Increases the availability of various transportation funds that could be used as borrowable resources for the state's General Fund for cash flow in the 2011-12 budget year to facilitate completion of transportation projects.

SB 204 (Liu-D) Local alternative transportation improvement program

Provides for a local alternative transportation improvement program (LATIP) for the State Highway Route (SR) 710 study area in Los Angeles County. Grants the California Transportation Commission (CTC) the final authority regarding content and approval of the LATIP, so long as the content and approval are consistent with the CTC's earlier processes related to LATIPs for SR 84 and SR 238. Requires the approval to include a finding by the CTC that the plan includes feasible funding, plans, and capacity to develop and implement the LATIP and the associated relocation assistance requirements.

Permits the California Transportation Financing Authority to issue nonrefundable tax credit bonds, available to California income taxpayers, to fund the construction of local transportation projects.

SB 985* (La Malfa-R) Transportation bonds

Requires the Secretary of State to place on the November 2012 general election ballot a legislative referendum which, if approved by the voters, prohibits the sale of any additional high-speed rail bonds. Authorizes the Legislature to appropriate any outstanding net proceeds from sale of the bonds before the enactment of this bill for retiring outstanding high-speed rail bond debt.

SB 1018 (Senate Budget And Fiscal Review Committee) Transportation funds: Budget Trailer Bill

Enacts the Energy, Resources, Environmental Protection, and Agriculture 2012-13 Budget Trailer Bill which, among other provisions, provides Highway Safety, Traffic Reduction, Air Quality and Port Security Bond Act of 2006 bond funds to be transferred by 1/1/13, if a local air district's funds, including accrued interest, are not committed by an executed contract, as reported to the Air Resources Board (ARB), by 6/30/12, as provided. Requires the local air district and ARB, by 9/30/12, to establish a list of potential local air districts that can be the recipient of the transferred funds with priority given to districts with the most polluting school buses and with the greatest need for school bus funding. Requires each allocation of funding made by the ARB to a local air district to include enough funding for at least one project to be implemented pursuant to the Lower-Emission School Bus Program. Requires all funds allocated by ARB to a local air district to be expended by 6/30/14, and requires all funds not expended by that date to be returned to ARB.

SB 1102 (DeSaulnier-D) State transportation improvement program

Requires the California Transportation Commission (CTC), beginning 1/1/13, to allocate construction support funding for each project in the State Transportation Improvement Program overseen by the Department of Transportation (Caltrans) at the time it allocates construction capital funding. Requires the CTC to review and approve a supplemental project allocation request for a project that experiences a construction support cost overrun of 20% or more. Requires Caltrans, no later than 11/15/14, and annually thereafter, to report to the Legislature on the difference between construction costs allocated on each project and the actual costs after the project has been completed.

SB 1117 (DeSaulnier-D) Passenger rail planning

Designates the Department of Transportation as the state rail transportation authority to prepare, maintain, coordinate, and administer the State Rail Plan, modifies the requirements of the State Rail Plan, and requires the California Transportation Commission to include in its guidelines for regional transportation plans policy direction regarding the integration of all passenger rail services into a coordinated system with emphasis on intermodal facilities and cost-effective rail services, as specified.

SB 1225 (Padilla-D) Intercity rail agreements

Authorizes the Department of Transportation to enter into a transfer of services agreement with the Los Angeles-San Diego Corridor Agency for the provision of intercity passenger rail service in the corridor. Establishes a uniform framework for negotiating interagency transfer agreements applicable to all state-supported intercity rail programs.

SB 1499 (Anderson-R) California Transportation Commission: review of expenditures

Requires the California Transportation Commission (CTC) to allocate funds for construction support costs for a project in the state transportation improvement program at the time of allocation of funds for construction capital costs. Requires a supplemental project allocation request to be made for all state transportation improvement program projects that experience construction support costs equal to or more than 120% of the amount originally allocated. Requires the Department of Transportation, as part of the annual project delivery report, to report on the difference between the original allocation made by the CTC and the actual construction support costs at project close for each state transportation improvement program project completed during the previous fiscal year.

