SB 12 (Corbett-D) Consumer affairs: Made in California Program

Creates the "Made in California Program" within the Governor's Office of Business and Economic Development for the purpose of encouraging consumer product awareness and to foster the purchases of products manufactured in California; provides that it is an unfair method of competition or unfair business practice to use the designated "Made in California" label without participating in the Made in California Program; requires the Office to develop the Made in California Program and specify eligibility requirements of a company participating in the Program; and adds a Consumers Legal Remedies Act enforcement clause.

Establishes, until 1/1/18, the Pilot Program for Increased Access to Responsible Small Dollar Loans for the purpose of allowing greater access for responsible installment loans in principal amounts of at least $200 and less than $2,500; specifies disclosure requirements that must be provided in writing to the consumer for loans made pursuant to the Program; requires a licensee participating in the Program to report each borrower's payment performance to at least one consumer credit reporting agency, upon acceptance as a data furnisher by that consumer reporting agency; and makes legislative findings and declarations relating to consumer demand for responsible installment loans.

SB 465 (Correa-D) Packaging and labeling: containers: slack fill

Amends packaging requirements pertaining to non-food commodities and food containers to address the issue of misleading packaging for consumer products, and specifically, "slack fill" - which is the impermissible empty space between the actual container capacity and the volume of the product contained therein.

SB 501 (Corbett-D) Social networking Internet Web sites: privacy: minors

Requires a social networking Internet Web site, as defined, to remove the "personal identifying information," as defined, of any registered user that is accessible online, within 96 hours after his/her request and requires removal of that information in that same manner regarding a user under the age of 18 upon request by the user's parent or legal guardian; and does not require removal or elimination of the personal identifying information if federal or state law otherwise requires the social networking Internet Web site to maintain the information.

SB 568 (Steinberg-D) Privacy: Internet: minors

Prohibits, on and after 1/1/15, an operator of an Internet Web site, online service, online application, or mobile application, as specified, from marketing specified types of products or services to a minor; prohibits an operator from knowingly using, disclosing, compiling, or knowingly allowing a third party to use, disclose, or compile, the personal information of a minor for the purpose of marketing or advertising specified types of products or services; makes this prohibition applicable to an advertising service that is notified by an operator of an Internet Web site, online service, online application, or mobile application that the site, service, or application is directed to a minor; requires, on and after 1/1/15, the operator of an Internet Web site, online service, online application, or mobile application to permit a minor who is a registered user of the operator's Internet Web site, online service, online application, or mobile application to remove, or to request and obtain removal of, content or information publicly posted on the operator's Internet Web site, service, or application by the minor, subject to specified conditions and exceptions; and specifies the types of products and services that are applicable to these restrictions.

AB 370 (Muratsuchi-D) Internet privacy: personally identifiable information

Requires privacy policies posted by an operator of a commercial Internet Web site or online service, that collects personally identifiable information, to disclose how the operator responds to Web browser "do not track" signals or other similar mechanisms regarding the collection of personally identifiable information and to disclose whether other parties may collect personally identifiable information about an individual consumer's online activities, as specified.

AB 509 (Blumenfield-D) Consumer affairs: unlawful acts

Adds to the list of unlawful acts, under the Consumers Legal Remedies Act, the act of representing a product as designed, made, or both in a specific city or county, by using a specified "made in" label, unless the product complies with specified standards.

AB 636 (Hall-D) Consumers: winemakers' instructional events

Permits a winegrower, California winegrower's agent, importer, or other specified parties appearing at an instructional event, as specified, to provide autographs to consumers or consumer advertising specialties given by the person to a consumer or on any item provided by a consumer; and prohibits a requirement of the purchase of any alcoholic beverage in connection with such autographing.

AB 834 (Williams-D) Consumer information: disclosure

Authorizes a law school accredited by the American Bar Association, and owned by an institution operating under the Bureau for Private Postsecondary Education within the Department of Consumer Affairs, to satisfy the current disclosure requirements of the School Performance Fact Sheet by, among other things, complying with the American Bar Association disclosure requirements relating to consumer information.

