Requires Regional Transportation Planning Agencies to commit 5% of state capital funding to disadvantaged small communities, as defined. Defines a disadvantaged small community as a city or census-designated place with fewer than 25,000 residents and with a median household income less than 80% of the statewide median household income. Specifies that it does not apply to any agency without a city in its region larger than 25,000 residents, nor does this bill preclude a disadvantaged small community from applying for more State Transportation Improvement Program funding than it would receive under this bill.

Creates a Road Usage Charge (RUC) Technical Advisory Committee to guide development and implementation of a pilot program to study the potential for RUC as an alternative to the gas tax. Requires the Committee study RUC alternatives to the gas tax, gather public comment on issues and concerns related to the pilot program, and make recommendations to the Secretary of the Transportation Agency on the design of a pilot program to test alternative RUC approaches and any evaluation of the program.

Specifies that projects eligible for funding include, but are not limited to, highway capacity and operational improvements, freight rail system improvements, land port, airport, and seaport efficiency enhancements, truck corridor improvements, surface transportation and connector road improvements, and border access improvements.

As such, the weight fees are directed to the State Highway Account for specified transportation purposes rather than offsetting General Fund debt service expenditures.

Provides that the imposition, extension, or increase of a special tax by a local government for the purpose of providing funding for local transportation projects requires the approval of 55% of its voters voting on the proposition, if the proposition proposing the tax includes certain requirements. Prohibits a local government from expending any revenues derived from a special transportation tax approved by 55% of the voters at any time prior to the completion of a statutorily identified capital project funded by revenues derived from another special tax of the same local government that was approved by a two-thirds-vote.

SCA 8 (Corbett-D) Transportation projects: special taxes: voter approval

Reduces, subject to a future vote of the people, the voter threshold from two-thirds to 55% for passage of local sales taxes dedicated to transportation purposes, if the local ballot proposition: (1) contains a specific list of projects, programs, and purposes to be funded by the tax proceeds; (2) requires an annual independent audit of the tax proceeds collected and expended; and (3) requires the governing board to create a citizens' oversight committee.

Authorizes the Department of Transportation to assume responsibilities for federal review and clearance under the National Environmental Policy Act of 1969 for a transit project, as defined, that is subject to the Act, provides that the State of California consents to the jurisdiction of the federal courts in that regard, and further provides that the Department may not assert immunity from suit under the 11th Amendment to the U.S. Constitution with regard to actions brought relative to those responsibilities under federal law.

Deletes the provisions allocating revenues derived from the increased motor vehicle fuel excise tax to State Highway Account reimbursement, the State Transportation Improvement Program, and the State Highway Operations and Protection Program, and instead provides for the State Controller to apportion all of these revenues to cities and counties for local streets and roads pursuant to a specified formula.

AB 2728 (Perea-D) Vehicle weight fees: transportation bond debt service

Explicitly prohibits weight fee revenue from being used to pay debt service on transportation bonds or from being loaned to the General Fund. Provides that these provisions sunset on 1/1/19.

SB 862 (Senate Budget And Fiscal Review Committee) Greenhouse gases: emissions reduction: high-speed rail

Makes various changes to implement the resources, environmental protection, energy, and agricultural budget actions adopted as part the 2014-15 Budget package. Provides a continuous appropriation of 25% of the cap-and-trade funds to continue the construction of high-speed rail, in addition to $400 million from the repayment of the cap-and-trade funds loaned to the General Fund in 2013.

Requires the High-Speed Rail Authority to provide, to the appropriate policy and fiscal committees of the Legislature, a copy of each contract entered into by the Authority, if the dollar value of the goods or services to be provided or performed under the contract is $25,000 or more, as well as a copy of each contract amendment and contract change order agreed to by the Authority for $25,000 or more.

Directs the Secretary of State to put on the November 2014 general election ballot a measure which, if approved, (1) prohibits further issuance and sale of any authorized bonds for high-speed rail, except for early improvement projects (a.k.a. bookend projects) in the Phase 1 blended system for which appropriations have already been made, (2) redirects the proceeds of any outstanding bonds issued and sold-except for those related to the bookend projects-to debt retirement, and (3) reauthorizes the issuance and sale of any unissued bonds for other transportation uses.

SB 151 (DeSaulnier-D) State highway operation and protection program

Requires the California Transportation Commission (CTC), beginning 2/1/16, to allocate funds for capital outlay and capital outlay support costs for projects in the State Highway Operation and Protection Program. Requires the Department of Transportation to submit requests for supplemental allocations, for projects that exceed approved allocations, to the CTC for approval, and authorizes the CTC to provide exceptions to this requirement as it determines necessary to ensure projects are not needlessly delayed.