SB 1549 (Vargas-D) Transportation projects: alternative project delivery method

Authorizes the San Diego Association of Governments (SANDAG) to use alternative contracting methods for public transit projects. Authorizes SANDAG to use one of two alternative contracting methods, each consisting of specified procedures, and referred to respectively as "design-sequencing," whereby each phase of a project can commence construction when the design of that phase is complete, and "construction manager/general contractor", whereby a construction manager is procured to provide preconstruction services during a project's design phase and construction services during the construction phase. Requires SANDAG, in order to use an alternative project delivery method, to make a written finding that its use in lieu of the traditional design-bid-build contracting method will reduce project costs, expedite completion, or provide other benefits otherwise not achievable.

AB 294 (Portantino-D) Transportation projects: procurement

Reenacts authorization, until 1/1/17, for the Department of Transportation (Caltrans) to enter into design-sequencing contracts, under certain conditions. Clarifies that Caltrans employees or its consultants are to perform specific tasks associated with design-sequencing, design-build, or public-private partnership contracts for projects on the state highway system.

AB 1458 (Buchanan-D) California Transportation Commission

Provides that notwithstanding the Governors Reorganization Plan No. 2 of 2012 (GRP 2), the California Transportation Commission (CTC) shall retain independent authority to perform its duties as prescribed under law. Makes it explicit that the CTC will retain its independent authority to perform its duties as prescribed under law regardless of the fact that the GRP 2 places the CTC in the Transportation Agency under the authority of the Transportation Secretary; provides that this bill shall become operative on 7/1/13 and only if the GRP 2 becomes effective; and stipulates that this bill prevails over any provision of the GRP 2, regardless of the dates on which this bill and the GRP 2 take effect.

AB 1465 (Assembly Budget Committee) Transportation: Budget Trailer Bill

Transfers funding from the Motor Vehicle Fuel Account to the General Fund for three years and then at that time these funds will be transferred to the Highway Users Tax Account. Transfers additional weight fee revenues to the General Fund. Facilitates a $432.2 million loan to the General Fund from the motor Vehicle Account. Allows the Department of Transportation (Caltrans) to post advertising projects on Caltrans Web site in lieu of trade publications and newspapers.

AB 1600 (Torres-D) Metro Gold Line Foothill Extension Construction Authority

Authorizes the Metro Gold Line Foothill Extension Construction Authority (Authority) to plan, design, and build an extension of the Gold Line from the City of Claremont to the City of Montclair. Authorizes the San Bernardino Associated Governments (SANBAG) to appoint one nonvoting member to the governing board. Authorizes the Metropolitan Transportation Authority (MTA) to operate each phase of the Gold Line light rail beyond its current terminus in east Pasadena to Azusa and Claremont. Authorizes MTA to operate the Gold Line light rail trains outside of Los Angeles County, which is its area of jurisdiction, to Montclair in San Bernardino County. Prohibits MTA from operating on right-of-way owned by SANBAG without a construction and maintenance agreement between MTA, SANBAG, and the Authority. Clarifies that the Authority may accept grants, fees, allocations, and transfer of funds from federal, state, and local agencies.

AB 1779 (Galgiani-D) Intercity rail agreements

Authorizes the Department of Transportation (Caltrans), with approval of the Secretary of the Business, Transportation and Housing Agency, to enter into interagency transfer agreements for additional intercity rail corridors, to be entered into between 6/30/14, and 6/30/15, and authorizes Caltrans to enter into a transfer of services agreement with a Joint Powers Authority to administer the state-contracted Amtrak service operating between the San Joaquin Valley, the San Francisco Bay Area, and Sacramento.

AB 1780 (Bonilla-D) Department of Transportation: project studies reports

Requires the Department of Transportation (Caltrans) to pay for costs related to the review and approval of specified project initiation documents (PIDs) prepared by other entities for projects that are on the state highway system and in an adopted regional transportation plan, a voter-approved sales tax measure expenditure plan, or other voter-approved transportation program. Provides Caltrans costs to review and approve PIDs for projects that aren't included in one of these plans be paid by the entity that prepared the documents.

Authorizes the Department of Transportation (Caltrans) to use an alternative procurement method referred to as Construction Manager/General Contractor (CM/GC) for up to six projects. Defines a CM/GC method of procurement as one in which Caltrans selects the construction manager to provide preconstruction services during the design phase of a project, plus actual construction services when the project is being built.

