulatory Act. Vetoed by the Governor AB 3181 (Isenberg-D) - Gambling Repeals the authority of the California Horse Racing Board to negotiate Tribal-State compacts governing horseracing activities on Indian lands; repeals the existing Gaming Registration Act and, instead, enacts the Gambling Control Act, as specified. (Died in Senate Rules Committee) AB 3183 (Isenberg-D) - Gaming Clubs: Report of Cash Transactions Includes gambling and gaming entities in the requirement to report any financial transaction over $10,000 to the Department of Justice. Chapter 1044, Statutes of 1996 HorseracingSB 398 (Dills-D) - Quarter Horse Racing Provides that a quarter horse race may be no longer than 5-1/2 furlongs. Provides that a California-bred quarter horse must be conceived in California by a stallion standing in the state at the time of conception. Contains language addressing a chaptering conflict with AB 3106 (Hoge-R). Chapter 595, Statutes of 1996 SB 518 (Dills-D) - Wagering: Out-of-State Races Permits the California Horse Racing Board to authorize any thoroughbred racing association conducting a meeting in this state to accept wagers on the results of out-of-state races, regardless of whether the race is a feature race and regardless of the amount of the gross purse. Provides for a license fee of 8% of the total amount remaining from the takeout after the contractual payment to the out-of-state host racing association, as specified. (Died in Senate Governmental Organization Committee) SB 782 (Lewis-R) - Wagering Permits a racing association disseminating races via satellite to accept out-of-state wagers on those races, as specified. Chapter 706, Statutes of 1996 SB 954 (Maddy-R) - Wagers: Satellite Wagering Facilities: License Fees Authorizes a licensed racing association that is conducting a racing meeting to transmit live audiovisual signals to, and accept wagers on horseraces from, 1 location in the northern zone and 2 locations in the combined central and southern zones where the association is conducting its racing meeting, if certain requirements are met , including the consent of the operator of any existing track or satellite wagering facility within 20 air miles, as specified. (Died on Senate Inactive File) SB 1373 (Maddy-R) - California-Bred Races Encourages quality race horse siring and breeding in California revising the existing distribution of owner and breeder awards, as specified. Chapter 393, Statutes of 1996 SB 1396 (Maddy-R) - License Fees: Satellite Wagering: Gaming: Supplementing Purses Reduces the license fee on wagers coming in from out-of-state betting systems from 8% to 1%. Allows racing associations and horsemen to form purse-supplementing agreements which offset any impact cardrooms operated by the racing associations may have on a racing meeting, whether or not the cardroom is at the track site. Chapter 1110, Statutes of 1996 SB 1439 (Ayala-D) - Horseracing: Parimutuel Pools Allows a quarter horse racing association to offer propositional wagering at its meeting. Defines "propositional parimutuel pool" as the total wagers under the parimutuel system on propositions approved by the board that are based on the results of a live quarter horse horserace, as specified. Chapter 551, Statutes of 1996 SB 1515* (Maddy-R) - Horseraces: Stabling and Vanning Permits any stabling and vanning reimbursement funds that are not expended during an association or fair horseracing meeting in which they are collected to be allocated to the organization representing racing fairs to offset its costs of maintaining the stalls contracted for by fairs. Chapter 53, Statutes of 1996 SB 1619 (Maddy-R) - Satellite Wagering: Out-of-State and Out-of-Country Races Enables thoroughbred racing associations to distribute the satellite signal for out-of-country thoroughbred races, providing certain conditions are met. Permits associations and fairs to exclude out-of-country and out-of-state races from their wagering program. Permits racing associations and fairs with satellite wagering facilities to forego offering satellite wagering on California races the California Horse Racing Board determines that the satellite facility is sustaining a loss on its live races by offering such wagering. Provides for up to $450,000 from the unclaimed refunds to be distributed to horsemen's organization for purposes of negotiating an agreement with a jockeys' organization, as specified, for health and welfare benefits for jockeys. AB 302 (Tucker-D) - Horseracing Redefines "pari-mutuel wagering" to allow for wagering on horseraces by means other than tickets at a racetrack or other facility permitted by law to conduct satellite wagering. AB 455 (Hoge-R) - Horseracing Expands pari-mutuel wagering on horseraces to include