Clarifies when a law enforcement agency needs a warrant to use an unmanned aircraft system, and that such a system cannot be used in a manner to invade a person's privacy.

AB 536 (Wagner-R) Contractors: payments

Excludes claims for additional compensation from the definition of a "disputed amount" for purposes of existing law that authorizes, in the event of a good faith dispute, the withholding of 150% of a disputed amount from certain payments to contractors and subcontractors.

AB 666 (Wieckowski-D) Automated traffic enforcement systems: violations

Requires violations recorded by an automated traffic enforcement system to be cited as civil violations, subject to a civil penalty, administrative process, and appeal in superior court. Exempts certain of those civil violations from the violation point count process.

AB 737 (Fox-D) Space flight liability

Includes a manufacturer or supplier of components, services, or vehicles that have been reviewed by the United States Federal Aviation Administration as part of issuing a license, permit, or other authorization pursuant to specified provisions of federal law relating to commercial space launch activities as a space flight entity with limited liability for any participant injury. Provides that limited liability under its provisions does not limit or prevent the liability of a space flight entity that manufactures or supplies a product with a defect, and repeals the Space Flight Liability and Immunity Act on 7/1/21.

AB 969 (Ammiano-D) Landlord and tenant

Provides that, if a lessor retaliates against a lessee of a dwelling for exercising his/her rights or because of a complaint to an appropriate agency as to tenantability, and the lessee is not in default as to the payment of rent, the lessor may not recover possession, cause the lessee to quit involuntarily, increase the rent, or decrease any services within 180 days of the occurrence of specified events.

AB 1164 (Lowenthal-D) Liens: employees and workers

Authorizes an employee to record and enforce a wage lien upon real and personal property of an employer, or a property owner, as specified, for wages, other compensation, and related penalties and damages owed the employee.

AB 1254 (Gorell-R) Civil actions: settlement offers

Provides that for a settlement offer that is not accepted, it must be served 15 days prior to the commencement of trial or arbitration and not be accepted prior to the trial or arbitration or within 25 days after the offer is made, whichever comes first.

AB 1256 (Bloom-D) Privacy: entry and exit of facilities

Recasts existing law to provide that a person is liable for a physical invasion of privacy when a defendant knowingly enters onto the land of another person without permission or otherwise commits a trespass with the intent to capture any type of visual image, sound recording, or other physical impression of the plaintiff engaging in a private, personal, or familial activity and the invasion occurs in a manner that is offensive to a reasonable person. Defines "facility," and defines "private, personal, or familial activity," and provides that this definition applies to physical and constructive invasion of privacy.

AB 2368 (Wagner-R) Civil law: libel: damages

Expands provisions of existing law related to actions for damages for the publication of a libel in a newspaper or in a radio broadcast to additionally include libel in a periodical or other medium, either in print or electronic form.

SB 323* (Lara-D) Taxes: exemptions: prohibited discrimination

Provides that, for taxable years beginning on or after 1/1/14, any "public charity youth organization" shall not be exempt from the Corporation Tax Law if it discriminates on the basis of gender identity, race, sexual orientation, nationality, religion, or religious affiliation.

SB 404 (Jackson-D) Fair employment: familial status

Adds "familial status" to the protected categories of the employment provisions of the Fair Employment and Housing Act. Defines familial status as an individual who provides medical or supervisory care to a family member and for the purposes of this definition. Family member is defined as any of the following: child, parent, spouse, domestic partner, and a parent-in-law.

AB 1356 (Bloom-D) Stalking: remedies

Includes a pattern of conduct intended to place the plaintiff under surveillance within those elements defining the tort of stalking. Permits the plaintiff to show, as an alternative to the plaintiff reasonably fearing for his/her safety or that of a family member, that the pattern of conduct resulted in the plaintiff suffering substantial emotional distress, and that the pattern of conduct causes a reasonable person to suffer substantial emotional distress.

Makes it a violation of the Fair Housing and Employment Act for an employer or other covered entity to discriminate against an individual because he/she holds or presents a specified driver's license or requires a person to present a driver's license, except as specified, and makes conforming changes to the Act. Prohibits a governmental authority or its agent, from discriminating against an individual because he/she holds or presents a specified license.

