Allows a taxpayer, under both the personal income and corporate tax laws, to elect to pay a 2% tax on any "net capital gain" as defined under federal law. The 2% tax is in lieu of any other tax that would otherwise be imposed on the net capital gain.

Sunsets 1/1/15, and requires a COE or consortium of COEs that establishes a pilot program to submit an evaluation to the State Board of Education and the Legislature by 1/1/14, as specified.

SB 879 (Cox-R) Counties: cities: construction projects: alternative bidding
Extends the sunset for the use of design-build by counties from 1/1/11, to 7/1/14, and aligns the design-build statutes for cities and counties. Requires each county that uses the design-build method on a public works project to submit to the Legislative Analyst's Office before 9/1/13, a report containing a description of each public works project procured through the design-build process and completed after 11/1/09, and before 8/1/13.

SB 939* (Aanestad-R) Income and corporation tax credits: Oroville enterprise zone
Allows taxpayers that derive enterprise zone hiring credits under the Personal Income Tax Law or the Corporation Tax Law to sell the credit to an unrelated party. The taxpayer must report the sale to the Franchise Tax Board (FTB) with all required information regarding the purchase and sale of the credit, including the social security number or other taxpayer identification number of the unrelated party acquiring the credit, and the sale price or other consideration received for the credit. Taxpayers may only sell the credit once, and cannot claim on its return any sold tax credit. Should the taxpayer generating the credit and the firm acquiring the credit both claim the same credit, FTB may disallow the credit of either taxpayer, but only if the statute of limitations still apply, which is generally four years.

SB 954 (Harman-R) Jobs Protection Act: legislative oversight
Enacts the Jobs Protection Act. Renames the Joint Committee on Boards, Commissions, and Consumer Protection as the Joint Committee on Boards, Commissions, and Consumer or Business Protection, and creates a new legislative procedure with regard to any bill, as defined, that may have a statewide economic impact affecting business. Requires the Assembly Rules Committee and the Senate Rules Committee to refer any bill that may have a statewide economic impact affecting business, as specified, to the Joint Committee for the preparation of an economic impact analysis and a hearing and approval.

Allows, under both the Personal Income Tax Law and Corporation Tax Law, for taxable years beginning on and after 1/1/10, a credit in an amount equal to 25% of the wages, not exceeding $6,000, paid to each "qualified veteran", as defined, by the taxpayer during the taxable year.

SB 1073* (Ashburn-R) Income taxes: renewable energy
Increases the percentage of increased qualified research expenses included in the research credit from 15 percent to 20 percent for "green technology and renewable energy research and development", as defined, beginning 1/1/10. Provides that this increased credit is allowed only against the taxes imposed for tax years beginning on or after 1/1/14. This means that taxpayers can earn this credit starting in the 2010 tax year, but cannot claim the credit until tax years starting in 2014.

SB 1074* (Ashburn-R) Manufacturer's investment credit: qualified renewable energy
Allows a credit of 6% of the qualified cost paid by a qualified taxpayer for qualified property placed in service in California, beginning 1/1/10. The language for the proposed credit is substantially similar to the prior Manufacturer's investment credit law. Specifies that any credit allowable for the taxpayer's taxable years beginning on or after 1/1/10, and before 1/1/14, shall be allowed as a credit against the "net tax" for the taxpayer's first taxable year beginning on or after 1/1/14.

SB 1084 (Liu-D) California Economic Security Task Force
Creates an Economic Security Task Force (Task Force) and requires it to develop recommendations for reducing poverty and increasing economic security among Californians. Requires the Task Force to submit to the Governor and the Legislature an interim report by 4/1/12, and a final report by 4/1/13. Requires the report to include a detailed review of current rates of economic security for each county in California and that it include recommendations that could be implemented beginning in 2012, to maximize the effectiveness of state programs and services in order to move 50% of California with incomes below the federal poverty level toward or above the California Family or Elder Economic Security Standard Index thresholds by 2020.

