Establishes the California Commission on Restructuring School Finance for Kindergarten and Grades 1 to 12, inclusive, and requires the commission to, among other things, propose simple, flexible, and workable funding programs that enable schools to meet the special needs of each individual pupil. Requires the Legislative Analyst to conduct a study regarding public school funding.

Requires a local education agency that is subject to corrective action under the provisions of the No Child Left Behind Act of 2001 to provide notices, convene meetings, and appoint a school site planning team related to restructuring the school.

Allows school districts, county offices of education, and Special Education Local Plan Areas to base their general purpose funding (revenue limit funding) on a two- or three-year running average of average daily attendance in order to better mitigate declining enrollment.

SB 1011* (Florez-D) California State Lottery: multistate lottery
Authorizes the California State Lottery Commission to enter into a multistate lottery agreement. Requires that at least 50 percent of multistate lottery revenues be allocated to the public in the form of prizes, at least 42 percent must benefit public education and no more than eight percent is to be allocated for lottery expenses. Gives a player one year to claim jackpot money.

SB 1077 (Simitian-D) Education finance: revenue limit equalization
Establishes, for fiscal year 2005-06, an equalization adjustment for school district base revenue limits, creating entitlements to equalization funding computed on a goal of raising all per pupil revenue limits to a level above which no more than 10 percent of the average daily attendance in the state is funded.

SB 1080 (Campbell-R) Adult education
Authorizes, until July 1, 2011, a school district to report for state funding average daily attendance and a community college district full time equivalent students, respectively, in adult education classes that are not open to the general public if (1) the classes are offered at a work site primarily for the benefit of employees, (2) intended primarily to develop literacy and English language skills, and (3) instructed by a credentialed employee of the school district.

Establishes a statutory formula to make equalizing adjustments to school district revenue limits with a goal of raising per pupil revenue limits to a fixed point at which 90 percent of all pupils would be attending school districts with revenues that are equal to other districts of the same size and type.

SB 1367 (Ducheny-D) Coachella Valley Unified School District: funding
Authorizes one elementary school and one high school in the Coachella Valley Unified School District to continue to receive necessary small school funding without regard to the overall size of the district, and provides that the average daily attendance of each school remains less than 287. Recasts and clarifies provisions of existing law governing eligibility for necessary small school funding.

SB 1415 (Scott-D) Surplus school property: use of proceeds
Prohibits the use of proceeds from the sale or lease with option to purchase of school district property for ongoing expenditures, including, but not limited to, salaries and other general operating expenses. Authorizes the State Allocation Board to adopt regulations to further define the specified costs. Increases from five to ten years the time period for which the district must demonstrate that it has no anticipated need for additional sites on building construction.

Extends, until January 1, 2010, the authority of the Santee Elementary School District, the Valley Center-Pauma Unified School District, and the Capistrano Unified School District to sell surplus real property and related personal property and deposit the net proceeds into the local general fund to use for any one-time general fund purpose.

SB 1514 (Maldonado-R) School finance: retirement benefit liabilities
Re-establishes, beginning January 1, 2007, a requirement that if a school district provides health benefits for employees upon their retirement, the superintendent of the district shall annually report to the governing board of the school district regarding the estimated accrued but unfunded costs. Applies to county offices of education as well.

SB 1588 (Dutton-R) School finance: equalization adjustments
Requires that a revenue limit equalization adjustment calculated by county superintendents of schools for the 2006-07 fiscal year be equal to, or greater than, an adjustment that was calculated for 1996-97. Makes an unspecified appropriation from the General Fund for that adjustment.

Requests the Governor and Legislature to encourage various organizations to advocate for the protection of these health program funds.

SB 1X (Perata-D) School finance: local control
Requires the apportionment of school funds on a weighted per pupil basis, in lieu of revenue limit funding, as specified. Allocates certain additional funds to eligible schools for implementation of school action plans and requires each school to establish a school site council as a condition of the receipt of these funds.

AB 9 (Coto-D) Education finance: sales and use taxes: services
Requires the Legislature and the Governor to ensure that the current per pupil level of funding for California's K-12 public schools grows by at least 20 percent annually, beginning in the 2006-07 fiscal year, until it reaches a level of at least $10,200 per pupil in current dollars. Requires that additional funding first be used to reduce teacher-pupil ratios so that they are equal to or less than the average teacher-pupil ratio of the ten states with the lowest ratios for public elementary and high schools. Requires that per pupil funding equals or exceeds the average of the top ten states by the 2011-12 fiscal year, and that it remain among the top ten each year thereafter. Establishes a sales tax on specialized services to increase funding for K-12 education and specifies the services that fall within that category.