Requires the training for an administrator of a group home facility, licensed foster parent, or relative or nonrelative extended family member caregiver to include instruction on cultural competency and sensitivity relating to, and best practices for, providing adequate care to a sexually exploited and trafficked minor in out-of-home care.

AB 2288 (Roger Hernández-D) Child Labor Protection Act of 2014

Tolls the statute of limitations for unlawful labor practices until a child worker attains the age of majority and authorizes an award of treble damages to an individual, who is discharged, threatened with discharge, demoted, suspended, retaliated against, subjected to adverse action, or in any other manner discriminated against in the terms of conditions of his/her employment because he/she filed a claim or civil action alleging a violation of the Labor Code that arose while he/she was a minor, and increases civil penalties.

SB 193 (Monning-D) Hazard Evaluation System and Information Service

Requires, when there is new scientific or medical information and the Chief of the Hazard Evaluation System and Information Service (HESIS), in consultation with the Director of Industrial Relations and the Chief of the Division of Environmental and Occupational Disease Control in the Department of Public Health, makes a specified determination, chemical manufacturers, formulators, suppliers, distributors, importers, and their agents to provide to HESIS the names and addresses of their customers who have purchased specified chemicals or commercial products containing those chemicals, and certain other information related to those shipments, upon written request of HESIS, for every product the final destination of which may be a place of employment in California.

SB 556 (Padilla-D) Providers of health and safety labor or services

Prohibits a person, firm, corporation, or association that is a nongovernmental entity and contracts to perform, on or after 1/1/15, public health and safety labor or services for a public agency from displaying on a vehicle or uniform a logo that reasonably could be interpreted as implying that the labor or services are being provided by employees of the public agency, unless the vehicle or uniform conspicuously displays specific disclosures. Defines the term "public health and safety labor or services" to mean fire protection services, rescue services, emergency medical services, hazardous material emergency response services, and ambulance services.

SB 650 (Lieu-D) Motion pictures

Removes, on 1/1/15, a provision of existing law that provides, that a licensee in ordinary course of business takes its rights under a nonexclusive license free of a security interest in the general intangible created by the licensor, even if the security interest is perfected and the licensee knows of its existence. Provides that a licensee of nonexclusive rights in a motion picture that is produced pursuant to one or more collective bargaining agreements, takes its nonexclusive license in the motion picture subject to any perfected security interest securing the obligation to pay residuals as set forth in the applicable collective bargaining agreement and arising from exploitation under the license.

SB 661 (Hill-D) False advertising

Establishes an exception to existing law by authorizing a person, firm, corporation, or association to sell or offer for sale in this state any merchandise labeled as being made in the United States if the merchandise is made, manufactured, or produced in the U.S. and has an article, unit, or part from outside of the U.S. that cannot be obtained within the U.S., as specified, and constitutes only a negligible part of the final manufactured product.

SB 713 (Correa-D) Liability: good faith reliance on administrative ruling

Provides that any person who relies upon a written order, ruling, approval, interpretation, or enforcement policy of a state agency or department, except the Division of Labor Standards Enforcement, is not liable or subject to punishment for a violation of a civil statute or regulation in a judicial or administrative proceeding if the person pleads and proves to the trier of fact that, at the time of the alleged act or omission, the person, acting in good faith, took certain specified actions.

SB 750 (Wolk-D) Building standards: water meters: multiunit structures

Requires measurement of the quantity of water supplied to a multiunit residential structure or newly constructed mixed-use residential and commercial structure and permits the measurement to be by individual water meters or submeters, and requires the owner of the structure to ensure that a water submeter installed for these purposes complies with laws and regulations governing approval of submeter types or the installation, maintenance, reading, billing, and testing of submeters.

SB 1188 (Jackson-D) Consumers Legal Remedies Act: material facts

Codifies that, under the Consumer Legal Remedies Act, fraud or deceit may consist of the suppression or omission of a material fact by one who is bound to disclose it or who gives information of other facts that are likely to mislead for want of communication of that fact. Specifies that a fact is material if a reasonable person attaches importance to its existence or nonexistence in determining a choice of action in a transaction, and that materiality is not limited to circumstances in which a product poses a threat to health or safety.