betting on additional portions of races other than just the outcome (propositional wagering). Races must take place at racing associations authorized to conduct pari-mutuel wagering, as specified. Chapter 219, Statutes of 1996 AB 2267 (Harvey-R) - Satellite Wagering Requires fairs conducting satellite wagering in the County of Kern to be solely reimbursed specified amounts of funds by the racing associations located in the northern zone, unless otherwise agreed to in writing by each association. Chapter 1006, Statutes of 1996 AB 3090 (Machado-D) - Horseracing: Fairs Permits the California Horse Racing Board to allocate horseracing days for combined fair horseracing meetings, and permits dates to be allocated for a combined fair horseracing meeting between July 1 and October 31, as specified. Chapter 741, Statutes of 1996 AB 3106 (Hoge-R) - Horseracing: Organizations Representing Horsemen and Horsewomen Increases from 2/3 of 1% to 2/3 of 1.5%, and 1/3 of 1% to 1/3 of 1.5% respectively, the amount deducted from specified purses of horsemen and trainers for services rendered by the designated organization representing these parties. Provides that all organizations representing horsemen and horsewomen, and trainers, as defined, shall submit an audited report of all expenditures from the previous calendar year to the California Horse Racing Board, which report shall be published as part of the board's annual report. Sunsets January 1, 1999. Chapter 594, Statutes of 1996 AB 3147* (Margett-R) - Satellite Wagering: Out of State and Out of Country Races Allows a harness racing association or a quarter horse racing association to distribute the signal of, and accept wagers upon, out-of-country harness races when the racing association is conducting live racing without the consent of the horsemen's organization representing horsemen participating in the meeting, and without regard to purse amounts as specified. (Assembly refuses to concur in Senate Amendments) Similar legislation is SB 1619 (Maddy-R) which died on the Assembly Inactive File. (Failed passage on Senate Floor) AB 3205 (Hoge-R) - Horseracing: Health and Welfare Benefits: Jockeys Requires up to $450,000 of unclaimed refunds to be distributed to the organization that is responsible for negotiating specified types of agreements on behalf of the horsemen and horsewomen participating in the racing meeting for the purpose of negotiating, in good faith, an agreement of at least 3 years duration with a jockeys' organization certified by the California Horse Racing Board, as specified. Exempts members of an LLC which holds an Alcoholic Beverage Control (ABC) license from financial qualification investigations conducted by the ABC board into the shareholders of an ABC licensee, where an officer or member owns less than a 10% share of the LLC and does not participate in its management. Chapter 44, Statutes of 1996 SB 1879* (Rosenthal-D) - Alcoholic Beverages: Delivery Allows beer and wine to be delivered to retail licensees between the hours of 3 a.m. and 8 p.m. any day other than Sunday. Chapter 334, Statutes of 1996 SB 1901 (Maddy-R) - Alcoholic Beverages: Licenses: Suspension Provides that delinquency of at least 3 months of any taxes and penalties due under the Sales and Use Tax Law, the Bradley-Burns Uniform Local Sales and Use Tax Law or the Transactions and Use Tax Law shall be cause for the automatic suspension of the license to sell alcoholic beverages. Provides that the tax liability must have arisen in whole or part from the exercise of the privilege of an alcoholic beverage license. Chapter 409, Statutes of 1996 SB 1923 (Thompson-D) - Alcoholic Beverages: Licenses: Beer Labeling Requirement Provides for issuance of alcoholic beverage licenses in excess of current limits under specified conditions. Allows winery owners to serve as an officer or hold ownership in an on-sale license under specified conditions. Provides that the label conform with alcohol content labeling requirements of Section 7.71 of Part 7 of Title 27 of the Code of Federal Regulations effective July 1, 1997. Repeals the prohibition of the sale of any product labeled beer, containing more than 4% alcohol by weight and substitutes a limit of 5.7% until July 1, 1997. Chapter 900, Statutes of 1996 Similar legislation which also contained provisions relating to beer label requirements is SB 1796 (Thompson-D) which was vetoed by the Governor. SB 2021 (Dills-D) - Alcoholic Beverages: Premiums: Gifts or Free Goods Clarifies that an alcoholic beverage licensee would be prohibited from giving refunds, in addition to giving any premium, gift, or free goods in connection with the sale or distribution of alcoholic beverages, either directly or indirectly, except as