SB 183 (Corbett-D) Elderly and dependent adults: civil actions
Clarifies who may commence and maintain an elder or dependent adult abuse action under the Elder Abuse and Dependent Adult Civil Protection Act where the elder or dependent adult has died. Permits an intestate heir whose interest may be affected by the action or to the decedent's successor in interest or an interested person if there is no personal representative of the decedent.

SB 434 (Romero-D) In-Home Supportive Services program
Increases the cap on state participation in hourly wages and benefits paid to In-Home Supportive Services workers. Increases the state participation cap in the total cost of wages and benefits to $13.35 per hour, makes the increase operative commencing the next state fiscal year for which the May Revision forecast of General Fund (GF) revenue exceeds the most current estimates by at least 5%, and requires subsequent annual increases up to $14.35 and $15.35 per hour when GF revenue forecasts grow an additional 5%.

SB 489 (Steinberg-D) Continuing care contracts: retirement communities: closure
Imposes patient protection requirements on continuing care retirement communities in the event of their closure by (1) requiring providers to provide written notice a minimum of 120 days before closure, (2) requiring the provider to provide the Department of Social Services (DSS) with a closure notice and relocation plan no less than 90 days prior to closure, (3) requiring DSS to approve the closure plan and monitor the facility closure in order to prohibit the providers from displacing residents, and (4) requiring the provider to offer residents the choice of placement options or a lump sum buy-out option in cases where comparable replacement housing and care are not available.

SB 491 (Alquist-D) The New Older Californians Act
Enacts the New Older Californians Act which establishes new programs or capacity within the Department of Aging for advocacy, housing, volunteer services, transportation, mental health, professional training, and data integration.

SB 535 (Kuehl-D) Long-term health care facilities
Requires the Department of Public Health to develop and maintain an online long-term care facility consumer information system to be available by 3/1/08. Requires the posting of all complaint data from the last three survey cycles, including outcome, nature of complaint, and date of investigation, and requires the posting of all state and federal deficiencies and enforcement sanctions from the last three survey cycles.

SB 573 (Scott-D) Annuity sales: seniors
Establishes a regulatory structure that requires life insurance companies and agents to determine the suitability of an annuity product for the particular senior customer before selling the policy.

SB 611 (Steinberg-D) Financial abuse of elder and dependent adults
Permits the use of the Attachment Law, which authorizes a plaintiff to attach the defendant's property to secure the amount of the claimed debt of defendant to plaintiff, in cases involving financial abuse of an elder or dependent adult under the Elder Abuse and Dependent Adult Civil Protection Act. This remedy shall be in addition to any other remedy sought or that may be available to plaintiff.

SJR 12 (Simitian-D) Elder abuse awareness stamp
Requests the President and Congress of the United States to afford the public a convenient way to contribute towards the funding of elder abuse prevention and awareness programs by authorizing the United States Postmaster General to establish a special rate of postage for first-class mail, and to issue a special postage stamp regarding elder abuse prevention and awareness.

AB 267 (Charles Calderon-D) Annuity sales: seniors
Requires the insurance producer agent or insurer when making a recommendation to a senior consumer, as defined, for the purchase or exchange of an annuity to have reasonable grounds for believing that the recommendation is suitable for the senior based on the facts disclosed by the senior relating to his/her financial situation and needs, and provides that before the purchase or exchange of an annuity, the insurance producer or insurer shall make reasonable efforts to obtain specified information to assist in making recommendations to the senior consumer. If a senior consumer refuses or fails to provide all specified relevant information, the insurance producer or insurer recommendation must be reasonable under all circumstances that were known at the time.

AB 298 (Maze-R) Relative caregivers
Establishes that a juvenile court can approve a proposed plan of legal guardianship with a relative without requiring proof of a compelling reason not to terminate parental rights. Revises the existing statutory order of preference governing permanent planning hearings so that adoption by a current caregiver remains first (as in current law), legal guardianship by a relative caregiver is moved to second, and adoption by an as-yet-unidentified family is third. Specifies that a relative caregiver's preference for legal guardianship over adoption, so long as it does not indicate an unwillingness to accept full responsibility for the child, may not alone be the sole basis to remove the child from the relative caregiver's home, and requires a court, prior to termination of a legal guardianship, to order the county child welfare agency to evaluate whether the child could safely remain in or be returned to the guardian's home if services were provided to the child or guardian and, if appropriate, to identify recommended family maintenance or reunification services to maintain the legal guardianship.

AB 304 (Huff-R) Elderly: disaster plan: health facilities
Requires that community care facilities and residential care facilities for the elderly which are licensed or have a special permit for specialized services provide a copy of their disaster and mass casualty plan to the fire department, law enforcement agencies, and civil defense and other disaster authorities in the area in which the facility is located upon request by the entity, and provides that the provision setting forth criminal penalties for violating rules or regulations promulgated under the Community Care Facilities Act does not apply to this bill.

Increases the annual homeowners' exemption to $27,000 for persons aged 62 or older.

AB 378 (Benoit-R) Elder and dependent adult abuse
Makes a subsequent conviction of theft, embezzlement, forgery, or fraud, regardless of value, by a caretaker against an elderly or dependant adult punishable by two, three, or four years in state prison or by a county jail term of up to one year.

AB 380 (Berg-D) Multipurpose Senior Services Program
Requires the Department of Health Care Services to annually increase reimbursement rates for the Multipurpose Senior Services Program by an amount based on the Medi-Cal rate adjustment for intermediate care facilities.

AB 398 (Feuer-D) Long-term health care facilities: information
Requires the Department of Public Health to establish and maintain an online consumer inquiry system to provide specified information to the public regarding long-term care facilities.

Establishes a 40-day timeframe for the Department of Public Health (DPH) to complete a long-term care facility complaint investigation and requires DPH to include in the written determination of the investigation specific findings and a summary of the evidence upon which the determination is made, and provides a complainant additional time to request an informal conference upon receipt of the determination of the investigation.

AB 411 (Emmerson-R) Residential care facilities: overconcentration
Permits a city of county to submit to the Director of the Department of Social Services information regarding the proposed location of residential care facilities with six or fewer residents. Allows the director to suggest the applicant find an alternate location for the facility if he/she finds the submitted information compelling.

Requires every residential care facility for the elderly that is licensed to care for not more than six residents to have an approved, operable automatic fire sprinkler system.

Requires the Department of Motor Vehicles to include with every notice of renewal of a driver's license a notice that a person who is 62 years of age or older may be issued an identification card free of charge.

Includes the crime of elder abuse to provisions of law punishing contempt of court for the willful and knowing violation of any protective or stay away order, as specified. Increases the penalty for violating a protective order to an elder abuse case from six months to one year.

AB 1558 (Soto-D) Community care facilities: license information system
Requires the Director of the Department of Social Services (DSS) to maintain and update the community care facilities automated license information system, authorizes inclusion of administrative or court actions against any facility or staff, and requires DSS to make the public information available by prescribed dates, as specified.