SB 1256 (Mitchell-D) Medical services: credit

Extends existing consumer protections regarding lines of credit for dental services to all types of medical or healing arts services by requiring a licensee to provide a patient with a treatment plan, a disclosure form, and information about third-party payment coverage, and also establishes language and competency requirements. Authorizes a patient who suffers any damage as a result of anything prohibited by this bill to seek relief through the methods authorized under the Consumers Legal Remedies Act, as specified.

SB 1338 (Wyland-R) Credit cards: disclosures

Requires a credit card issuer, on the front page of a billing statement, to provide written statements disclosing that a missed credit card bill payment can affect a cardholder's credit history, credit report score, and ability to acquire more credit, and disclosing how a credit score is typically calculated using payment history, amounts owed, length of credit history, new credit, and types of credit used.

Enacts "The California Right to Know Genetically Engineered Food Act" to require the labeling of genetically engineered foods sold within California, as specified.

AB 167 (Hagman-R) Unfair competition: private enforcement actions

Defines the injury in fact required for a private person to bring suit as damages suffered by each individual plaintiff or member of a class amounting to at least $500, adjusted for inflation. Provides that it shall become effective only when submitted to, and approved by, the voters of California.

AB 844 (Dickinson-D) Credit and debit cards: transactions: personal information

Updates provisions of the Song-Beverly Credit Card Act of 1971 related to the protection of personal identification information to reflect the increasing use of debit cards to purchase goods and services and the increasing use of the Internet as a venue for use of both credit cards and debit cards to purchase goods and services.

AB 890 (Jones-R) False advertising

Provides that, for purposes of existing California law regarding the labeling of a product as "Made in California," or "Made in America," any merchandise has been substantially made, manufactured, or produced within the United States if it meets all of the requirements specified in this bill.

AB 961 (Levine-D) Health facilities: investigations: public disclosure

Requires the Department of Public Health to complete its investigation of a long-term health care facility and issue a citation, if any, within specified time frames. Authorizes public notice of facility investigation and evaluation information, as specified, for a facility with a license capacity of 16 or more beds.

Prohibits a vehicle dealer from advertising for sale or selling a used vehicle that he/she knows or should have known is subject to a manufacturer's safety recall, and prohibits them from selling a used vehicle as part of a used vehicle certification program if they know or should have known that the vehicle is the subject of a manufacturer's safety recall.

AB 1072 (Wagner-R) Mortgage loan modification

Prohibits a person who engages in mortgage loan modification from accepting payment for services in advance of the loan modification approval and assesses civil penalties for various related violations. Authorizes further civil penalties for unlawful or fraudulent mortgage modifications perpetrated against seniors or disabled persons, and authorizes a court to order the offender to pay restitution to the senior or disabled victim.

Makes information reported to the Insurance Commissioner in the registration statement and information disclosed in the course of an examination or investigation of a registration statement exempt from public disclosure by the Commissioner and not subject to discovery from the Commissioner or admissible into evidence in any private civil action if obtained from the Commissioner in any manner.

AB 1291 (Lowenthal-D) Privacy: Right to Know Act of 2013

Creates the Right to Know Act of 2013, and requires any business that retains a customer's personal information, as defined, or discloses that information to a third party, to provide at no charge, within 30 days of the customer's specified request, a copy of that information to the customer as well as the names and contact information for all third parties with which the business has shared the information during the previous 12 months, regardless of any business relationship with the customer. Requires that a business subject to this bill's provisions to choose one of several specified options to provide the customer with a designated address for use in making a request for copies of information under these provisions.

Imposes on an attorney the duty to deposit into a client trust account funds received in advance from, or for, the client for fees, costs, or expenses for legal services, which are to be withdrawn by the attorney only as fees are earned or costs or expenses are incurred. Authorizes legal services to be provided in stages, and authorizes an attorney to withdraw fees when he/she has performed and completed a specified stage or stages, if the agreement with the client specifies each stage and sets the amount of the advance fee for each stage.

