SB 494 (Kehoe-D) Vehicular air pollution control: clean alternative fuels
Requires the Air Resources Board (ARB), in consultation with certain other state entities, to adopt regulations by 6/30/09, that become operative by 1/1/10, to ensure that commencing 1/1/15, 25% of new passenger vehicles and light-duty trucks sold in California are clean alternative vehicles, and that commencing 1/1/20, 50% are clean alternative vehicles. Requires the ARB, in developing the regulations, to consider technological and economic feasibility of the regulations, develop and enforce compliance options for eligible clean alternative vehicles, and ensure that clean alternative fuel is made available at retail outlets whenever the ARB determines that the sufficient number of vehicles capable of using that fuel has been reached.

SB 587 (Runner-R) Air quality: permit requirement: exemptions
Exempts printing, coating, adhesive application, or laminating equipment, from existing permit requirements. Limits this exemption to: (1) equipment whose volatile organic compound emissions are no greater than three pounds per day or 66 pounds per calendar month; (2) equipment that employs ultraviolet or electric beam type materials and the total amount of inks, coatings, adhesives, or organic solvents used in this equipment, including in the cleanup, is no more than six gallons per day or 132 gallons per calendar month; and (3) equipment that employs ultraviolet or electric beam type materials that contain no more than 50 grams of volatile organic compounds per liter of material and use cleanup solvents containing no more than 50 grams of volatile organic compounds per liter of material. Also corrects an erroneous cross-reference.

Increases the San Joaquin Valley Unified Air Pollution Control District's governing board from 11 members to 15 members. Increases the number of city members on the district board from three to five members, and requires the Governor to appoint two public members with specified qualifications and subject to Senate confirmation.

Requires the Air Resources Board to adopt regulations to ensure that 50% of new passenger and light-duty trucks, beginning in 2012, sold in California are clean alternative vehicles, and that all such vehicles sold in 2020 be clean alternative vehicles. Defines "clean alternative fuel" as a nonpetroleum fuel, including electricity, hydrogen, natural gas, propane, and any other fuel derived from renewable resources, that on a full fuel-cycle and energy-equivalent basis does not increase the emissions of greenhouse gases, toxic air contaminants, criteria air pollutants, water pollutants, or any other substances known to damage human health or the environment, in comparison to the production and use of a petroleum-derived fuel.

AB 109 (Nunez-D) California Global Warming Solutions Act of 2006: report
Requires the Governor, the State Teachers' Retirement System, the State Treasurer's Office, and the Public Employees' Retirement System, beginning 1/1/09 and annually thereafter, to report specified information to the Legislature regarding greenhouse gas emissions and green investments made in the alternative energy or clean technology business. Beginning 1/1/09, requires all land conservancies within the Resources Agency, the Department of Parks and Recreation, the state forests under the management or ownership of the Department of Forestry and Fire Protection, and the Wildlife Conservation Board, in coordination with the Department of Fish and Game, to report to the Legislature on the past, current, and future activities to sequester greenhouse gas emissions.

AB 118 (Nunez-D) Alternative fuels and vehicle technologies: funding programs
Creates the Air Quality Improvement Program, which the Air Resources Board (ARB) will administer in consultation with local air districts, to provide, upon appropriation by the Legislature, competitive grants to fund projects to reduce criteria air pollutants, improve air quality, and provide funding for research to improve the air quality impacts of alternative fuels and vehicles, vessels, and equipment technologies. Requires the ARB to determine which air quality projects may receive grants and which revenue streams will fund the program. This program shall be funded by increases over the next 7.5 years in smog abatement fees, boat registration fees, and special identification plate fees.

AB 233 (Jones-D) Diesel vehicles and engines: Healthy Heart and Lung Act
Requires the Air Resources Board (ARB) to develop a strategic plan for consistent, comprehensive, and fair enforcement of ARB's diesel emission control regulations. Increases the minimum civil penalty, from $100 to $300, for a violation of ARB's idling restriction on diesel-fueled commercial motor vehicles. Prohibits the Department of Motor Vehicles from registering or renewing the registration of a commercial vehicle if the owner or operator has been found in violation of air pollution control laws and regulations until the violation has been cleared by the ARB.

AB 242 (Blakeslee-R) Emissions of greenhouse gases: reduction
Declares that it is the policy of the state and the intent of the Legislature to encourage voluntary actions to achieve near-term reductions in emissions of greenhouse gases through investments in cost-effective, available solutions. Requires that an entity that has voluntarily reduced its emissions of greenhouse gases through such investments receive credit from the Air Resources Board (ARB) for early action, and authorizes an entity that has received credit for early action to further minimize its carbon footprint through the purchase of offsets for the emission of greenhouse gases as authorized by the ARB.