SB 234 (Hancock-D) Goods Movement Emission Reduction Program

Requires the Air Resources Board to disperse eligible funds from the Highway Safety, Traffic Reduction, Air Quality, and Port Security Bond Act of 2006, for projects that provide shorepower for vessels, to applicants on a quarterly basis, and also authorizes the Board to withhold 10% of reimbursable costs until the project demonstrates its ability to power a vessel at berth.

SB 357 (Dutton-R) Air Resources Board: regulations: obsolete equipment

Requires the Air Resources Board (ARB) to estimate the cost or savings to the state in revenues that are lost or gained as a result of a regulation adopted or amended by the ARB imposing requirements relating to diesel-fueled heavy-duty on-road or off-road motor vehicles that would make equipment obsolete, where that equipment would otherwise have a remaining depreciable life. Requires the Franchise Tax Board to provide to the ARB, and update every five years, the average tax rate to be applied to the amount of the estimated accelerated deduction due to reduced asset life attributable to the regulation for an increase in business depreciation.

SB 535 (De León-D) Greenhouse gas emissions

Requires the investment plan related to the Greenhouse Gas Reduction Fund that is developed and submitted to the Legislature pursuant to AB 1532 (J. Perez-D) to allocate (1) a minimum of 25% of the available monies in the Fund to projects that provide benefits to identified disadvantaged communities, and (2) a minimum of 10% of the available monies in the Fund to projects located within identified disadvantaged communities. Contingent on the enactment of AB 1532.

SB 800 (Hancock-D) Voluntary Greenhouse Gas Emission Offset Program Fund

Creates the Voluntary Greenhouse Gas Emission Offset Program Fund, and provides that funds received by the state on a voluntary basis from the federal government, individuals, businesses, organizations, industry, or other sources for the mitigation of climate change impacts related to greenhouse gas emissions be deposited in this fund. The monies in the fund will be available, upon appropriation, for expenditure by the Natural Resources Agency for specified projects through a competitive grant process.

SB 1076 (Emmerson-R) Vehicle emission: tire inflation regulation

Requires Automotive Service Providers (ASPs) to use tire pressure gauges that are accurate within a range of plus or minus two pounds per square inch of pressure. Establishes that an ASP is not required to check and inflate a vehicle's tire if the tire is determined to be an unsafe tire. Defines "unsafe tire" to mean any tire considered unsafe in accordance with standard industry practices due to tire tread wear, tread irregularity, or damage. Provides examples that include any tire with an exposed ply or cord, a sidewall crack, a bulge, a knot, or a ply separation.

SB 1455 (Kehoe-D) Alternative and vehicle technologies: funding programs

Extends, until 12/1/23, various fees and surcharges related to the clean air, fuel, tire recycling, and vehicle programs of the Air Resources Board (ARB), the California Energy Commission (CEC), the Department of Resources Recycling and Recovery, and the State Bureau of Automotive Repair. Prohibits ARB from moving forward with implementation of the Clean Fuels Outlet regulation, and instead directs funds from the Alternative and Renewable Fuel and Vehicle Technology Fund for the construction and operation of a hydrogen fueling network in California. Requires CEC and ARB to report on the status of the state's alternative transportation fuel use in the Integrated Energy Policy Report.

Clarifies that gasoline used to make blended fuels (e.g., E85, which is 85% ethanol blended with 15% gasoline) is exempt from California's motor vehicle fuel tax provided it is taxed under the use fuel tax law.

Requires that any rule or regulation applying to owners or drivers of heavy-duty tractors or the 53-foot or longer trailers they pull pursuant to the California Global Warming Solutions Act of 2006 to include exemptions for a tractor-trailer combination that travels within 100 air miles of the tractor-trailer's base, and that returns to its base within 48 hours of traveling outside of the 100-air-mile radius.

Requires the Air Resources Board (ARB) to report to the Legislature by 7/31/11, on the readiness of its proposed cap-and-trade program to begin 1/1/12. Authorizes ARB to delay cap-and-trade implementation up to one year. Requires ARB to report annually on the status of the cap-and-trade program until 2016.

AB 344* (Mendoza-D) Vehicular air pollution: exemption: low-use vehicles

Requires the Air Resources Board, for purposes of specified provisions relating to mobile source emissions reductions, as applied to the reduction of emissions of diesel particulate matter, oxides of nitrogen, and other criteria pollutants from certain in-use, diesel-fueled vehicles, to define "low-use vehicle" for purposes of tax-exempt nonprofit organizations as a vehicle that will be operated fewer than 5,000 miles in the state in any compliance year, as specified.