specified. (Died in Senate Governmental Organization Committee) SB 2114 (Dills-D) - Alcoholic Beverages: Brewpub-Restaurant License Creates a new license for on-sale premises, the brewpub-restaurant license, as a form of on-sale retail license, to persons or entities who manufacture not more than 5,000 barrels of beer annually on the licensed premises, subject to specified conditions and restrictions. (Died on Assembly Inactive File) AB 385* (Tucker-D) - Alcoholic Beverages: Licenses: Fee Revenues Eliminates the transfer of funds collected as annual alcoholic beverage license fees to the General Fund. Instead, the funds are to be allocated to the Department of Alcoholic Beverage Control for enforcement and administration of the Alcoholic Beverage Control Act. Chapter 339, Statutes of 1996 AB 682 (Tucker-D) - Alcoholic Beverages: Tied-House Restrictions Permits a beer manufacturer or winegrower to provide sponsorship funds for or on behalf of a retail on-sale licensee who is the owner and manager of certain outdoor fairs, if certain conditions are met. Chapter 638, Statutes of 1996 AB 684 (Tucker-D) - Alcoholic Beverages: Brewpub-Restaurant License Establishes and provides for the existence and issuance by the Department of Alcoholic Beverage Control of a brewpub-restaurant license to persons or entities manufacturing not more than 5,000 barrels of beer annually on the licensed premises, subject to specified conditions and restrictions. Chapter 1098, Statutes of 1996 Similar legislation was SB 1796 (Thompson-D) which was vetoed by the Governor. AB 957 (Gallegos-D) - Alcoholic Beverages: Local Ordinances: Open Containers Allows municipalities to enforce ordinances which would prohibit possession of alcoholic beverages in unopened containers in parks, when the intent is to consume, where possession of such beverages is prohibited. (Died in Senate Governmental Organization Committee) AB 1042 (Alpert-D) - Alcoholic Beverages: Licenses: Denial Codifies an existing Department of Alcoholic Beverage Control (ABC) regulation that allows ABC to deny issuance of a license for any premises for which an application for a license has been denied or revoked for specified reasons pertaining to the premises unless 1 year has elapsed from the date the order becomes final. Prohibits a license from being issued for any premises for which a license has been denied 2 times within a 36-month period, unless 2 years have elapsed from the date the last order becomes final. Chapter 538, Statutes of 1996 AB 2091 (Alpert-D) - Alcoholic Beverages: Licenses: Convention Centers and Event Centers Exempts convention centers and event centers from the limitations imposed on counties when issuing on-sale general alcoholic beverage licenses, as specified. Chapter 254, Statutes of 1996 AB 2118 (Hauser-D) - Alcoholic Beverages: Tied-House Restrictions: Brewing Clarifies existing law and provides that specified paper beverage coasters are not included in the definition of supplies as it relates to those items currently prohibited from being given to retailers by manufacturers or wholesalers. Chapter 811, Statutes of 1996 AB 2278 (Battin-R) - Alcoholic Beverages: Licenses: Club Provides that a club license for a golf club entitles the licensee to sell alcoholic beverages from any golf cart operating anywhere on the golf club premises. Chapter 82, Statutes of 1996 AB 2545 (K. Murray-D) - Alcoholic Beverages: Minors Makes it a misdemeanor for any person under the age of 21 years to have a blood-alcohol concentration of 0.05% or greater or to be under the influence of alcohol while in any public place or in any place open to the public or while a passenger in any motor vehicle. (Died in Senate Criminal Procedure Committee) AB 2625 (Morrissey-R) - Alcoholic Beverages: Purchases by Minors: Penalties Increases the penalty for any person under 21 years of age who attempts to purchase any alcoholic beverage to a $250 fine and/or up to 50 hours of community service for a first offense and a $500 fine and/or up to 60 hours of community service for a second offense. (Failed passage in Senate Criminal Procedure Committee) AB 2811 (Cortese-RFM) - Alcoholic Beverages: Beer: Return to Seller Authorizes, upon approval by the Department of Alcoholic Beverage Control, retail licensees to return discontinued or seasonal brands of beer in exchange for beer produced or sold by the same manufacturer with the same or lesser value. Requires that such beers not be re-introduced in the same market area for specified periods. (Died on Senate Inactive File) AB 2841 (Hoge-R) - Alcoholic Beverages: Retail Licenses: Undue Concentration Requires that all local governing bodies be notified of all license applications in areas of undue concentration, as defined.