SB 1239* (Wyland-R) Income and corporation taxes: sales and use taxes
Provides, beginning 1/1/11, a state sales and use tax exemption for purchases of qualifying tangible personal property by persons engaged in "manufacturing", as defined. Increases, under the Personal Income Tax Law and the Corporation Tax Law, for taxable years beginning on or after 1/1/10, the credit for increasing qualified research expenses from 15% to 20%, and increase the state's Alternative Incremental Research Credit percentages to equal the federal percentages in effect on 1/1/05. Thus, the former federal percentages of 2.65%, 3.20%, and 3.75%, would apply for state purposes. Enacts a new tax credit for taxpayers for hiring a qualified employee beginning in the 2010 tax year. Taxpayers inside or outside a geographically targeted economic development area may claim the credit.

Creates the Economic Development and Job Creation Agency (Agency) in state government, and provides for the appointment of the Secretary of Economic Development and Job Creation who would serve as executive officer. Requires the Labor and Workforce Development Agency, by 7/1/10, to establish standardized courses of study covering components necessary to effectively and safely install, inspect, or repair clean energy systems, and to train others to do so, direct the Division of Apprenticeship Standards to convene the Electrical Industry Training Committee to develop a model solar curriculum, and create a program of outreach and assistance on creating clean energy training programs to schools, using the Division, the Employment Training Panel, and the California Workforce Investment Board.

Provides that no exemption shall be allowed unless the purchaser furnishes the retailer with an exemption certificate, completed in accordance with any instruction or regulation issued by the Board of Equalization (BOE), and the retailer subsequently furnishes BOE with a copy. The exemption certificate shall contain the purchase price of the exempt machinery or equipment.

AB 970 (Block-D) Economic development: local government
Establishes the University Park and Research Center Educational and Technological Tax Credit Program. Under that program, a taxpayer would be granted a credit, as specified, for a period of no more than seven years, against the taxpayer's state corporation tax or state personal income tax liability, on the amount invested in businesses or educational institutions within, or with the intent to locate within, the University Park and Research Center, during the taxable year. Establishes the University Park and Research Educational and Technological Fund (Fund), authorizes the City of Chula Vista to collect private moneys for deposit in the Fund and allocates any moneys in the Fund to make loans to, or donations for, businesses or educational institutions within, or with the intent to locate within, the University Park and Research Center.

Requires that approximately 16% of revenues attributable to General Fund sales and use taxes currently derived from certain art-related sales be diverted to a newly created special fund, the Creative Industries and Community Economic Revitalization Fund (Fund). Specifies that revenues received by the Fund can, upon annual appropriation by the Legislature, be allocated by the California Arts Council for purposes specified in current law, such as encouraging art awareness, promoting the employment of artists, providing for the exhibition of art works in public buildings, and awarding prizes or direct grants to individuals or organizations.

Exempts specified territory in a redevelopment project area within Fort Ord from the state law that prohibits redevelopment officials from providing direct assistance to the development of five acres or more which had not been developed for urban uses and which will generate sales tax revenues. For territory to qualify, the Fort Ord Reuse Authority's Final Base Reuse Plan, as the plan existed on 1/1/10, must designate the territory as either (1) a planned development mixed-use district, (2) a business park with light industrial, office, and research and development mixed uses, or (3) as regional retail space.

Requires the California Environmental Protection Agency, the Division of Occupational Safety and Health, and the Air Resources Board to complete an economic impact analysis prior to adopting, amending, or repealing an administrative regulation. Requires the analysis to include (1) the projected cost of the action to the General Fund, (2) the projected total economic impact of the action, including the cost to small business and the estimated number of jobs to be lost as a result of the action, (3) a description of all feasible regulatory alternatives and a cost-benefit analysis of each alternative, and (4) a summary of the written criticisms of the proposed action received a reasonable time prior to the publication of the written analysis, including letters, memoranda, reports, and written allegations, of which the agency has knowledge, that the action is discriminatory, unfair, unclear, inconsistent with statue, or beyond their authority to enact.

