Among other provisions, requires the California Transportation Commission to report semiannually on the expenditure of Transportation Corridor Improvement Funds for railroad projects, extends expenditure of funds for four years relative to water transit projects, provides a one-year extension for cities and counties to expend Proposition 1B local street and roads funds, as specified, extends the sunset for three years for cashflow borrowing among transportation special funds.

SB 901 (Ashburn-R) Transportation: bond funded projects: letter of no prejudice
Authorizes a regional or local agency that is a lead agency for a project or project component, including grade separation and railroad crossing projects, for which bond funding has been programmed or otherwise approved by the administrative agency or is otherwise targeted to be available, to apply to the administrative agency for a letter of no prejudice that makes the regional or local agency eligible to be subsequently reimbursed from bond funds for expenditures of funds under its control for the project or project component under certain conditions.

Exempts the expansion of an existing overpass, onramp, or offramp from the California Environmental Quality Act if it is built within an easement or right-of-way controlled by a state or local transportation agency, a city, or a county.

SB 1215 (Price-D) Transportation: public contracts: architectural/engineering
Authorizes the Department of Transportation (Caltrans) to establish prequalified lists of firms providing architectural and engineering services. Establishes a separate Caltrans contracting category for contracts having an estimated value of greater than $5,000, but less than $250,000 and awarded to certified small businesses, including microbusinesses and disabled veteran business enterprises. Requires Caltrans to establish evaluation criteria and advertise for firms to provide services in order to create a prequalified list of architectural and engineering firms for each category of service and for small, medium, and large projects for each of Caltrans 12 Districts. Requires the qualified list of firms to contain no less than three firms and that the firms be ranked and the list be maintained for no less than two years.

SB 1348 (Steinberg-D) California Transportation Commission: guidelines
Provides, notwithstanding any other provision, in instances where the California Transportation Commission (CTC) adopts guidelines, the guidelines will be exempt from the Administrative Procedure Act. Sets forth a process governing CTC's adoption of guidelines after 1/1/11, except for guidelines adopted to implement the State Transportation Improvement Program. Requires CTC to maintain complete files on guideline adoption proceedings, including a summary of each objection or recommendation made and an explanation of how the proposed guidelines were changed to accommodate each objection or recommendation, or the reason no change was made.

Allows a fee increase of up to $4 annually on vehicle registration to fund regional planning activities by councils of governments, metropolitan planning organizations and other specified local planning entities subject to approval by voters, and adds additional members to the Planning Advisory and Assistance Council.

SCA 3 (Wyland-R) Transportation Investment Fund
Deletes the provisions of law authorizing the transfer of revenues to the Transportation Investment Fund (TIF) to be suspended during a fiscal emergency, prohibits a loan of TIF revenues under any circumstances, and prohibits any statute that would reduce the extent to which these tax revenues are deposited into the General Fund for transfer to the TIF for transportation purposes.

AB 133 (Smyth-R) Major thoroughfares: funding
Allows city officials in certain situations and Los Angeles County officials to spend bridge and major thoroughfare subdivision fees on construction costs that include design, acquisition of rights-of-way, contract administration, and actual construction. Caps spending on "reasonable administrative expenses" at $300,000 a year, adjusted after 1986, for changes in the Consumer Price Index.

AB 522 (Blumenfield-D) Transportation: bond funds
Requires the California Transportation Commission to ensure that bond funds previously committed to a project from the Highway Safety, Traffic Reduction, Air Quality, and Port Security Fund of 2006 remain available to the sponsoring agency of the project for another qualifying project, if funds from any federal economic recovery legislation enacted in 2009 are used to fund the project, as specified.

AB 949 (Logue-R) Transportation: State-Local Partnership Program
Adds mineral or resource extraction fees or taxes to the list of local matching fund sources eligible for the 95%-portion of the State Local Partnership Program (SLPP) that is to be distributed by formula to self-help counties. Strikes the requirement that developer fees must be uniform to be eligible as local matching funds for the 5%-portion of the SLPP that is to be competitively distributed, and provides that, in addition to developer fees and mineral or resource extraction fees, eligible local matching funds can include a local or regional tax or fee, including a fee or tax imposed within a county or any part thereof, by voter approval or by action of the board of supervisors.

AB 1030 (Blumenfield-D) Department of Transportation: energy development
Authorizes the Institute of the Environment at the University of California, Los Angeles to map the renewable energy development potential of property owned or controlled by the Department of Transportation (Caltrans), upon receipt of funding for the project, and requires Caltrans to cooperate with the Institute on the mapping project and respond to proposals to develop renewable energy facilities on Caltrans property within 90 days.