Requires the Air Resources Board to amend regulations, which require vessel fleets to either reduce onboard power generation to specified levels or achieve equivalent emission reductions, to ensure that a person choosing the equivalent emission reduction compliance option is not subject to more stringent requirements than a person choosing the reduced onboard power generation option.

AB 1064 (Furutani-D) Air quality ports

Makes certain prohibitions in the Highway Safety, Traffic Reduction, Air Quality, and Port Security Bond Act of 2006, inapplicable for a shoreside electrical power infrastructure project that is administered by a California port, and instead requires that the individual segments of these projects be a part of an adopted terminal plan submitted to the Air Resources Board. Authorizes the Board, for a specified purpose, to allow a recipient agency for shoreside electrical power infrastructure to average vessel calls made across multiple berths within a terminal.

AB 1180 (Bradford-D) Greenhouse gas emissions

Requires any offset protocol adopted as part of a cap-and-trade program for reducing greenhouse gas (GHG) emissions to target high warming potential gases, be approved by a third-party registry, be monitored for GHG reductions in real-time, and be capable of providing at least one million tons of carbon dioxide equivalent GHG reductions each year.

AB 1256 (Bill Berryhill-R) Air Resources Board: transported air pollutants

Requires the Air Resources Board to identify each air basin, or subregion of an air basin, in which transported air pollutants from upwind areas outside the air basin, or subregion of an air basin, cause or contribute to a violation of a state or federal ambient air quality standard in a downwind district, and to identify the district of origin of the transported air pollutants.

Requires more valuable rebates to be offered for zero-emission vehicles (ZEVs) manufactured by a California manufacturer. Requires rebate amounts for ZEVs manufactured by a California manufacturer, awarded as part of the state's Clean Vehicle Rebate Project and the Hybrid Truck and Bus Voucher Incentive Project, to be 20% greater than rebates for other ZEVs.

Directs the Air Resources Board, in coordination with the Strategic Growth Council and other state agencies, as needed, to establish a program of local assistance grants to develop and implement multibenefit GHG emission reduction projects in California. Charges the Strategic Growth Council with implementing the local assistance grant program by awarding grants on a competitive basis, according to potential GHG reduction and other locally beneficial criteria. Makes eligible to receive local assistance grants any county, or combination of counties, that adopts a local GHG emission reduction plan certified by the Board, and that enters into a memorandum of understanding with cities in its jurisdiction as well as any state conservancies, metropolitan planning organizations, regional climate protection authorities, special districts, air pollution control and air quality management districts, or joint powers authorities that many choose to participate.

SB 1174 (Walters-R) Highways: vehicles: length limitations: motorsports

Authorizes the Department of Transportation (Caltrans) and local authorities to permit a combination of vehicles consisting of a truck tractor-semitrailer with a length of not more than 56 feet as long as the vehicle combination is used primarily in connection with motorsports. Authorizes Caltrans, in consultation with the California Highway Patrol (CHP), to designate specific routes where the 56 foot motorsport vehicle combinations can travel. Requires Caltrans to conduct a field test of the 56 foot motorsport vehicle combinations to evaluate their performance on various segments of the National Network and transition routes. Requires that Caltrans, in consultation with CHP, submit the results of the field test along with a recommendation on whether or not the 56 foot motorsport vehicle combinations should be reauthorized to the Legislature on or before 1/1/14.

SB 1269* (Fuller-R) Highway maintenance and enhancement

Allows a maintenance and roadside enhancement credit against the personal income tax equal to 50% of the qualified amount for each taxable year beginning on or after 1/1/13, and before 1/1/17. "Qualified amount" means both the amount the taxpayer paid or incurred, and the value of materials, equipment, and services the taxpayer donated, for maintenance or roadside enhancement of a section of highway during the taxable year. The value of materials and equipment means the deductible amount allowed under federal law relating to charitable contributions. The value of services donated is less than or equal to the hourly rate of labor determined by the Department of Transportation for maintenance and roadside enhancement. Services donated do not include services for which the taxpayer received compensation.