AB 1013 (Gomez-D) Consumer affairs: Attorney General

Authorizes any employee designated by the Attorney General to present evidence and argument to the agency, court, or department, for the effective protection of the interests of consumers.

AB 1220 (Skinner-D) Consumer credit reporting: adverse action

Makes it unlawful for a consumer credit reporting agency to prohibit, or to dissuade or attempt to dissuade, a user of a consumer credit report furnished by the credit reporting agency from providing a copy of the consumer's credit report to the consumer, upon the consumer's request, if the user has taken adverse action against the consumer based upon the report; and authorizes the Attorney General, among others, to bring a civil action, for a civil penalty not to exceed $5,000, against any credit reporting agency for a violation of these provisions.

AB 1255 (Pan-D) Corporations: consumer cooperatives

Authorizes a consumer cooperative corporation to (1) provide for preferred memberships and/or non-voting memberships in its articles of incorporation or bylaws; (2) divide a membership class into one or more series; and (3) authorize the board of directors to fix the rights, privileges, preferences, restrictions, and conditions attaching to any wholly unissued class or series of memberships. Also, makes conforming changes to the laws governing consumer cooperative corporations.

SB 307 (Price-D) Veterinary Medical Board: veterinary assistants: permits

Extends, until 1/1/16, the provisions establishing the Veterinary Medical Board (VMB); makes other changes regarding the inspection authority of the VMB as it pertains to veterinary premises, the membership, and responsibility of the Multidisciplinary Committee of the VMB; limits access to controlled substances by veterinary assistants who have obtained a valid permit by the VBM; and requires the VBM to require an applicant to furnish a set of fingerprints to conduct the criminal history record check.

SB 309 (Lieu-D) State Athletic Commission: licenses

Extends, until 1/1/16, the operation of the California State Athletic Commission (CSAC) which regulates professional and amateur boxing, kickboxing, and martial arts contests and exhibitions; enacts fee increases and spending restrictions to ensure the financial sustainability and appropriate operation of CSAC; deletes the training gymnasium license and creates a professional trainer's license; and expands CSAC's authority to delegate and revoke regulatory oversight of amateur contests.

Prohibits health care practitioners, other than chiropractors, physicians, surgeons or osteopathic physicians, from performing joint manipulation or joint adjustments; indicates that a health care practitioner who engages in the unlawful practice of chiropractic is subject to their license being revoked or suspended and/or other disciplinary action; and specifies that this bill will not prevent veterinarians from practicing within the scope of their license.

SB 410 (Yee-D) Anesthesiologist/radiologist assistants: licensure

Enacts the Anesthesiologist Assistant Practice Act requiring the licensure and regulation of anesthesiologist assistants by the Medical Board of California (MBC) and prescribing the services that may be performed by a radiologist assistant under the supervision of a qualified physician and surgeon; makes it a crime for a person to practice as an anesthesiologist assistant without a license or for an anesthesiologist assistant to practice outside the scope of his/her practice, as specified; and requires the MBC to adopt regulations relating to the licensure of radiologist assistants and certification of approved programs by 7/1/14, and to commence licensure and certification on that date.

SB 417 (Berryhill-R) Contractors: supplemental license requirements

Authorizes state and local agencies subject to the State Building Construction Act of 1955, the State Contract Act, and the Local Agency Public Construction Act, prior to advertising for bids for construction of a public building or a public works project, to advise the Contractors State License Board (CSLB) of any supplemental license, certification, or education required of a contractor to qualify to bid on the contract for that project; requires the CSLB to review the information received regarding any supplemental license, certification, or education requirements, and to post any supplemental requirements it approves in an easily identifiable location on the CSLB's Internet Web site; and provides that any supplemental requirements that are not posted on the CSLB's Internet Web site before the bid opening shall not apply to the bidding process for that contract.

SB 485 (Calderon-D) Junk dealers and recyclers: weighmaster's license

Requires a junk dealer or recycler to submit additional information regarding its junk dealer business to the Department of Food and Agriculture when applying for a weighmaster's license or a renewal license; requires the Department to complete an investigation of the information on the application or renewal within a specified period of time and revoke the license if the information submitted in the application or renewal is materially inaccurate; increases the fees that junk dealers or recyclers pay for each fixed location; and sunsets these provisions on 1/1/19.