Provides, for the purposes of determining job placement rates for an occupation or job for which the Division of Apprenticeship Standards (DAS) has approved a certified apprenticeship program, that "graduates employed in the field" shall mean "graduates who are gainfully employed for not less than 60 days within six months of graduation in a position with job duties meeting all of the criteria of the apprenticeable occupation or job set forth by DAS." Requires a remedy that could have been ordered to redress a violation of the former Private Postsecondary and Vocational Education Reform Act of 1989 to remain available for certain actions that were commenced after 6/30/07, and before 1/1/10.

Makes both credits subject to the Legislature approving a cap by 1/1/12, and provides that if the cumulative value of the credits greater than the cap, FTB shall reduce them proportionally.

Requires the suspension of any license that, after 1/1/11, is active and has had the C-39 roofing classification removed, if the licensee is found by the registrar of contractors to have employees and to lack a valid Certificate of Workers' Compensation Insurance or Certification of Self-Insurance. Requires the report given annually to the Insurance Commissioner regarding statistical data on those holding C-39 licenses, as reported by the appropriate state entity, be given to the Legislature, as specified.

AB 1320 (Fong-D) Workforce development: Lifelong Learning Accounts Initiative
Creates, 1/1/12, a Lifelong Learning Accounts Initiative Program for the purpose of providing grants to employers and employees to be used to establish individual lifelong learning accounts for the deposit to be used by those employees and employers for the purposes related to lifelong education and training. Requires the Employment Development Department to establish a grant program and report on the effectiveness of the program. Provides that the program shall only be implemented if the Director of the Department of Finance makes a written determination that there are sufficient funds from non General Fund sources available for the purposes of the bill.

Limits the number of Program unemployment insurance beneficiaries to 5% of the total statewide unemployment insurance beneficiaries.

Enacts the Debt Settlement Service Act for the purpose of licensing debt settlement service providers. Exempts a person or entity licensed as a debt settlement services provider from the Check Sellers, Bill Payers, and Proraters Law, as specified, provides specific requirements that a provider must comply with in offering debt settlement services, including the preparation of a written financial analysis, and a good faith estimate on the length of time it will take to complete the program, prior to entering into an agreement with a consumer, and provides that an agreement is void if the provider is not licensed by the Act.

AB 365 (Ammiano-D) Consumer Overdraft Protection Fair Practices Act
Prohibits a financial institution, defined as a state and federally regulated bank or credit union, from imposing a "protection fee", as defined, when covering the payment on a transaction for which there are insufficient funds in a customer's account unless specified conditions are satisfied, including that the customer has provided specific written consent to an overdraft protection program or service that provides for the imposition of an overdraft protection fee.

Increases the maximum value of a payday loan from $300 to $500 and permits a payday loan customer to rescind the transaction no later than the end of the next business day. Requires payday loan lenders to pay a five-cent fee for each payday loan transaction to the Department of Corporations to be used for financial literacy education programs.

SB 374 (Calderon-D) Personal trainers
Establishes educational and training requirements for personal trainers and after 1/1/12, prohibits a person from calling themselves a "personal trainer" unless they meet the requirements. Exempts individuals who only provide training in a particular discipline such as yoga or pilates, and establishes administrative fines for violations of these provisions.

SB 392 (Florez-D) Contractors: limited liability companies
Allows a limited liability company (LLC) to render contractors services that are "professional services" otherwise prohibited by the Beverly-Killea Limited Liability Company, by authorizing the issuance of a contractor's license to the company under the Business and Professions Code. Provides that a contractor-LLC obtain and maintain a $1 million insurance policy or place on deposit or escrow $1 million plus an additional $100,000 per licensee in excess of five employed by the LLC, up to $5 million in total insurance, escrow, or deposit, and provides, if the LLC is suspended, each member of the LLC who is licensed as a contractor will be liable for up to $1 million in damages occurring as a result of the licensed activities of the LLC during the suspension.