Requires the Metropolitan Transportation Commission (MTC) to bring an action to determine the validity of its recent office building purchase, under certain conditions. Requires the validation action to determine whether MTC had statutory authority to purchase the office building, and whether the purchase of the office building was a proper use of toll revenues. Prohibits toll money from being used for the validation action. Prohibits MTC from entering into any additional contracts with respect to the office building until the validation action is complete. Randy Sanchez, a native of New Jersey, worked for several years for the Department of Transportation and was project manager. On 9/21/04, a motorist ran a red light, and struck and killed Mr. Sanchez while he was riding his motorcycle to work. Mr. Sanchez is survived by his wife Annette and two children, Ryan and Nicole. John Burton served at various times in the California State Assembly, U.S. Congress, and California State Senate, between 1965 and 2004. From 1998 through 2004, he was the President pro Tempore of the State Senate. He also served on two separate occasions as chair of the California Democratic Party. He founded and chairs the John Burton Foundation for Children Without Homes.

In 2004, Cox won election to the California State Senate, where he represented the first district until his death in 2010. He is survived by his wife, Maggie, and their daughters Cathleen, Margo, and Sarah, as well as six grandchildren.

The five members of the HSRA appointed by the Governor would be subject to Senate confirmation, but existing members could continue to serve the remainder of their terms. Authorizes the HSRA to appoint an executive director, and provides for the Governor to appoint up to six additional individuals exempt from civil service as HSRA staff. Requires the HSRA to adopt policies directing the development and implementation of high-speed rail, prepare and adopt a business plan and high-speed train capital program, establish a peer review group, select alignments for the routes of the high-speed train system established by law, adopt criteria for the award of franchises, and set fares or establish guidelines for the setting of fares.

Adds aerodynamic devices to the list of equipment that may project three inches (on each side) beyond the maximum allowable outside width of a vehicle or its load as long as the devices does not adversely impact the vehicle's swept width and turning characteristics and its primary purpose is not for advertising. Defines "aerodynamic devices" as devices that minimize drag and improve airflow over and around a vehicle.

States that it is unlawful for any person to drive a vehicle with a controlled substance in his/her blood. Provides that it is a rebuttable presumption that the person had a controlled substance in his/her blood at the time of driving a vehicle if the person had any measurable amount of a controlled substance in his/her blood at the time of the performance of a chemical test within three hours after driving. Clarifies that a controlled substance does not include a controlled substance or narcotic drug when administered by or under the direction of a person licensed by the state to dispense, prescribe, or administer controlled substances. The defendant shall bear the burden of showing that the exception applies.

Requires the Department of Motor Vehicles (DMV) to revise the application for an original or renewal driver's license to include a specified statement that allows an applicant to register with the federal Selective Service System. Requires DMV to forward any personal information required for registration of consenting persons to the federal Selective Service System in an electronic format. Prohibits DMV from forwarding any personal information for persons who do not consent to Selective Service registration, except as provided in any memorandum of understanding between DMV and the federal Selective Service System.

SB 956 (Lieu-D) Automobile sellers and lenders: Buy-Here-Pay-Here

Establishes the Buy-Here-Pay-Here (BHPH) Automobile Dealers Act. Specifically, defines a BHPH automobile dealer as a dealer that enters into a conditional sale or lease contract, and assigns less than 90% of all unrescinded conditional sale contracts and lease contracts to unaffiliated third party finance or leasing sources within 45 days of consummation of those contracts. Requires BHPH dealers to be licensed under the California Finance Lenders Law (CFLL). Provides that an automobile dealer that meets the definition of BHPH to become licensed under the CFLL within six months of meeting the definition. Limits the annual percentage rate of a BHPH loan to no more than 17% plus the federal funds rate in effect at the time the contract was executed.

Allows a city or county that has installed parking meters that allow 10 or more hours of parking and that are in compliance with the Americans with Disabilities Act to require a disabled person to pay for parking, provided that the parking space has signage to that effect. Requires a person with a permanent disability, when renewing a permanent disabled parking placard every two years, to submit a new medical certificate.

Requires the California Highway Patrol or any other law enforcement agency that receives a report of a suspected DUI offender to provide the reporting person's identifying information to the state or local agency responsible for disbursing the reward. Requires victim restitution and every other fine, penalty, assessment, reimbursement, or forfeiture imposed pursuant to a conviction to be paid and collected in full prior to paying the reward.

