Establishes the Internet Gambling Consumer Protection and Public-Private Partnership Act of 2013, a framework to authorize intrastate Internet gambling, as specified. SB 600 (Lieu-D) Drugs: supply chain: consumer protection

Repeals provisions of existing Pharmacy Law to conform to the federal Drug Quality and Security Act. Declares that any foreign dangerous drug that is not approved by the United States Food and Drug Administration or that is obtained outside the state-licensed supply chain is misbranded. Provides that anyone who purchases that drug is guilty of a misdemeanor and subject to a fine of not more than $10,000.

SB 962 (Leno-D) Smartphones: sales: technological solutions

Requires smartphones manufactured on or after 7/1/15, and sold in California after that date, to contain a technological solution at the time of sale that will render the essential features of the smartphone inoperable when not in the possession of the authorized user. Authorizes an authorized user to affirmatively elect to disable or opt-out of the technological solution at any time.

SB 1019 (Leno-D) Upholstered furniture: flame retardant chemicals: labeling

Requires a manufacturer of upholstered furniture to indicate whether or not the product contains added flame retardant chemicals, as defined, by including a specified statement on that label.

SB 1027 (Hill-D) Booking photographs: commercial use

Prohibits a person who publishes a booking photograph via print or electronic means from soliciting, requiring, or accepting a fee or other consideration from a subject individual to remove, correct, modify, or to refrain from publishing or otherwise disseminating that photograph, as specified. Authorizes a subject individual who is aggrieved by a violation of these provisions to bring a civil suit to recover the greater of actual damages or a $1,000 penalty for each violation, as specified.

SB 1040 (Evans-D) Food labeling: genetically engineered food

Requires, beginning 1/1/16, that any food, except as provided, offered for retail sale in the state be considered misbranded if it is entirely or partially genetically engineered, as defined, and that fact is not disclosed in a specified manner. Prescribes labeling requirements for a raw agricultural commodity that is genetically engineered and packaged foods, as defined, containing some products of genetic engineering. Imposes these labeling requirements on manufacturers and retailers of the commodities and foods.

SB 1177 (Steinberg-D) Advertising: student information: privacy

Prohibits an operator of an Internet Web site, online service, online application, or mobile application from knowingly engaging in targeted advertising to students or their parents or legal guardians, using covered information to amass a profile about a K-12 student, selling a student's information, or disclosing covered information, as provided. Requires an operator to implement and maintain reasonable security procedures and practices appropriate to the nature of the covered information, to protect the information from unauthorized access, destruction, use, modification, or disclosure, and to delete a student's covered information if the school or district requests deletion of data under the control of the school or district. Authorizes the disclosure of covered information of a student under specified circumstances.

SB 1256 (Mitchell-D) Medical services: credit lines: consumer protection

Extends existing consumer protections regarding lines of credit for dental services to all types of medical or healing arts services by requiring a licensee to provide a patient with a treatment plan, a disclosure form, information about third-party payment coverage, and establishes language and competency requirements.

SB 1326 (Roth-D) Hearing aids: warranty

Clarifies hearing aid warranty provisions by requiring a retailer to provide written warranty beginning and expiration dates from the time the hearing aids are initially delivered to the buyer. Clarifies the hearing aid warranty tolling period after repair or service. Requires the seller to provide a work order or receipt with the date the warranty period resumes and the revised expiration date of the warranty adjusted to reflect the suspension of the warranty period during repair or service.

SB 1348 (DeSaulnier-D) Data brokers: sale of personal information

Requires a data broker, as defined, to permit an individual to review the personal information that the data broker holds about them and to request that the data broker cease selling, or otherwise sharing, that personal information to third parties, except as specifically allowed.

SB 1350 (Lara-D) Public restrooms: baby diaper changing accommodations

Requires the California Building Standards Commission to develop and adopt standards governing the installation of baby diaper changing accommodations for restroom facilities in a place of public accommodation, as specified.

SB 1351 (Hill-D) Payment cards: fraud

Requires retailers, except as specified, that accept a payment card to provide a means of processing card-present payment card transactions involving payment cards equipped with embedded microchips or any other technology that is more secure than static magnetic stripe technology for card-present fraud prevention. Enacts legislative findings and declarations relating to the adoption of microchip technology for credit cards in over 80 countries throughout the world, not including the United States, and to the value of these cards in combatting payment card fraud. States legislative intent that this bill provide consumer protection consistent with federal law and not impact private agreements between retailers, small retailers, and payment card networks relating to which party bears liability for fraudulent payment card usage.

Requires buildings owned or partially owned by state or local governments, as well as other private buildings open to the public, as specified, to maintain at least one safe, sanitary, and convenient baby diaper changing station that is accessible to women and men.