AB 255 (De Leon-D) Smog abatement fee
Increases, from $12 to $16, the annual Smog Abatement Fee imposed on newer motor vehicles exempt from biennial inspection under the state Smog Check program, and earmarks the additional revenue to provide subsidies for the development and use of alternative fuels.

Requires the Department of Public Health to adopt regulations to establish specific fees per cigar and cigarette to be assessed.

SB 97 (Dutton-R) CEQA: greenhouse gas emissions
Requires the Governor's Office of Planning and Research, on or before 7/1/09, to prepare, develop, and transmit to the Resources Agency amendments to the California Environmental Quality Act (CEQA) guidelines to assist public agencies in the mitigation of greenhouse gas (GHG) emissions or the effects of GHG, as required under CEQA, including the effects associated with transportation and energy consumption. Requires the Agency to certify and adopt those guidelines by 1/1/10. Provides that the failure to adequately analyze the effects of GHG in documents required under CEQA is not a cause of action. Makes numerous changes with respect to regional transportation and land use planning, with the overall goal of reducing greenhouse gas emissions attributable to the transportation sector in California. Key provisions require the larger regional transportation planning agencies to develop more sophisticated transportation planning models, and to use them for the purpose of creating "preferred growth scenarios" in their regional plans that limit greenhouse gas emissions. Also, provides incentives for local governments to incorporate these preferred growth scenarios into the transportation elements of their general land use plans.

Authorizes a lead agency to prepare a short form environmental impact report for a project subject to the California Environmental Quality Act (CEQA) if the project meets specified criteria, including that the project is a qualified urban use, is within the area designated in a qualified programmatic plan for the type of proposed development, is consistent with the land use designation for the area and applicable standards of population density and building intensity, provides housing or employment near specified areas, and incorporates specified mitigation measures. Requires that a short form environmental impact report include specified information and comply with specified procedural requirements of CEQA for an environmental impact report.

Requires the California Environmental Protection Agency, the California Integrated Waste Management Board, the State Water Resources Control Board, each California regional water quality control board, the Department of Toxic Substances Control, and specified local agencies, as specified, to notify the building, planning, or engineering department in the affected city or county if it takes certain actions with regard to approving a remedial action, removal action, closure, corrective action, or any other type of environmental cleanup action, finds that the property subject to the action is not suitable for unrestricted use, and requires that the property be subject to a land use control, or if it enters into, or imposes, a specified instrument or agreement restricting land uses.

Changes the current prohibition for persons seeking membership to the State Water Resources Control Board (SWRCB) or a regional water quality control board (RWQCB) to instead prohibit any person from being on either the SWRCB or RWQCB if he/she receives, or has received during the previous two years, 25% or more of his/her income directly or indirectly from any person subject to specified waste discharge requirements or applicants for specified waste discharge requirements.

Authorizes a city or county to allow a discharger within its jurisdiction, upon the request of the discharger, to become subject to regulation by the SARWQIB in lieu of the regional board for purposes of the Act. Establishes the Santa Ana Regional Water Quality Improvement Fund and authorizes the developer of a development project, if the developer has become subject to regulation by the SARWQIB, to agree to pay a fee to the appropriate city or county, based on the acreage and density of the proposed development project, for deposit in the fund for research relating to urban runoff, to be conducted by certain educational institutions, as specified, for formulation of mitigation measures for proposed development projects, and for mitigation projects that are approved by that board for the purposes of improving water quality within the region, including projects to mitigate the impacts of urban runoff.

Prohibits, on and after 7/1/08, a person from manufacturing, processing, or distributing in commerce a product containing diacetyl. Authorizes the Director of the Office of Environmental Health Hazards Assessment (OEHHA), with the concurrence of the Secretary of the California Environmental Protection Agency, to grant a temporary waiver from the prohibition of two years with a renewal period of two additional years. States that a waiver may be granted if the manufacturer submits a petition requesting a deferral of the prohibition and the Director of OEHHA makes a written finding that: (1) the prohibition will cause substantial economic hardship to users of diacetyl; (2) there is no feasible alternative to diacetyl; and (3) that there will be appropriate mitigation to the greatest extent practical.

Requires manufacturers of high production volume chemicals to report to the Department of Toxic Substances Control (DTSC) specified information at specified times and to do so electronically. The sale, lease, sublease, or other transfer of any land presently or formerly occupied by the Santa Susana Field Laboratory shall be prohibited unless the Director of Toxic Substances Control certifies that the land has undergone complete remediation.
