Urges the United States government to urge the Mexican government to accept a variety of documents as proof of a valid claim.

Requires the Office of Environmental Health Hazard Assessment to disclose ingredient information to local governments and specified health care providers in effected areas.

AB 219 (Ruskin-D) Pest control: plant quarantine inspection stations
Increases the civil penalties to every operator of a motor vehicle from $1,000 to $2,500 per violation, for not obtaining a certificate of inspection when entering the State of California with a shipment of any agricultural commodity, and makes other technical, nonsubstantive changes.

AB 443 (Galgiani-D) Apple pests: pest and disease prevention
Enacts the California Apple Pest and Disease Prevention Act of 2009 which requires the Secretary of the Department of Food and Agriculture to appoint a committee, and a scientific advisory panel, for the purpose of preventing the future introduction of identified pests and diseases related to the California apple industry; expands the California Apple Commission's authority to include regulating apple movement and treatment to control new pests and diseases; and requires the Commission to administer and fund the committee.

Requires, with respect to aerial applications of a pesticide, the observance of a safety zone of no less than 3.3 miles from the aerial application for residential areas, including known sensitive sites. AB 835 (Monning-D) Pesticides: volatile organic compound emissions
Makes legislative findings and declarations regarding fumigants and pesticides, their impacts, costs and damages, Department of Pesticide Regulation failure, the independence of the Air Resources Board (ARB), establishes a public hearing process for ARB dealing with emission data, changes the pesticide disclosure requirements and emission inventory baseline, and requires removal of reclassified products from the baseline.

AB 967 (Ma-D) Pesticides: safety: playgrounds and dog parks
Establishes the Healthy Parks Act of 2009 which prohibits the use on a playground or dog park of certain pesticides. Requires the owner or operator of a playground or dog park to maintain records of all pesticide use at the playground or dog park for a period of four years and to make the records available to the public upon request. Requires the owner or operator of a playground and dog park to post warning signs in an area of pesticide application at least 24 hours prior to application and to maintain the posting until 72 hours after the application.

SB 416 (Florez-D) Antibiotics
Allows a school district to make every effort to purchase poultry and meat products that have not been treated with non-therapeutic antibiotics. Provides that each school district that purchases poultry or meat products that have not been treated with non-therapeutic antibiotics may report annually to the Superintendent of Public Instruction (SPI). Requires the SPI to request specified information from the United States Department of Agriculture (USDA), and requires the SPI to provide the Legislature, no later than 7/1/11, with a copy of any information provided by the USDA including information relating to any lack of response to the request for information by the SPI.

SB 677 (Yee-D) Workers' compensation: exclusions: farming operations
Excludes, until 1/1/13, any person employed by his/her parent, child, spouse, or registered domestic partner in a farming operation from having to secure the payment of workers' compensation, including medical treatment for injuries incurred by their employees that arise out of, or in the course of, employment if they meet certain conditions. Requires the owner(s) of the farming operation to submit specified information when registering with the Department of Industrial Relations for the exclusion. Specifies that a violation of the conditions shall constitute good cause for the department to cancel the farming operation's registration. Limits registrations within a calendar year to no more than 3,000 and provides that registration shall be in effect for one year, except as specified.

Requires the state to achieve a 20% reduction in urban water use in California by 12/31/20 and requires agricultural water suppliers to prepare and adopt agricultural water management plans with specified components by 12/31/12, and update those plans every five years. Revises one of those conditions to alternatively require the property received in an exchange and all the proceeds from a sale to be used for the improvement, operation, and maintenance of existing or replacement land within the Chino Agricultural Preserve.

Extends the sunset date for the additional fee assessed on inedible kitchen grease transporters from 7/1/10 to 7/1/15 and extends the repeal date to 7/1/16. Authorizes the Secretary of the Department of Food and Agriculture to issue a waiver for dead animal disposal in cases of a declared state of emergency or local emergency. Authorizes the department to issue a permit to a licensed renderer, collection center, or dead animal hauler to haul the carcass to an appropriately permitted landfill in the event of a declared state of emergency or if a licensed hauler has a certification from a licensed renderer that they cannot process the dead animal.

Enacts the California Transition to Organics Act of 2009 which establishes, within the State Treasury, the Transition To Organics Fund (TTOF) to consist of monies from federal, industry and citizen sources. Expenditures of money from the TTOF shall be limited to providing financial assistance to persons who transition their uncertified farms to certified organic farms and for administrative expense. The TTOF shall be administrated by the Secretary of the Department of Food and Agriculture who shall be authorized to adopt regulations to carry out the provisions of the act.

Provides for a comprehensive plan for taking care of the Sacramento-San Joaquin Delta including the establishment of a Delta Stewardship Council and the Delta Independent Science Board. Expands the State Water Resources Control Board's collection and reporting of data concerning the delta and establishment of a Delta Watermaster. Repeals the California Bay-Delta Authority. Becomes operative if the other bills of the comprehensive water planning package are enacted -- SB 229 (Pavley-D), SB 458 (Steinberg-D and Simitian-D), AB 39 (Huffman-D), and AB 49 (Feuer-D and Huffman-D).

SB 21 (Simitian-D) Fishing gear
Requires the Department of Fish and Game and the Ocean Protection Council to reduce the impact of derelict fishing gear in state and coastal waters by collecting information on the location of the lost gear. Requires the department and the Council to recommend a fund source for future prevention and recovery activities. Requires the Council to prioritize existing derelict fishing gear for future recovery.

SB 42 (Corbett-D) Coastal resources: once-through cooling
Defines once-through cooling as a system that uses an open seawater intake to pump seawater from an ocean, estuary, or bay and then discharges the water after only one cycle of cooling. Prohibits once-through cooling for a new power plant or industrial facility that commences operation on or after 1/1/10 and requires the State Water Resources Control Board to adopt a statewide policy on once-through cooling, in consultation with the California Energy Commission, by 3/1/10. Requires state regional water boards to review and reissue National Pollutant Discharge Elimination System (NPDES) permits for power plants within six months of expiration or by 7/1/10 if that permit has already expired, and to regulate the cooling water intake of those plants according to standards of the federal Clean Water Act as it existed on October 18, 1972 and also restricts the enforcement of water discharges under the NPDES.

SB 51 (Ducheny-D) Salton Sea Restoration Council
Establishes the Salton Sea Restoration Council as a state agency in the National Resources Agency to implement certain preferred alternative activities set forth in the agency's Salton Sea Ecosystem Restoration Program to develop and implement, or finance, additional pilot or demonstration projects to improve the water quality of the Salton Sea, to restore the Salton Sea ecosystem, and to take other actions to enhance the sea. Prescribes requirements relating to the composition and administration of the Council. Requires the Council to include an executive committee, a science committee, a local government forum, and a stakeholder forum, as specified. Requires the executive committee to serve as the governing body of the Council and provide guidance and oversight on behalf of the restoration program. Requires the Department of Fish and Game to provide staff services that the Council needs to carry out its activities and to enter into interagency agreements with the Department of Water Resources and other state agencies to provide staff services.

SB 113 (Senate Local Government Committee) Water issues: Local Government Omnibus Act of 2009
Enacts the Local Government Omnibus Act of 2009, and makes 39 changes to the state laws affecting local agencies' powers and duties included therein, county waterworks districts' contracts, dredging and harbor improvements, as they relate to the Improvement Act of 1911.