Allows an autonomous vehicle to be operated on public roads for testing purposes by a driver who possesses the proper license for the vehicle being operated if it is being operated on roads in this state solely by employees, contractors, or other persons designated by the manufacturer of the autonomous technology. Under this scenario, the driver must be seated in the driver's seat, monitoring the safe operation of the autonomous vehicle, and must be capable of taking over immediate manual control of the autonomous vehicle in the event of an autonomous technology failure or other emergency. Prior to the start of testing in this state, the person performing the testing must obtain an instrument of insurance, surety bond, or proof of self-insurance in the amount of $5 million dollars and provide evidence of such in a form and manner required by the Department of Motor Vehicles (DMV). Prohibits an autonomous vehicle from being operated on public roads until the manufacturer submits an application to DMV that is approved by DMV.

AB 1550 (Bonilla-D) Vehicles: veterans' organizations license plates

Increases the fees required to issue, renew, and personalize veterans license plates. Permits the Department of Veterans Affairs to create a distinctive design of veterans' plates and the associated decals to honor all veterans or veterans who served in a particular war or armed conflict. Permits any vehicle owner to apply to the Department of Motor Vehicles (DMV) for a veterans' plate with a decal that honors all veterans or veterans who served in a particular war or armed conflict. Requires DMV, by 7/1/13, to issue a distinctive decal to any veteran for his/her veterans' plate that recognizes his/her veteran status in, or honoring veterans of, a particular war or armed conflict. In lieu of such a decal, DMV must offer a "yellow ribbon/support our troops decal" to veterans.

AB 1595 (Cook-R) Vehicles: recreational off-highway vehicles

Defines recreational off-highway vehicles (ROHVs) and prescribes safety regulations for their use in California. Defines ROHVs as a motor vehicle designed for operation primarily off of the highway and that has (1) a steering wheel, (2) non-straddle seating for the operator and passengers, (3) a maximum speed capability of greater than 30 miles per hour, and (4) an engine displacement equal to or less than 1,000 cubic centimeters. Includes ROHVs among off-highway motor vehicles subject to the Department of Motor Vehicles registration and identification requirements. Establishes requirements for the operation of ROHVs on public lands.

AB 1657 (Wieckowski-D) Traffic offenses: additional penalty

AB 1658 (Gatto-D) Vehicles: specialized license plates

Establishes a Legacy License Plate Program through which the Department of Motor Vehicles (DMV) shall issue specialized license plates that replicate the look of California license plates from the state's past. Imposes additional fees for legacy plates of $50 for original issuance, $40 for annual renewal, $15 to transfer to another vehicle, and $35 for replacement. Precludes DMV from issuing any of these plates until it has received at least 7,500 paid applications for any one of the legacy license plates. If it does not receive 7,500 paid applications for any one of the three plates by 1/1/15, then DMV must immediately refund all the application fees that it has received.

AB 1665 (Galgiani-D) Railroad crossings: California Environmental Quality Act

Specifies that the California Environmental Quality Act (CEQA) does not apply to the closure of a railroad grade crossing by order of the Public Utilities Commission (PUC) when the PUC has found the crossing to present a threat to public safety, until 1/1/16. Requires a state agency, whenever it determines that a project is not subject to CEQA pursuant to designated provisions and the state agency approves or determines to carry out the project, to file a specified notice of that approval or determination with the Office of Planning and Research.

Permanently allows the operation of overweight transit buses on non-interstate highways that were procured before 1/1/13. AB 1768 (Davis-D) Vehicles: additional registration fees

Allows counties, by a resolution adopted by the board of supervisors, to impose a $3 annual vehicle registration fee surcharge in order to enhance the capacity of local police and prosecutors to deter, investigate, and prosecute vehicle theft crimes. (In a county with a population of 250,000 or less, the proceeds of the fee must be expended exclusively for those vehicle theft crime programs and for the prosecution of crimes involving driving while under the influence of alcohol or drugs, or both, or vehicular manslaughter, or any combination of those crimes.)

Requires the Department of Motor Vehicles (DMV) to disclose and not mask the violation if the commercial license holder attends a TVS. DMV will not, however, apply the conviction toward the driver's negligent operator point count.