AB 2039 (Muratsuchi-D) Real property sales: auctions

Prohibits, on and after 7/1/15, with respect to an auction that includes the sale of real property, a person from causing or allowing any person to bid at a sale for the sole purpose of increasing the bid on any real property being sold by the auctioneer, but does allow an auctioneer or another person to place a bid on the seller's behalf during an auction of real property if specified notice is given. SB 1306 (Leno-D) Marriage

Repeals the provision of the Family Code which provides that only marriage between a man and a woman is valid or recognized by the state, removes language from the Family Code which provides that marriage is only between a man and a woman, and replaces other gendered language in the Family Code with gender-neutral terms. Provides that marriage is a personal relation arising out of a civil contract between two persons, and removes limitations on the validity of same-sex marriages performed outside of California.

SB 1326 (Roth-D) Hearing aids: warranty: work order or receipt

Clarifies hearing aid warranty provisions by requiring a retailer to provide written warranty beginning and expiration dates from the time the hearing aids are initially delivered to the buyer. Prohibits the Department from disclosing the identity of a social worker making a disclosure, unless the social worker has consented to the disclosure or there is an immediate risk to the health and safety of a child.

AB 1981 (Brown-D) Rental vehicles: contracts: damage waivers

Removes the manufacturer's suggested retail price as one of the criteria for determining the rate of a damage waiver sold by a rental company, and instead sets the rate of damage waivers according to the vehicle's classification using criteria set by the 2014 Association of Car Rental Industry Systems Standards for North America. Increases the maximum rate of the damage waiver to $11 per rental day for vehicles designated as an "economy car," "compact car," or another term denoting the two smallest categories of vehicles described by the standards. Increases the maximum rate of the damage waiver to $17 per rental day for vehicles in the next three body-size categories of vehicles designated in the standards.

AB 2001 (Ammiano-D) Homeless youth: child welfare services

Requires the Department of Social Services to establish a working group to develop policy and practice recommendations to ensure that homeless, unaccompanied minors have access to appropriate placements and services through the state's child welfare system. States the Legislature's intent that law enforcement agencies work with local child protective services agencies to identify the appropriate placement for homeless youth, including placement in a homeless youth shelter, as specified. Requires a social worker to interview a minor who is in a runaway and homeless youth shelter or any other community care facility, as defined, and requires the commencement of juvenile court proceedings within five judicial days in specified cases.

AB 2065 (Melendez-R) Legislative Employee Whistleblower Protection Act: employees

Establishes the Legislative Employee Whistleblower Protection Act. Among other things, prohibits a member of the Legislature or legislative employee from directly or indirectly using or attempting to use that person's official authority or influence for the purpose of intimidating, threatening, coercing, commanding, or attempting to intimidate, threaten, coerce, or command a legislative employee for the purpose of interfering with the right of the legislative employee to make a protected disclosures. Makes applicable violations of the Act subject to a fine not to exceed $10,000 and imprisonment in a county jail for a period not to exceed one year.

AB 2068 (Nazarian-D) Charter-party carriers of passengers

Includes within the definition of charter-party carrier of passengers a person that uses an online-enabled application or platform to connect passengers with drivers. Requires the Public Utilities Commission to develop a standard disclosure agreement with specified insurance disclosures, and requires the agreement to be included in a written agreement between drivers and charter-party carriers of passengers that use an online-enabled application or platform to connect passengers with drivers, and to be signed by those drivers. Requires the trial court to provide a brief statement of the reasons for its decision to deny a protective order either in writing or on the record and provides that, for the purposes of its provisions, a court should consider provisions relating to dominant aggressors in determining if both parties acted primarily as aggressors.

Requires parties who file motions for an award of costs for bad-faith actions or tactics to transmit to the California Research Bureau (CRB) a copy of various documents associated with the motions. Requires the CRB to maintain a public record of all information transmitted related to each motion for at least three years, and, on or before 1/1/17, requires the CRB to submit a report to the Legislature examining the impact and effect of the changes made by this bill's provisions.