AB 834* (Williams-D) Law schools: consumer information: disclosure

Provides a law school otherwise exempt from the California Private Postsecondary Education Act that applies to the Bureau for Private Postsecondary Education (BPPE) for an approval to operate and that meets other specified criteria with an alternate way to satisfy the requirements regarding a School Performance Fact Sheet. Specifies that such a law school satisfies those requirements by, among other things, complying with a specified standard of the American Bar Association relating to the disclosure of consumer information. Requires such a law school to annually provide the information to the BPPE and requires the BPPE to include the information on its Internet Web site.

AB 1658 (Jones-Sawyer-D) Consumer credit reports: foster care children

Requires a county welfare department, county probation department, or the Department of Social Services to inquire of each of the three major credit reporting agencies as to whether a child in foster care reaching his/her 16th birthday, and each year thereafter, has any consumer credit history, as specified. Requires the Department to provide information to the appropriate legislative policy committees regarding the implementation of these provisions, including, but not limited to, any state and county barriers to obtaining credit reports as required by the federal Child and Family Services Improvement and Innovation Act of 2011.

AB 1710 (Dickinson-D) Data breach: personal information: privacy

Requires, with respect to the information required to be included in the notification of a data security breach, if the person or business providing the notification was the source of the breach, that the person or business offer to provide appropriate identity theft prevention and mitigation services, if any, to the affected person at no cost for not less than 12 months if the breach exposed or may have exposed specified personal information. Expands security procedures and practice provisions that apply to businesses that own, license, or maintain personal information about California residents. Prohibits the sale, advertisement for sale, or offer to sell of an individual's social security number, with exceptions.

AB 1735 (Hall-D) Nitrous oxide: dispensing and distributing

Makes it a misdemeanor for any person to dispense or distribute nitrous oxide (N2O) to a person, if it is known or should have been known that the N2O will be ingested or inhaled by the person for the purposes of causing intoxication, and that person proximately causes great bodily injury or death to himself/herself, or any other person. Requires a person who dispenses or distributes N2O to record each transaction in a written or electronic document, and make the document available for inspection, upon presentation of a duly authorized search warrant, to officers or employees of the Board of Pharmacy or other law enforcement agencies.

AB 1907 (Ridley-Thomas-D) Natural gas: sales

Requires compressed natural gas (CNG) sold at retail to the public for use as a motor vehicle fuel to be sold in a gasoline gallon equivalent that is equal to 126.67 cubic feet (5.66 pounds) of CNG, measured at the standard pressure and temperature, as specified, and requires liquefied natural gas (LNG) to be sold in a diesel gallon equivalent that is equal to 6.06 pounds of LNG. Prohibits a person from selling at retail any CNG or LNG for use as motor fuel from any place of business in this state unless there is displayed and labeled on the dispensing apparatus in a conspicuous place "Gasoline gallon equivalent" or "Diesel gallon equivalent," respectively.

Creates a 13-member California Cyber Security Steering Committee in the Governor's Office of Emergency Services. Continues in existence the California Cyber Security Task Force. AB 2624 (Medina-D) False advertising: Made in North America

Makes it unlawful to sell or offer for sale in this state any product that contains the words "Made in North America," "North American Made," or similar words on the product or its container unless all of the product was made in the United States, Canada, or Mexico. Adds misrepresenting a product as made in North America to the list of unfair methods of competition and unfair or deceptive acts or practices actionable under the Consumers Legal Remedies Act.

AB 2656 (Jones-R) Motor fuel: labeling

Requires each motor fuel transaction in this state to contain information regarding the estimated cost of compliance with any market-based compliance mechanism that the Air Resources Board may adopt. Requires the Division of Measurement Standards to annually estimate and post online the cost per gallon of motor fuel resulting from compliance with California's Greenhouse Gas Emissions Reduction regulations. Requires wholesale motor fuel invoices, product transfer documents, and retail gasoline pumps to publicize that estimated cost.

AB 2667 (Bloom-D) Rental-purchase agreements: electronic devices

Amends the Karnette Rental-Purchase Act to require a lessor to provide clear and prominent notice to a consumer and obtain express consent from the consumer at the time the lessor and the consumer enter into a rental-purchase agreement for an electronic device if that device has geophysical location tracking technology installed by the lessor and prohibits a lessor from installing the technology without providing clear and prominent notice and obtaining express consent from the consumer.

Requests the Department of Justice to convene meetings in 2014 with representatives from law enforcement, prosecutors, the secondhand dealer and pawnbroker industry, and the public to determine the changes to existing law that will (1) allow California pawnbrokers and secondhand dealers to fairly compete with out-of-state Internet pawnbrokers, (2) keep available to law enforcement merchandise pawned over the Internet that would otherwise go out-of-state and not be reported or held for inspection, and (3) protect California consumers transacting pawn loans over the Internet from higher interest rates and fees than those permitted in California.