AB 1760 (Blumenfield-D) Transportation: design-sequencing contracts
Authorizes the Department of Transportation (Caltrans) to use the design-sequencing method of contracting until 1/1/14, on not more than five transportation projects. Requires Caltrans to compile data for each project including the stage of completion, district, cost, description, status, estimated time to complete the project, and, as appropriate, actual time to complete the project, and add the data as an attachment to any annual status reporting performed by Caltrans. Allows Caltrans to utilize design-sequencing authority only on projects that are deemed to have a high probability of success as determined by the "Design-Sequencing Project Selection Criteria" as contained in the "Design-Sequencing Nomination Fact Sheet."

Authorizes the Riverside County Transportation Commission to award a design-build contract for design and construction of the State Highway Route 91 Corridor Improvements Project. Provides that the Department of Transportation (Caltrans) will be responsible for construction inspection services on the project, including specific tasks, such as materials testing, surveying, and quality control inspection. Prescribes a direct reporting relationship between project inspectors and responsible senior Caltrans engineers, and explicitly states that senior Caltrans engineers are responsible for acceptance or rejection of work on the project.

Authorizes a regional or local agency that is a lead agency for a project to be funded under the Clean Air and Transportation Improvement Act of 1990 to apply to the administrative agency for a letter of no prejudice that permits the applicant to spend its own resources on the project and then to be reimbursed at a later date when bond funds become available, subject to various requirements and conditions.

AB 2620 (Eng-D) Department of Transportation: capital outlay support service
Requires a public agency or a private entity to reimburse the Department of Transportation (Caltrans) for staff salaries and benefits for staff needed to perform capital outlay support services, as well as for the cost of administration directly related to the function, such as space, equipment, and required materials. Denies Caltrans reimbursement for indirect overhead costs unless the cost can be attributed solely to the capital outlay support functions and would not exist if Caltrans did not perform that function. Requires an agency or an entity to reimburse Caltrans when Caltrans uses a contractor to provides capital outlay support services for the cost of the contractor plus costs directly associated with the contracted function, including but not limited to, advertising and awarding the service contract, inspection, supervision, and monitoring of the contractor.

Allows the Los Angeles County Metropolitan Transportation Authority to let a contract to the lowest responsible bidder when the purchase price of the construction of all facilities exceeds $100,000, rather than $25,000, and authorizes the Authority to award individual contracts, not exceeding $8 million per year, providing for the issuance of job orders for construction work with compensation for the work based on unit prices, and defines "job order" and "unit price" for these purposes.

Requires the State Controller, if a specified portion of the Highway Users Tax Account is transferred to the Transportation Debt Service Fund, to make certain calculations regarding the amount of funding that has been transferred to the Transportation Debt Service Fund. Appropriates, commencing in the 2011-12 fiscal year, and in each fiscal year thereafter, for a total of 10 years, a certain amount of revenues from the General Fund, which would be required to be apportioned to local agencies in a manner that fully restores the funds transferred to the Transportation Debt Service Fund.

The study must include certain matters, as specified.

SB 385 (Wright-D) Vehicle emission: historic motor vehicles: preservation
Exempts vehicles from the smog check program provided the vehicle has a historic license plate, the registered owner of the vehicle owns two or more currently registered vehicles that are not registered as historic vehicles, the registered owner of the vehicle signs a statement under penalty of perjury that the vehicle will be used principally for the purpose of exhibition and historic vehicle club activities, and the vehicle has not been driven more than an average of 150 miles per month during the previous two-year cycle minus any mileage accrued from driving to and from events sponsored by charitable organizations, provided the mileage is documented by a receipt issued by the organization in accordance with Internal Revenue Service regulations.

SB 462* (Strickland-R) Manufacturers of diesel exhaust filters
Authorizes a $10,000 credit for a manufacturer of "Verified Diesel Emission Control Strategies" (VDECS), defined as emissions control strategies designed primarily for the reduction of diesel particulate emission and are either approved or pending approval by the Air Resources Board (ARB). The taxpaying manufacturer must obtain a certification from ARB that it makes approved VDECS, and provides the certification to the Franchise Tax Board upon request. The credit may be carried over to subsequent taxable years.

SB 464* (Strickland-R) Diesel particulate matter reduction
Enacts a tax credit equal to 5% of the amount paid or incurred to purchase qualified property used to meet the Air Resources Board (ARB) off-road diesel equipment regulations, not to exceed $10,000. The taxpayer must obtain and retain a letter from ARB certifying that the qualified property assists in meeting the regulations, and provide that letter to the Franchise Tax Board upon request. The tax credit may be carried over to subsequent years, but sunsets on 1/1/19.

Prohibits the Air Resources Board from requiring a gasoline dispensing facility that does not meet certain requirements from undergoing an Enhanced Vapor Recovery Phase II upgrade until 4/1/10.