AB 659* (Chan-D) School districts: reserve for economic uncertainties
Authorizes a school district to continue to maintain one-half of its normally-required reserve for economic uncertainties for fiscal year (FY) 2005-06, and requires a school district to restore its reserve to three-fourths of the required level in FY 2006-07. Requires the minimum reserve level to be restored to the percentage required by regulation in FY 2007-08.

AB 951 (Coto-D) Bonds: interest accrued: deposit in general fund
Authorizes the governing board of a school district to transfer from the interest and sinking fund of the school district to the general fund of the school district the interest that accrues on the proceeds of bonds of the district if the transfer is authorized by the terms of a bond act approved by the electors on or after January 1, 2006.

AB 958 (De La Torre-D) School operations: multitrack year-round scheduling
Requires, commencing with the 2011-12 school year, that no more than 50 percent of the schools operated by a district on a multitrack year-round scheduling program may be schools eligible to receive federal Title 1 funding. Makes an exception to this requirement for a school district in which 85 percent or more of the schools are eligible to receive Title 1 funding. Authorizes various alternatives for complying with this requirement.

AB 973 (Jerome Horton-D) Los Angeles Unified School District
Requires the Board of Education of the Los Angeles Unified School District to establish a budget oversight committee for the purpose of providing independent oversight over the budget of the Los Angeles Unified School District. Specifies the membership composition, governance, functions, and responsibilities relating to the committee and requires the Los Angeles Unified School District to provide support to the committee, including, among other things, technical and administrative assistance and financial resources.

AB 1073 (Liu-D) Average daily attendance: growth formula
Establishes a method for reallocating authorized, but unused, adult education growth to other districts that served adult education pupils in excess of their authorized level and requires that redistributed growth be used to offer career-technical education courses.

AB 1177 (Chan-D) Personal income tax: rates: education finance
Raises the top personal income tax rates to 10 percent and 11 percent and the alternative minimum tax to 8.5 percent. Appropriates funds raised by the bill to the State School Fund and to the California Community Colleges to reimburse districts for specified state-mandated costs.

AB 1191 (Benoit-R) Transportation: equalization adjustment
Establishes the Equalization Adjustment for Special Education and Regular Home-to-School Transportation and requires that for any fiscal year in which funds are specifically appropriated for the equalization of special education and regular home-to-school transportation apportionments pursuant to this bill, the Superintendent of Public Instruction apportion to each school district and county office of education an equalization amount calculated as specified.

Authorizes a school district to invest any portion of the funds that it receives by gift, bequest, or devise, from private sources, in any manner that it deems wise or expedient.

Requires the governing board of a school district or community college district to approve by resolution, at a public meeting as an agenda item, the method of sale and other related information when a district intends to issue bonds. Requires the board, after the sale of the bonds, to disclose actual cost-of-sale information at a public meeting, and to submit other information and reports requires by the California Debt and Investment Advisory Commission regarding the sale of planned sale of bonds.

Authorizes, beginning in the 2005-06 fiscal year, a school district that reports a decline in units of average daily attendance (ADA) for two or more consecutive years, to establish a method to provide additional funding equal to 40 percent of the amount of funding it has lost due to the decline in ADA.

AB 1569 (Cogdill-R) Rural county unified school districts: funding
Requires the county superintendent of schools to calculate an increase to the revenue limit funding of any school district that meets specified criteria for the attendance of pupils at a comprehensive high school. The criteria of the bill are expected to limit this adjustment to the Mariposa Unified School District.

AB 1578 (Bermudez-D) Transportation: East Whittier City School District
Requires, beginning in the 2006-07 fiscal year and every year after, home-to-school transportation funding for the East Whittier City School District to be calculated as if it will receive $175,000 in the 2005-06 school year. This allocation is contingent upon an increase in the home-to-school transportation funding appropriated in the annual budget act specifically for this purpose.

AB 2577 (Wolk-D) Property tax revenue allocations
Establishes an 11 percent floor for property tax allocations to county governments by transferring property tax revenues from the Educational Revenue Augmentation Fund in each county that received less than this minimum in fiscal year 2001-02 and has at least 60 percent of its land in Williamson Act contracts.

AB 2797 (Strickland-R) School districts: fiscal penalties and fines

Appropriates $300,000 from the General Fund for this expansion. Requires the SDE to ensure that the 20 additional SELPAs include SELPAs comprised primarily of low-income families with a high number of English language learners.

Requires SDE to determine the performance level on the test or tests that is equivalent to a passing score on the pertinent portion of the CAHSEE, and to report its findings to the Legislature as to whether any of these tests is equivalent to the CAHSEE and whether a student who achieves an equivalent passing score on the identified CST should be deemed to have passed that portion of the CAHSEE.

Existing law provides that such a candidate is eligible for a 12-month extension to complete program requirements. Existing law repeals these provisions on January 1, 2006.