Authorizes the creation of the California New Markets Tax Credit Program, administered through the Governor's Office of Business and Economic Development and the California Competes Tax Credit Allocation Committee, for the purpose of allocating tax credits in tax years 2015 through 2019 to a qualified community development entity (CDE). Makes legislative findings and declarations stating that the Program allocates federal tax incentives to CDEs, which they then use to attract private investors who contribute funds that can be used to finance and invest in businesses and develop real estate in low-income communities. Authorizes the Committee to allocate up to $40 million in tax credits annually to qualified CDEs for a total allocation of $200 million.

Limits access to controlled substances by veterinary assistants who have obtained a valid permit by the VMB. SB 315 (Lieu-D) Contractors: licensed/unlicensed

Provides that it is a misdemeanor for a person to engage in the business of, or act in the capacity of, a contractor within this state if the person is not licensed, as specified, or if the person performs acts under a license that is under suspension for specified violations. Authorizes a person who is not licensed as a contractor to advertise for construction work or a work of improvement only if the aggregate contract price is less than $500 and the person states in the advertisement that he/she is not licensed. Extends the period during which the Contractors State License Board must initiate disciplinary action against a licensee upon a finding by the Labor Commissioner of a willful and deliberate Labor Code violation.

SB 381 (Yee-D) Health care practitioners: chiropractic practice: licenses

Prohibits health care practitioners, other than chiropractors, physicians, surgeons or osteopathic physicians, from performing joint manipulation or joint adjustments. Indicates that a health care practitioner who engages in the unlawful practice of chiropractic is subject to their license being revoked or suspended and/or other disciplinary action. Specifies that this bill will not prevent veterinarians from practicing within the scope of their license.

SB 410 (Yee-D) Anesthesiologist/radiologist assistants: licensure

Enacts the Anesthesiologist Assistant Practice Act requiring the licensure and regulation of anesthesiologist assistants by the Medical Board of California and prescribing the services that may be performed by a radiologist assistant under the supervision of a qualified physician and surgeon. Makes it a crime for a person to practice as an anesthesiologist assistant without a license or for an anesthesiologist assistant to practice outside the scope of his/her practice, as specified. Requires the Board to adopt regulations relating to the licensure of radiologist assistants and certification of approved programs by 7/1/14, and to commence licensure and certification on that date.

SB 417 (Berryhill-R) Contractors: supplemental license requirements

Authorizes state and local agencies subject to the State Building Construction Act of 1955, the State Contract Act, and the Local Agency Public Construction Act, prior to advertising for bids for construction of a public building or a public works project, to advise the Contractors State License Board (CSLB) of any supplemental license, certification, or education required of a contractor to qualify to bid on the contract for that project. Requires the CSLB to review the information received regarding any supplemental license, certification, or education requirements, and to post any supplemental requirements it approves in an easily identifiable location on the CSLB's Internet Web site.

Requires the Board to set, by regulation, the fee for issuing and renewing a certificate for the use of immunizations, at the reasonable cost of regulating the certified optometrists, not to exceed $100.

Requires, no later than 1/1/16, licensing bodies to require an applicant to provide either an individual tax identification number or social security number if the applicant is an individual. Prohibits, except as specified, any entity within the Department of Consumer Affairs from denying licensure to an applicant based on his/her citizenship status or immigration status. AB 462 (Stone-D) Residential care facilities: fire protection regulations

Requires a residential care facility for the elderly or adult residential facility that has a valid license as of 1/1/14, to have installed and maintained on and after 1/1/18, an operable automatic fire sprinkler system approved by the State Fire Marshal. Requires a residential care facility, defined to include these facilities, for which a license is newly issued on or after 1/1/17, to have an approved, operable automatic fire sprinkler system. Provides that if the facility does not own the property the property owner shall determine all phases of construction, and the facility licensee shall pay all costs associated with compliance with these provisions. Limits specified inspection fees related to the sprinkler systems. Requires, by 1/1/16, the State Fire Marshal to adopt regulations to implement these provisions.

Requires the Board of Pharmacy to license a surplus medication collection and distribution intermediary to facilitate the donation of medications to, or transfer of medications between, participating entities under the unused medication repository and distribution program. Prohibits that intermediary from taking possession, custody, or control of dangerous drugs and devices, but authorizes the intermediary to charge specified fees for the reasonable costs of the support and services provided. Requires a surplus medication collection and distribution intermediary to keep and maintain for three years complete records for which the intermediary facilitated the donation of medications to or transfer of medications between participating entities. Requires that a surplus medication collection and distribution intermediary license be renewed annually, and requires the payment of a fee in the amount of $300 to obtain or renew the license.

Requires each board within the Department of Consumer Affairs to complete, within 45 days, the application review process with respect to each person who has filed with the board an application for issuance of a license, and to issue, within those 45 days, a license to an applicant who has successfully satisfied all licensure requirements, as specified. Requires each board to offer each examination the board provides for licensure, a minimum of six times per year, unless the board uses a national examination.