SB 662 (Galgiani-D) Structural pest control operators: financial responsibility

Increases the minimum limit for liability insurance to $500,000 for a structural pest control company; increases the amount of the surety bond required to maintain a license or company registration to $12,500; and increases the upper limit of a surety bond required for issuance, reissuance, or restoration of a license or company registration, after a suspension or revocation, to $25,000.

Prohibits the holder of any dealer's license from advertising for sale or selling a used vehicle that the dealer knows or should have known is subject to a manufacturer's safety recall, 180 days after the enactment of regulations pursuant to portions of the federal Moving Ahead for Progress in the 21st Century Act; prohibits the holder of any dealer's license from selling a used vehicle as part of a used vehicle certification program if the dealer knows or should have known that the vehicle is the subject of a manufacturer's safety recall; and generally prohibits the holder of any dealer's license from selling any used vehicle at retail without providing a written disclosure, as specified.

AB 983 (Melendez-R) Self-service storage facilities

Provides that in addition to the right to foreclose on the vehicle, watercraft, or trailer at a self-storage facility, the owner of a self-storage facility may have the vehicle, watercraft, or trailer towed from the premises if rent and other charges have not been paid for 60 days and the required notice has been sent; and deletes the 14-day period, and, instead, allows an owner to deny the occupant access to the space, enter the space, and remove property to safekeeping by the termination date specified in the preliminary lien notice.

AB 993 (Linder-R) Contractors: arbitration

Revises and updates the provisions relating to the Contractors State License Board's arbitration program that provides for an alternative dispute resolution process between consumers and contractors for claims up to $50,000, and clarifies the arbitration process, the arbitrator's authority, and the awarding of attorney's fees, as specified.

AB 1000 (Wieckowski-D) Physical therapists: direct access to services

Allows patients to self-refer to a physical therapist and receive treatment for 45 calendar days or 12 visits, whichever comes first, before being seen by a physician and receiving sign off on the treatment plan initiated by a physical therapist; and permits specified health professionals to be employed by a medical corporation.

Provides that it is not the practice of law, is not a violation of those provisions prohibiting the unlawful practice of law, does not constitute the activities of a legal document assistant, and does not require registration as a legal document assistant for a person to design, create, publish, assemble, complete, distribute, display, or sell legal products, by means of an Internet Web site or mobile application, if the Internet Web site or mobile application includes a statement that it is not a substitute for an attorney.

Deletes existing law prohibiting contractors from paying, crediting, or allowing any consideration or compensation, of any kind to any other contractor or salesperson other than a licensee for, or on account of, the performance of a work of improvement or services, including, but not limited to, home improvement work or services, except as specified.

AB 1136 (Levine-D) Pharmacists: drug disclosures

Requires a pharmacist, on or after 7/1/14, to include a written label on a prescription drug container indicating that the drug may impair a person's ability to operate a vehicle or vessel, if in the pharmacist's professional judgment, he/she determines that the drug may impair a person's ability to operate a vehicle or vessel.

Permits a pharmacist to substitute a biological pharmaceutical product with a comparable "biosimilar" product, provided that biosimilar product is deemed by the federal Food and Drug Administration to be interchangeable with the prescribed biological product.

AB 1159* (Gonzalez-D) Attorneys: immigration services

Provides that it is the unlicensed practice of law for an immigration consultant, or any person who is not an attorney, to literally translate, from English into another language, in written documents or advertisements, the term "notary public," or any other term that implies that the person is an attorney; requires attorneys who provide immigration reform act services to use a written contract in English and in the client's native language which contains specified elements; prohibits an attorney or an immigration consultant from demanding or accepting the advance payment of any funds from a person for immigration reform act services before the enactment of any immigration reform act; requires immigration consultants to place client funds into a trust account; increases the bond required by an immigration consultant to $100,000; and clarifies that civil penalties, as specified, are to be directed by the State Bar of California to provide free legal services or mitigate unpaid claims of injured immigrant clients.