Prohibits a peace officer from towing and impounding a vehicle driven by an unlicensed driver if the vehicle can be legally parked near the scene of the traffic stop and retrieved by a licensed driver within a reasonable amount of time. Requires a peace officer to inform the unlicensed driver that the vehicle will not be towed or impounded if a licensed driver can retrieve the vehicle within a reasonable amount of time. Authorizes a peace officer to use his/her discretion in allowing a licensed driver to appear to retrieve the vehicle. Authorizes a peace officer to use his/her discretion and available resources in assisting the unlicensed driver in contacting a licensed driver to retrieve the vehicle. Requires the licensed driver to present a valid driver's license and evidence of financial responsibility prior to assuming control over the vehicle.

Deletes tire repair and changing from the list of services exempt from licensure as an automotive repair dealer (ARD) under the Bureau of Automotive Repair, as specified. Exempts tires service provided by or on behalf of a motor vehicle club holding a specified certificate of authority or a tow truck operator possessing a valid motor carrier permit, from licensure as an ARD.

Provides that any sign placed in accordance with these provisions need not be removed when the authority to place the sign is repealed.

AB 2098 (Jones-R) Driver's licenses: requirements

Requires 18 and 19 year old driver's license applicants to complete driver education and training. Prohibits a student from taking driver training instruction, unless he/she has successfully completed driver education. Prohibits the governing board of a school district from requiring a person who has completed the Department of Motor Vehicles (DMV) approved driver education and training elsewhere to be required to complete driver education and training at a secondary school in order to graduate from high school. Allows DMV to issue a distinctive driver's license that displays a distinctive color or a distinctively colored stripe or other distinguishing characteristic, to a person who is 18 or 19 years of age.

AB 2118 (Butler-D) Household goods carriers

Amends the Household Goods Carriers Act to enhance the authority of the Public Utilities Commission (PUC) to regulate household goods carriers. Identifies "broker" as a person engaged by others in the act of arranging for service by a household goods carrier and makes a "broker" subject to permit requirements. Clarifies that an entity falling within the definition of "household goods carrier," including a "broker," is subject to penalties regardless of whether it has obtained a permit and maintains the failure to obtain a permit as a separate violation. Increases fines from a maximum of $1,000 to $2,500 and requires that the fine for a violation that involves operating or holding oneself out as a household goods carrier without a permit be not less than $1,000. Authorizes the PUC to suspend or revoke a household goods carrier's permit, or assess a fine, for unauthorized use of another person's trademark and authorizes assessments to cover the expense of a commission trademark infringement investigation.

AB 2128 (Cook-R) Vehicles: automated traffic enforcement systems

Requires the Department of Transportation or a local authority to determine the appropriate yellow light signal interval based on the prevailing traffic speed rather than on posted speed limit set based on a rounding down to the nearest five mile per hour increment. Revises and recasts provisions clarifying that drivers stopped at red light signals are prohibited from proceeding straight through an intersection or making a left turn (except for a left turn from a one-way street onto a one-way street) until an indication to proceed is shown, a violation of which is subject to a base fine of $100. Revises and recasts provisions clarifying that a driver, after having come to a complete stop at a red light signal, is authorized to turn right or turn left from a one-way street onto a one-way street (except when a sign is in place prohibiting such a turn), a violation of which is subject to a base fine of $35.

AB 2182 (Torres-D) Airports: firearms: arrest

Requires that a peace officer must arrest a person for violating the provisions of law prohibiting the carrying of concealed firearms when the offense occurs within an airport, as defined, in an area to which access is controlled by the inspection of persons and property, and requires the peace officer to confiscate the firearm. Establishes a rebuttable presumption that the area to which access is controlled by the inspection of persons and property begins wherever signs have been posted notifying airport users that the possession of restricted items is prohibited.

AB 2245 (Smyth-R) Bicycle lanes: CEQA

Exempts from the California Environmental Quality Act (CEQA) a project that consists of restriping of streets and highways for bicycle lanes in an urbanized area that is consistent with a city of county bicycle transportation plan. Prior to determining that a project is exempt the lead agency is to prepare an assessment of any traffic and safety impacts of the project, to mitigate potential vehicular traffic impacts and bicycle and pedestrian safety impacts and hold hearings in areas affected by the project to hear and respond to public comments. Requires the hearings be published in a newspaper of general circulation in the area affected by the proposed project. Whenever an agency determines that a project is not subject to CEQA pursuant to the bill and it determines to approve or carry out that project, the notice is to be filed with the Office of Planning and Research (OPR) and if a local agency so determines the notice is to be filed with OPR, and filed with the county clerk which the project is located.