Requires the relinquishment be subject to an agreement by the City to accept the relinquishment.

Extends, until 1/1/24, extra fees on vehicle registrations, boat registrations, and tire sales in order to fund the AB 118 (Núñez, Chapter 750, Statutes of 2007), the Carl Moyer Program, and AB 923 (Firebaugh, Chapter 707, Statutes of 2004) programs that support the production, distribution, and sale of alternative fuels and vehicle technologies, as well as emissions reduction efforts. Suspends, until 2024, the Air Resources Board's authority to require fuel suppliers to provide hydrogen fueling stations and instead allocates up to $220 million to construct and operate retail hydrogen fueling stations. Extends the authority of local air districts to impose vehicle registration surcharges, in their respective areas, to achieve air emission reductions from vehicles and off-road engines.

Requires that a cylinder and tank bracket inspection be conducted on all motor vehicles with a compressed natural gas fuel system every three years by an independent qualified compressed natural gas cylinder inspector, except as provided, and that the cylinder be replaced on these vehicles before the manufacturer expiration date marked on the cylinder. Requires a smog check technician, when inspecting a motor vehicle with a compressed natural gas fuel system, to locate and report the manufacturer expiration date marked on the vehicle's cylinder to the Department of Motor Vehicles (DMV) in a manner to be determined by DMV. Requires DMV to refuse to renew the registration of a motor vehicle with a compressed natural gas fuel system if DMV has not received an inspection report confirming that the vehicle has received a cylinder and tank bracket inspection in the last three years or if the cylinder attributed to the vehicle is past the expiration date on record with DMV.

AB 1908 (Bigelow-R) Vehicles: farm vehicles

Exempts truck tractors or truck tractor and semitrailer combinations from the Department of Motor Vehicles registration requirements if the following conditions are met: (1) the vehicle is owned by a farmer; (2) the vehicle is operated on highways only incidental to a farming operation and not for compensation; (3) the vehicle is operated by the farmer, employee of the farmer, or a contracted employee of the farmer; (4) the vehicle is operated between one part of a farm to another part of that farm or from one farm to another; (5) the vehicle is operated on a highway for a distance not to exceed 10 miles from the point of origin of the trip; (6) the vehicle has a manufacturer's gross vehicle weight rating over 10,000 pounds and is equipped with off-highway traction tires on all wheels; (7) the vehicle is used exclusively to haul onions; and (8) the vehicle is not operated in excess of 25 miles per hour on highways.

AB 1998 (Grove-R) Vehicles: registration fees

Requires the Department of Motor Vehicles to clearly identify the $43 registration fee as the base registration fee on any application for initial registration or renewal of registration, and to clearly identify each additional fee or surcharge added to the base registration fee as a separate and district line item on those applications. Requires the Department to provide with each application a brief description of purpose for each fee or surcharge, and the statutory authority for that fee or surcharge.

AB 2197 (Mullin-D) Vehicles: temporary license plates

Requires the Department of Motor Vehicles (DMV), by 4/1/15, to issue a request for proposal with a private industry partner to contract for development of a temporary license plate (TLP) system, as specified, to become operational by 1/1/16. Authorizes DMV to impose a fee on dealers and lessors to process TLPs that does not exceed DMV's costs to procure and maintain the system. Authorizes the dealer to charge the vehicle purchaser a TLP processing charge, not to exceed an amount established by DMV through regulations. Requires a dealer to electronically record and transmit to the TLP system vehicle and owner identification information as specified. Allows a vehicle to be operated with a TLP until either the purchaser receives a permanent license plate or a 90-day period following the date of sale of the vehicle has expired.

AB 2201 (Chávez-R) Vehicles: driver's license: selective service

Deems that a person who is required by federal law to register with the federal Selective Service System (SSS), and completes an application for an original or renewal of a driver's license on or after 1/1/16, has consented to registration with the SSS. Submission of an application establishes a conclusive presumption that the person has either registered with the SSS or authorized the Department of Motor Vehicles to forward information necessary for registration when the person is required to register. Requires the Department to forward the necessary personal information for registration to the SSS in an electronic format. Applies to United States citizens and immigrants who are 16 years of age or older but less than 26 who are or will be required to register with the SSS.