Defines the term "escrow" and "escrow agent rating service;" requires, until 1/1/17, escrow agent rating services to comply with specified portions of the California Consumer Credit Reporting Agencies Act; establishes policies and procedures reasonably intended to safeguard from theft or misuse any personally identifiable information it obtains from an escrow agent; and clarifies that title insurers are not considered escrow agent rating services when they engage in their regular business activities.

Expands the scope of practice for registered dental assistants, registered dental assistant in extended functions, and registered dental hygienists to better enable the practice of teledentistry in accordance with the findings of a Health Workforce Pilot Program, and enables reimbursement by Medi-Cal for Virtual Dental Home treatment.

AB 1177 (Bocanegra-D) Structural pest control licensees: fumigation

Extends the sunset date, to 1/1/18, for the Structural Fumigation Enforcement Program for Los Angeles, Orange, Santa Clara, and San Diego Counties; authorizes a county agricultural commissioner to require full payment of any delinquent fees due to that county pursuant to the enforcement program as a condition to registering a structural pest control licensee to operate a structural pest control business in that county; and increases the fee paid under the Program, from $5 to $8, by any person who performs a structural fumigation in those counties, as specified.

Clarifies that the California State Athletic Commission (CSAC) is authorized to regulate all forms of full contact martial arts contests involving participants 18 years of age or younger, including all forms and combinations of forms of full contact martial arts contests deemed by CSAC to be similar, and that an amateur contest includes a contest where full contact is used, even if unintentionally; requires CSAC to establish an advisory pankration subcommittee; authorizes CSAC to delegate oversight of amateur sports to one or more entities; and includes a deadline of 7/1/14, by which the subcommittee must make recommendations to CSAC.

Extends the requirement to allocate tax credits for five additional years, until 7/1/22, in an amount equal to a specified percentage of the qualified expenditures, as defined, attributable to the production of a qualified motion picture in California, or where the qualified motion picture has relocated to California or is an independent film; and extends and increases the limit on the aggregate amount of credits that may be allocated through the 2021-22 fiscal year.

Makes changes in the state's administration of the Export Document Program to address an existing backlog and streamline the process in the future; authorizes a person requesting an export document to make the request in certain electronic formats; requires the Department of Public Health (DPH) to accept requests submitted by e-mail or other electronic methods, including electronic copies of labels or advertising; requires that the fees for requests made by e-mail, facsimile, or the DPH's Internet Web site be submitted within specified time periods; requires DPH to develop procedures to expedite approval of requests for an export document in which the labels and advertising remain unchanged from a previously approved request for an export document for that food, drug, device, or cosmetic; and requires that an export document expire one year after its issue date.

Deletes a requirement that the Governor's Office of Business and Economic Development review and identify efficient and cost-effective methods for the state to create jobs in advanced manufacturing, as defined, and report their findings to the Legislature by 1/1/17; redefines "project" to include, but not be limited to, machinery and equipment utilized in the state; clarifies that for purposes of the sales and use tax exclusion, an entity located outside of the state, including an entity located overseas, is considered to be a participating party and is eligible to apply for financial assistance if the participating party commits to, and demonstrates that the participating party will be opening a manufacturing facility in the state; and repeals the requirement to perform a peer review on certain criteria, including, but not limited to, the extent to which the project will create new, permanent jobs in California and the extent to which the project results in a reduction in greenhouse gases, a reduction in air or water pollution, an increase in energy efficiency, or a reduction in energy consumption.

ACA 5 (Grove-R) Physicians and surgeons: abortions: notification requirement

Establishes the Parental Notification, Child and Teen Safety, Stop Predators Act which prohibits a physician and surgeon from performing an abortion on an unemancipated minor, as defined, unless the physician and surgeon or his/her agent has delivered written notice to the parent of the unemancipated minor, or until a waiver of that notice has been received from the parent or issued by a court pursuant to a prescribed process; requires the physician and surgeon performing an abortion on an unemancipated minor to report specified information to the Department of Public Health; and requires the Department to compile an annual statistical report with that information.
