Used as a omnibus general government budget trailer bill covering a variety of state government issues as it relates to farm labor, including allowing the State Department of Housing and Community Development to expend $1.4 million from the funds provided from the Housing and Emergency Shelter Trust Fund Act of 2002 (Proposition 46) for the Joe Serna, Jr. Farmworker Housing Grant Fund. This funding will support the repair, rehabilitation and replacement of equipment at the various state-owned migrant centers. Restricts state-owned farmworker housing rental rates so that they cannot exceed 30 percent of the average farmworker household income without specific legislative authorization.

AB 32 (Salinas-D) Housing: farmworker housing

Authorizes local public agencies or nonprofit organizations that construct farmworker housing using public funds to lease that housing to agricultural employers who agree to rent the housing units to their employees on the same terms as would the local entity. Extends the authority of the State Department of Housing and Community Development to enter into a memorandum of understanding with a nonprofit corporation to administer the Joe Serna, Jr. Farmworker Family Wellness Program through January 1, 2008.

Authorizes the Commission to re-establish district boundaries by a two-thirds vote in order to ensure proper representation, eliminates provisions relative to the three-year term of office for each member, permits the tonnage threshold for a producer and handler to be increased by a two-thirds vote of the Commission, and conversely decreased if approved by referendum, adds two at-large members who have a financial stake in the pepper industry to be appointed at the discretion of the Commission, and permits the Commission to re-define categories of pepper handling.

SB 456 (Ortiz-D) Sacramento Suburban Water District: board: finances

Sets the compensation of a member of the board of directors of the Sacramento Suburban Water District (SSWD) at $1,000 per year, commencing January 1, 2004, and provides that, commencing on that date, each member of the board shall be provided with appropriate health benefits only for the duration of his/her service on the board of, or an employee of, the SSWD, or a previously existing water district that was subsumed into that district, has misused funds of any of those districts, that person shall be required to repay the district the full amount of funds found to have been misused, plus interest within 30 days of the finding. Authorizes the SSWD to establish a schedule of fees to be charged for any late repayments of those funds. States the intent of the Legislature that penalties be established, including the dismissal of any employee or board member, against whom an administrative or judicial finding is made.

Requires local agencies to notify the public by posting a notice at public beaches stating that beach inspections to ensure compliance with health and sanitation standards are not being conducted.

Appropriates $15,000,000 made available by Proposition 50 to the State Water Resources Control Board for allocation to the University of California (UC) to finance the establishment of a Water Quality Information Clearinghouse to facilitate the restoration and protection of the water quality and environment of coastal waters, estuaries, bays and near shore waters, and groundwater in accordance with a certain provision of that act. Declares that nonuse of water as a result of conservation efforts constitutes good cause to extend the period specified in a permit for application of appropriated water to beneficial use. Requires the State Water Resources Control Board to extend the time for application of the water to beneficial use for a period of time sufficient to enable the permittee to perfect its appropriation if the petition to extend the time to apply water to beneficial use includes a description of future increased water requirements that are anticipated to be satisfied with water diverted under the permit, and other requirements are met.

SB 1107* (Senate Budget And Fiscal Review Committee) State Budget Act of 2004: resources

A budget trailer bill which makes changes to current law relating to natural resources and environmental protection necessary for the implementation of the 2004-05 Budget Act. Among the bill's provisions relating to this subject:

  1. Increases Watermaster Fees. Increases fees paid by water users so those fees cover the entire costs of the Watermaster program. This will result in $713,000 General Fund savings.
  2. Establishes a River Parkways Program. Provides legislative parameters and guidelines for river parkway grants and land acquisitions made by the Secretary of the State Resources Agency. This bill also appropriates $7.9 million Proposition 40 bond funds and $30.5 million Proposition 50 bond funds for this purpose.
  3. Limits Creation of New State Maintenance Areas. Gives the State Department of Water Resources discretion over whether to form a flood management maintenance area outside the Central Valley in the future and authorizes the department to recover all costs related to establishing a new maintenance area. This reduces the state's future liability related to maintenance of flood management projects.
  4. Consistency of CALFED Grant Programs. Clarifies existing law that requires water projects funded within the CALFED solution area to be consistent with the objectives of the CALFED program as specified in the CALFED Record of Decision. Requires the California Bay-Delta Authority to review grant criteria of programs and projects with the CALFED solution area. Ensures state funds expended within the CALFED solution are expended in a more cost-effective manner.

Requires the State Department of Water Resources (DWR) to deem certain water management projects that are operational on or before November 5, 2002, to be part of an adopted regional water management plan. Requires DWR to give preference to projects designed to restore, repair, rehabilitate, or replace water management projects damaged or destroyed as a consequence of fires or other natural disasters.

Changes the name of the Lake County Flood Control and Water Conservation District to the Lake County Watershed Protection District (LCWPD), and authorizes LCWPD to participate alone, or jointly with Lake County, or cities or districts within Lake County, in the federal National Pollution Discharge Elimination System permit program in accordance with the Clean Water Act. Authorizes the LCWPD to impose and collect fees to carry out the purpose of the district.

Prohibits an entity from substantially impairing or altering a state regulated wetland without first obtaining a wetland alteration permit, as provided. Requires the Director of the State Department of Fish and Game to establish a fee for the application and the issuance of wetland alteration permits.

AB 496 (Correa-D) Santa Ana River Conservancy

Establishes the Santa Ana River Conservancy, until January 1, 2012, to acquire specified lands within one-half mile on either side of the thread of the Santa Ana River and prescribes the management, powers, and duties of the conservancy. Creates the Santa Ana River Conservancy Fund, but prohibits the conservancy from implementing the funding authorization until the Legislature appropriates the necessary funds. Requires the conservancy, by January 1, 2006, and annually thereafter, to submit a report to the Governor and the Legislature on progress made to further the purposes of the conservancy. Requires the conservancy, on December 31, 2011, to transfer all land acquired in accordance with the provisions of the bill to the State Resources Agency, unless the repeal of those provisions on January 1, 2012, is otherwise deleted or extended.

Provides for the termination of this arrangement upon notice from the city and county or upon the city and county engaging in retail sales to customers within the service territory of Pacific Gas and Electric Company, as a result of becoming a community choice aggregator, as a result of municipalization, or otherwise.

Repeals the provision of law that requires the State Resources Agency to initiate a comprehensive, long-range planning process for the use of offshore ocean waters and, instead, requires the Secretary for California Environmental Protection Agency and the Secretary of the Resources Agency to (1) jointly conduct a review of the regulatory programs under their respective jurisdictions in light of the Pew Oceans Commission's June 4, 2003 report; and (2) report to the Legislature by April 1, 2005 regarding suggested structural and budgetary changes needed for a coordinated coastal and marine program.

Authorizes the board of directors of a metropolitan water district to contract, on and after January 1, 2005, for services performed by employees to achieve cost saving if various requirements are met. Permits the district to contract for certain types of services, including the performance of new functions if the Legislature has required or authorized the performance of those functions by independent contractors.