SB 960 (Dutton-R) Air Resources Board: Office of Administrative Law
Requires the Air Resources Board (ARB) to submit any major regulation to the Office of Administrative Law (OAL) immediately upon completion of ARB's economic analysis. ARB must submit with the regulation all background information used in conducting the economic analysis and information on a specified form. Requires OAL to submit an analysis to ARB and the Legislature within 90 days of receiving the regulation from ARB. Defines "major regulation" to be any proposed adoption, amendment, or repeal of a regulation having a total cost of $10 million or more on state government, business enterprises, or citizens, as estimated by ARB.

SB 1033 (Wright-D) California Global Warming Solutions Act of 2006: allowances
Requires the Air Resources Board, if market-based compliance mechanisms are adopted that include the distribution of allowances, which are defined under existing law as authorizations to emit greenhouse gas emissions, to sell or otherwise distribute an allowance only to a regulated entity, subject to the greenhouse gas emissions limit to which that allowance applies. Authorizes a regulated entity to sell or trade an allowance only to another regulated entity.

SB 1114 (Florez-D) Emission reduction credits: private and public moneys
Authorizes air quality management districts and air pollution control districts to create an emission reduction credit from a marine vessel or locomotive emission reduction project that is funded by both public and private moneys. An emission reduction credit created pursuant to this provision would be created only for the percentage of the emission reduction project that is paid for by private moneys. Provides that the state share of the credit would be 80%, and the State Treasurer would be required to sell this ownership share, and deposit the proceeds into the Emission Reduction Credit Sales Fund, which the bill creates.

SB 1120 (Dutton-R) Global Warming Solutions Act: market-based compliance
Prohibits the Air Resources Board from implementing a market-based compliance mechanism that includes caps on greenhouse gas emissions and trading among participants unless it is part of a legally enforceable regional or federal program. A regional program must include participation by all of the following: Arizona, California, Montana, New Mexico, Oregon, Utah, Washington, Quebec, Ontario, Manitoba, and British Columbia.

Appropriates $20 million from the Enhanced Fleet Modernization Subaccount, in the High Polluter Removal and Repair Account, to the Air Resources Board to provide grants to owners of three or fewer heavy-duty diesel trucks that service the state's ports and railyards for the purchase of equipment that meets specified emission standards pursuant to drayage truck regulations.

SB 1305 (Pavley-D) Global Warming Solutions Act of 2006: revenue allocations
Provides that revenues generated from fees related to the Global Warming Solutions Act of 2006 fund expenditures beyond the administrative costs of implementing the Act. Revenues generated as a result of the implementation of market-based compliance mechanisms, or revenues generated from compliance mechanisms, shall be appropriated by the Legislature in furtherance of the Act for purposes determined by the Legislature.

SB 1328 (Lowenthal-D) Greenhouse gas emissions: motor vehicle cabin temperature
Requires the Air Resources Board, if adopting or amending regulations to reduce cabin temperatures in vehicles in order to reduce greenhouse gas emissions, to consider (1) potential reductions in air conditioning use that can be achieved while a motor vehicle is moving, in addition to reductions in air conditioning use when a motor vehicle is parked, (2) potential conflicts between, and relative benefits of, motor vehicle cabin temperature reduction requirements and technologies that provide motor vehicle greenhouse gas emission reductions through various means, and (3) the flexibility necessary to achieve overall maximum greenhouse gas emission reductions from motor vehicles.

Requires, as of 1/1/10, a person who sells a voluntary greenhouse gas emission offset in California to include in any marketing materials specified information, such as the geographic location of the offset project, the duration of the effect of the offset, the name of the certification body or governmental protocol under which the offset was certified, and the name of the registry with which the offset is registered. Prohibits, as of 1/1/11, any protocol, certification body, or registry from being used to support a voluntary offset marketing claim unless the protocol, certification body, or registry has first been validated by the Air Resources Board, with certain exceptions.

Requires the executive officer of the Air Resources Board to conduct three reviews of the Low Carbon Fuel Standard (LCFS) regulation. Requires the executive officer to review the LCFS regulation by January 1 of 2012, 2015 and 2018. Specifies topics to be covered by the reviews, such as (1) progress against targets, (2) necessary adjustments to the compliance schedule, (3) life-cycle assessments, (4) cost-effectiveness, and (5) the effect of the regulation on state revenues, consumers, economic growth, public health and air quality. Directs the executive officer to establish the LCFS advisory panel, consisting of specified governmental and private representatives, to participate in the periodic reviews of the LCFS regulation.

Authorizes counties to impose a vehicle license fee (VLF) upon approval of 2/3 of the board of supervisors and a majority of local voters. Specifies that the assessment rate shall be equal to the difference between the historical 2% state VLF rate and the current statewide VLF rate. This translates into a rate of .85% in 2010 (the difference between 2% and the current statewide rate of 1.15%), and 1.35% after May 2011 (when the recently enacted 0.5% increase in the statewide rate expires). The local rate could vary in future years depending on statewide rate increases. Requires any county imposing an assessment to contract with the Department of Motor Vehicles (DMV) to collect and administer the fee and to pay DMV for its initial setup and programming costs.