AB 2204 (Achadjian-R) Vehicle registration fees

Allows any county with a population of 300,000 or less, rather than a county of 250,000 or less, upon the adoption of a resolution by its board of supervisors, to impose a fee of $1 or $2 on all motor vehicles. Requires the funds be used for the prosecution of crimes involving driving while under the influence of alcohol or drugs, or both, vehicular manslaughter, or any combination of those crimes.

Deletes the duty of the Board of Equalization to adjust annually the excise tax on gasoline, and instead requires that by March 1 of each year, the Department of Finance calculate the gasoline excise tax rate to equal the revenue loss attributable to exempting gasoline from state sales tax. If this calculated rate is less than or equal to the current rate, then that rate shall take effect automatically on July 1. If this calculated rate exceeds the current rate, then the increased rate will only take effect if included in a bill passed by two-thirds-vote of both houses of the Legislature, otherwise the rate will remain unchanged.

Requires the Air Resources Board to consider circumstances beyond the control of a vessel fleet if, upon initial visit to a port, the Board finds that equipment testing compliance efforts are affected by delays in construction, technical issues, and requirements of third parties.

Allows for future transfers from the Local Airport Loan Account to the Aeronautics Account upon the approval of the Department of Finance and the California Transportation Commission. Closes a loophole that currently exists for right-of-way support and capital expenditures that exceed their allocation after the Commission vote. Modifies existing affidavit-related language to allow the use of the existing Department of Motor Vehicle's Form 44 under penalty of perjury to declare a social security number has not been issued to the applicant and they are not presently eligible for a social security number. Requires the Department of Transportation to provide a report to the budget and policy committees on the use of advertising on electronic signage on the state's highway system and the feasibility of a pilot project including estimates of revenue. Makes technical change to the Active Transportation Program that prevents a situation where the adoption of the initial program of projects would overlap with the call for projects for the second round of funding. Requires the Department of Transportation, in consultation with the Department of Parks and Recreation and the Department of Motor Vehicles, to conduct a study to determine the appropriate level of state fuels tax revenues that are derived from the use of off-road highway vehicles. Increases, by 15,000, the cap on "green stickers" which allow electric vehicles to use high-occupancy vehicle lanes. Appropriates $4,934,000 from the Motor Vehicle Account to the California Highway Patrol to conduct a pilot project to replace 12 dispatch radio consoles at two California Highway Patrol communication centers.

Requires, beginning 1/1/15, that a person or a public or private entity that owns or operates an unmanned aircraft (UA) that is not a model aircraft within California to do one of the following: (1) legibly and permanently affix, stamp, or mark on the UA, in a size that can be read by the naked eye without the use of magnification, identifying information that indicates the name, residential or business address, and telephone number of the owner of the UA; (2) store the owner's identifying information in a digital format on the UA in a manner that is readily accessible and retrievable; and (3) legibly and permanently affix, stamp, or mark on the UA, in a size that can be read by the naked eye without the use of magnification, an address for an active Internet Web site that lists the owner's identifying information.

Provides that a driver, who fails to stop when involved in an accident where an individual is struck, is guilty of an infraction punishable by a fine not exceeding $250, or a misdemeanor, punishable by up to six months in county jail, a fine of up to $1,000, or both. Requires the Department of Motor Vehicles to suspend the individual's driver's license for six months.

Exempts Terminal One at the San Diego International Airport from the requirement for the room to be located behind the airport security screening area, but requires the airport to provide a secure room located in the same terminal prior to entering the security screening area that meets specified requirements.

Authorizes, in each county, upon agreement between the county and the court, implementation of an amnesty program whereby a person can pay 50% of a fine or bail due before 1/1/12 for eligible infraction or misdemeanor violations of the Vehicle Code if certain conditions are met. Payment shall be accepted between 1/1/16 and ending 12/31/16.

Establishes a base fine of $220 to $300 for a driver convicted of violating any statutory rule of the road that is punishable as an infraction and, as a result of that violation, proximately causing bodily injury or great bodily injury to a vulnerable road user. Defines "vulnerable road user" to mean a pedestrian, including a highway construction and maintenance worker; a person on horseback; a person operating equipment other than a motor vehicle, including, but not limited to, a bicycle, in-line skates, roller skates, a scooter, or a skateboard; a person operating or using a farm tractor; a person on an electric personal assistive mobility device; and a person in a wheelchair.

Requires the Authority to contract with an independent third-party collection agency to collect the use fee. Requires the tariff to include certain provisions for its enforcement in case of delinquency, including refusal of service and a lien on cargo, and also requires the tariff to include a prohibition against payment, waiver, advancement, or absorption of the use fee by any ocean common carrier or railroad operator on behalf of a user.