Requires the Department of Motor Vehicles (DMV) to establish, maintain and make available on its Web site, a current listing of the date and time it received each application for the registration of a specially constructed passenger vehicles and pickup trucks (SCV) in the order the applications were received and a tally of the requests received for that calendar year. Requires DMV to adopt regulations to secure the privacy of applicants for SCV registration subject to the Web site listing described above. Requires DMV, when it receives an application for registration of an SCV after it has registered 500 SCVs in that calendar year, to consider that application, in the order it was received, the following calendar year.

AB 2291 (Blumenfield-D) Vehicles: advertising signs

Defines the types of displays that are exempt from local regulation of advertising on parked vehicles. Exempts from local regulation legal license plate frames and paper advertisements issued by a dealer and contained within legal license plate frames. Provides that advertising is permanently affixed when it is (1) painted directly on the body of a motor vehicle; (2) applied as a decal on the body of a motor vehicle; and (3) placed in a location on the body of a motor vehicle that the manufacturer specifically designed, in compliance with both state and federal law or guidelines, for the express purpose of containing an advertising sign.

AB 2477 (Garrick-R) Vehicles: commercial vehicles: video event recorders

Authorizes the placement of a video event recorder on a commercial vehicle's windshield in an area no more than two inches below the upper edge of the area swept by the windshield wipers and outside the driver's line of sight to the road and highway signs and signals. Provides that the authorization becomes inoperative when the California Highway Patrol (CHP) declares that an existing federal exemption for these recorders has expired or when the CHP declares that a subsequent renewal if the federal exemption has expired, whichever is later.

Revises and recasts provisions related to driving under the influence of alcohol or drugs, or the combination of drugs and alcohol by separating the provisions into three distinct sections and subsections (1) driving under the influence of alcohol, (2) driving under the influence of drugs, and (3) driving under the influence of alcohol and drugs.

Requires the California Law Revision Commission to conduct a survey to compare the key provisions of California's underinsured motorist coverage laws with the laws of other states, as specified. Requires the Commission to conduct the survey in consultation with automobile insurers, consumer attorneys, and the Department of Insurance, and to report its findings to the Legislature no later than 12/31/13.

AB 2600 (Norby-R) Vehicles: driving privilege: marijuana

Prohibits the driver's license of a juvenile person, under the age of 21, from being suspended or revoked for a conviction of possession of not more than 28.5 grams or one ounce of marijuana, other than concentrated cannabis, when the juvenile person is convicted of an infraction for possession of the substance.

AB 2644 (Butler-D) Electric vehicle charging stations

Requires the Building Standards Commission, as a part of the next triennial edition of the California Building Standards Code adopted after 1/1/14, to adopt building standards for the construction, installation, and alteration of electric vehicle charging stations for parking spaces in single-family residential real property, in accordance with prescribed requirements.

Extends the period to submit evidence of financial responsibility or establish that the vehicle is not being operated from 45 days to 60 days.

AB 2659 (Blumenfield-D) Vehicles: driver's licenses

Permits the Department of Motor Vehicles to waive the driving skills test required to obtain a commercial driver's license for a person with a U.S. Armed Forces military driver's license in compliance with federal regulations. Deletes the requirement that the signature of the driver whom the vehicle is being rented to be written in the presence of the person renting the vehicle and instead allows the person renting the vehicle to instead compare the photograph on the driver's license of the person with the person to whom the vehicle is to be rented, except as specified.

AB 2679 (Assembly Transportation Committee) Transportation: omnibus bill

Makes various non-substantive, technical changes to transportation-related provisions. Cleans up statutes to reflect highway relinquishments that have already occurred and those that will not occur. Authorizes the California Transportation Commission (CTC) to relinquish to the City of Watsonville a portion of State Highway Route 152 within the city limits upon terms and conditions the CTC finds to be in the best interests of the state. Allows for an alternate placement location for a license plate on the rear of certain tow trucks to ensure that the view of the license plate is not obstructed by the swing arm. Codifies regulations relative to bus stop placement and authorize private school officials to designate school bus stops.