AB 2321 (Nava-D) Political Reform Act of 1974: corporations
Requires a corporation that makes a contribution or expenditure for a "political activity" in the State of California, as defined, to prepare a report within 30 days after the close of the corporation's fiscal year containing specified information regarding all contributions or expenditures made by the corporation for political activities in the State of California during that fiscal year. Requires the corporation to maintain records of those contributions or expenditures, including the report described above, for a period of not less than five years, and to file a copy of the report with the Fair Political Practices Commission upon request of the Commission. Gives shareholders of a corporation the right to file a notice of objection to the corporation's use of the shareholder's invested funds for political activities in the State of California and requires the corporation, if a shareholder so objects, to return to the shareholder as a dividend his/her pro rata share of the funds expended for political activities.

AB 2627 (Nielsen-R) General contractors: participation goals
Expands the Business Utilization Plan to allow general contractors an alternative means of receiving disabled veteran business enterprise (DVBE) participation credit on their state contract solicitations. Allows the use of the DVBE bidding incentive to those general contractors that have an approved Business Utilization Plan. However, the use of a Business Utilization Plan does not apply towards a department's totals in meeting its required 3% DVBE participation goals which means state departments will need to offer additional incentives to achieve DVBE participation goals.

AB 2640* (Arambula-IN) Income taxes: credits: sales tax on qualified property
Repeals the exclusion for employer-provided subsidies for parking at or near the job site or van-pool site. Allows a personal income tax and corporation tax credit for equipment and other qualifying property purchased by manufacturers for use in California. Provides that the credit is equal to the General Fund portion of the sales taxes paid on the purchase of the property (currently equal to 6% of the purchase price). Provides that the manufacturers' credit will be capped at $100 million in 2011, with the cap adjusted for inflation in succeeding years. Provides that the credit will be allocated by the Franchise Tax Board on a first-come-first-served basis. Under this system, the business would apply for credit reservations, and those applying after the $100 million cap is reached would be put on a waiting list to claim the credit the following year.

AB 2649 (Torrico-D) Professional or occupational licenses
Requires a "state governmental licensing entity", as defined, and excluding the Department of Motor Vehicles and the Contractor's State License Board, to provide to the Franchise Tax Board (FTB) the name and social security number or federal taxpayer identification number of each individual licensee of that entity. Requires the FTB, if a licensee fails to pay taxes for which a notice of state tax lien has been recorded, as specified, to mail a preliminary notice of suspension to the licensee. Provides that the license of a licensee who fails to satisfy the unpaid taxes by a certain date shall be automatically suspended, except as specified, and requires the FTB to provide a notice of suspension to the applicable state governmental licensing entity and to mail a notice of suspension to the licensee, and provides that the suspension be canceled upon compliance with the tax obligation.

Requires the Business, Transportation and Housing Agency to prepare a five-year Short Line Commercial Rail Haul Connectivity Plan for the state, the focus of which would be to identify, with a statewide emphasis, opportunities for short line commercial rail system improvements and linkages. Requires the plan (1) to include desirable linkages and feeder opportunities between short line commercial rail services, and to identify the coordination in planning and the capital investments necessary in that regard, (2) to identify future right-of-way needs of short line commercial rail lines in connection with state and local highway system improvements in order to accommodate future rail system improvements, and (3) to be developed in consultation with the agencies and entities responsible for the various rail and highway systems.

AB 2659 (Tran-R) Business licensing: Business Master License Center
Creates the Business Master License Center (BMLC) within the State and Consumer Services Agency as a one-stop system for all business licenses within the state. Establishes the BMLC's duties, which include developing and administering a computerized one-stop licensing system, identifying types of licenses appropriate for inclusion in the system, and recommending to the governor and the Legislature the elimination, consolidation, or other modification of duplicative, ineffective, or inefficient licensing or inspection requirements. Lists agencies that are required to participate in the BMLC, and permits the governor to appoint a third-party facilitator from the business community who shall report directly to, and serve at the pleasure of, the governor. Requires the third-party facilitator to provide oversight over the creation of the BMLC and the development of the system.

Prohibits the transfer of title or possession of cigarettes or tobacco products without consideration, exchange, or barter if the cigarettes or tobacco products had been purchased for resale under a license issued pursuant to the California Cigarette and Tobacco Products Licensing Act and the transfer occurs without a license or after receipt of a notice of suspension or revocation of the license.