Requires the State of California to comply with the federal Real ID Act of 2005, a measure that establishes standards for the issuance of drivers licenses and identification cards that may be used by federal agencies for official purposes. In complying with the Real ID Act, requires the Department of Motor Vehicles to issue two types of driver's licenses and identification cards: cards that may be used for official federal purposes and cards that may be used by persons who are not able to demonstrate legal presence status.

Prohibits a repossession agency from publicly disclosing a registrant's residential address, residential telephone number, cell phone number, or driver's license. Modifies the qualified manager examination and reexamination schedule from once every other month to once every three months. Authorizes a person to work as a registrant pending the receipt of the registration card if he/she has been approved by the Bureau of Security and Investigative Services and carries on his/her person a printout of the Bureau's approval from the Bureau's Internet Web site and valid picture identification. Requires the Bureau to issue a cardholder a certified replacement card in the event of the loss or destruction of the card, provided that the cardholder states the circumstances surrounding the loss and pays a $10 certification fee.

Allows the registered owner of a specially-constructed vehicle that is currently registered or incorrectly registered to change the vehicle's registration by having it inspected by a repair station authorized to perform referee functions for the purpose of determining the engine model-year used in the vehicle or the vehicle model-year, and the appropriate emission control system application. Provides that the 750-vehicle annual registration limit described above does not apply to the renewals of the current registrations of specially-constructed vehicles.

AB 1781 (Villines-R) Neighborhood electric vehicles
Authorizes the City of Fresno, until 1/1/16, to establish a neighborhood electric vehicle (NEV) transportation plan under the same terms as the pilot projects in Lincoln and Rocklin. Permits the City to establish an NEV plan for all city streets within the City, plus Fresno County islands, which are areas of land, streets, and roads under county jurisdiction, but entirely surrounded by the city, provided that the county concurs in inclusion of any island in the city's NEV plan. Requires that the City adopt the plan by ordinance or resolution and, prior to adoption, receive comment and review on the plan from the Council of Fresno County Governments and any agency with traffic law enforcement responsibilities in the plan area. The plan must accommodate the travel of NEVs by identifying routes and providing for NEV facilities (separate lanes, trails, street crossings, parking, charging stations, etc.).

AB 1815 (Emmerson-R) Vehicles: special interest license plates: NASCAR
Allows the Bureau of Automotive Repair (BAR), on behalf of the High Polluter Repair or Removal Account, to apply to the Department of Motor Vehicles (DMV) to sponsor National Association for Stock Car Auto Racing (NASCAR) driver-specialized license plates. Requires DMV to issue, or cause to be issued, specialized plates for that program if BAR complies with all statutory requirements. Allows the NASCAR plates to bear emblems, seals, or other symbols or designs displaying themes of professional stock car auto racing, or professional stock car auto racing drivers. Prohibits DMV from establishing this program until it has received not less than 7,500 applications for NASCAR plates, with BAR collecting and holding applications for the plates and submitting them to DMV along with the necessary fees once it has received at least 7,500 applications, to DMV.

Modifies, beginning 7/1/11, provisions of state law related to traffic violator schools to reflect that the referral to a traffic violator, now a dismissal, is a de facto guilty plea and conviction and not a dismissal of the complaint. Provides, beginning 7/1/11, that Department of Motor Vehicle records related to traffic violator school conviction, normally held confidential, are not confidential if the person convicted holds a commercial license, the violation occurs in a commercial vehicle, or if a conviction would result in a violation point count of more than one point. If the conviction is kept confidential, no violation point count may be assessed. Increases the length of disqualification periods and the amount of penalties related to out-of-service convictions such that they range from 180 days to three years and from $2,500 to $5,000 for drivers, and increases the maximum penalty for employers to $25,000.

Authorizes the Governor, for purposes of managing and administering the ongoing work of the High-Speed Rail Authority in implementing the high-speed train project, to appoint up to six additional authority employees, exempt from civil service, who would serve in specified positions at the pleasure of the executive director. Requires a salary survey to be conducted to determine the maximum compensation for the executive director and additional exempt employees, and requires the salaries to be approved by the Department of Personnel Administration.

Requires a lead agency, if a proposed residential, retail, or commercial development project would preclude or substantially and directly impede the present or potential future use of lands for mineral extraction in an area that has received a specified classification by the State Geologist as containing mineral deposits of statewide or regional significance, to determine whether those impacts may have a significant effect on the environment, including, but not limited to, any significant effect on air quality.
