Requires that specified information about vendor rates and payments to nonprofit housing corporations be posted on each regional center's Internet Web site, alongside other existing information.

SB 577 (Pavley-D) Autism and other developmental disabilities: employment

Requires the Department of Developmental Services, contingent upon receiving federal financial participation, to conduct a four-year demonstration project to determine whether community-based vocational development services will increase employment outcomes for consumers and reduce purchase of service costs for working age adults. Establishes an hourly rate for community-based vocational development services for all services identified and provided in the plan. Requires the Department to publish a notice on its Internet Web site when the demonstration project has been implemented, and to make determinations and notify the Legislature concerning the project's effectiveness at the project's conclusion.

SB 579 (Berryhill-R) Commission on Oversight Efficiency and Quality Enhancement

Establishes the Commission on Oversight Efficiency and Quality Enhancement Models to investigate methods of implementing a unified and consistent oversight and quality enhancement process that ensures the welfare, community participation, health, and safety of individuals with developmental disabilities who are served in programs licensed by the Community Care Licensing Division of the Department of Social Services.

SB 1093 (Liu-D) Regional centers: culturally competent services

Requires regional centers to provide independent living skills services to an adult consumer, as specified. Requires regional centers to hold the annual stakeholder meetings regarding data that includes residency type, race or ethnicity, and primary language, separately from any meetings of its board of directors and to schedule the meetings at times and locations designed to result in a high turnout by the public and underserved communities, as specified. Also requires each regional center to annually report to the Department of Social Services specified information regarding its implementation of these provisions and requires the reports to be posted on the Department's and each regional center's Internet Web site by August 31 of each year.

AB 518 (Yamada-D) Community-based adult services: adult day health care center

Continues Community Based Adult Services as a Medi-Cal benefit and included as a covered service in contracts with all Medi-Cal managed health care plans following the expiration of a legal settlement and a Medicaid waiver in effect until August 2014, establishes eligibility criteria for Community Based Adult Services, requires an Adult Day Health Center to meet specified staffing standards, and establishes requirements for Community Based Adult Services providers, including a requirement that the Department of Health Care Services certify and enroll as new Community Based Adult Services providers, only those providers that are exempt from taxation under Section 501(c)(3) of the federal Internal Revenue Code, commencing 7/1/15.

Permits the Department the discretion of completing a prelicensure survey for a new licensee of a currently licensed residential care facility for the elderly for which there will be no material change to management or operations when the license changes hands.

Broadly rewrites the statutory responsibilities of the State Council on Developmental Disabilities (SCDD), including restructuring the role and scope of the state's 13 area boards, to comply with the requirements of the federal Administration on Intellectual and Developmental Disabilities, which has designated the SCDD as being at high risk and limited access to its $6.5 million grant. Revises the authorization for the Department of Developmental Services to contract with SCDD for advocacy services within its state developmental centers and makes other conforming changes.

SB 909 (Pavley-D) Children in temporary custody: health screenings

Allows social workers to authorize noninvasive initial medical, dental, and mental health screenings of a child in temporary custody, without parental consent or court order, if reasonable attempts to notify the parent are made. Adds "mental health care" as defined, to the list of services that may be authorized under specified circumstances for a child who is a dependent of the juvenile court, is in temporary custody, or for whom a dependency petition has been filed.

SB 977 (Liu-D) Juveniles

Imposes additional duties on social workers to include in each social study, evaluation, and supplemental report to the courts a factual discussion of whether a child can be returned to the custody of his/her parent who is enrolled in a certified substance abuse treatment facility that allows a dependent child to reside with his/her parent. Requires courts to consider whether a child can be returned to the custody of his/her parent in these situations, as specified.

Revises and recasts existing law which specifies the documents and information that are required to be provided to a dependent youth prior to terminating dependency. Requires the Department of Health Care Services or the delegated county to review the certification issued of a facility upon receipt of notification from DSS of any adverse licensing action taken after the finding of noncompliance during an unannounced visit, as specified. Requires DSS to consult with specified agencies and entities to develop additional performance standards and outcome measures that require group homes to implement programs and services to minimize law enforcement contacts and delinquency petition filings against dependent minors, as specified.

AB 1658 (Jones-Sawyer-D) Foster care: consumer credit reports

Requires when a child in foster care reaches his/her 16th birthday, and each year thereafter, while the child is under the jurisdiction of the juvenile court, the county welfare department, county probation department, or, the Department of Social Services, to inquire of each of the three major credit reporting agencies as to whether the child has any consumer credit history instead of requesting a "consumer credit disclosure." Requires the Department to provide information to the appropriate legislative policy committees regarding the implementation of these provisions, including, but not limited to, any state and county barriers to obtaining credit reports as required by the federal Child and Family Services Improvement and Innovation Act of 2011.

AB 1978 (Jones-Sawyer-D) Child welfare services

Requires the Department of Social Services (DSS), in consultation with counties and labor organizations, to establish a process to receive voluntary disclosures from social workers, if a social worker has reasonable cause to believe that a policy, procedure, or practice related to the provision of child welfare services by a county child welfare agency endangers the health or well-being of a child, as specified. Prohibits DSS from disclosing the identity of a social worker making a disclosure, unless the social worker has consented to the disclosure or there is an immediate risk to the health and safety of a child. Requires DSS to report to the Legislature, and post on its Internet Web site, the total number of relevant disclosures received and a summary description of the issues raised in those disclosures, and of the actions taken by DSS in response to those disclosures. Also authorizes a county child welfare social worker to comment on a child fatality once certain documents from the child's case file have been released by the custodian of records and makes several legislative findings and declarations.

AB 2668 (Quirk-Silva-D) Foster care: nonminor dependent parents

Authorizes the development of a parenting support plan between a nonminor dependent (NMD) parent who resides in a supervised independent living placement, an identified responsible adult who has agreed to act as a parenting mentor, and a representative of the county child welfare agency or probation department; requires an NMD who develops a parenting support plan to provide a copy of the plan to the county child welfare agency or probation department and inform these entities of subsequent changes to the plan; and requires that, after completion and approval of the plan and a determination by the county agency, the payment to the NMD parent be increased by an additional $200 per month. Also, requires the Department of Social Services to convene a working group to develop and issue an all-county letter specifying the minimum criteria a person must meet in order to serve as an identified responsible adult to an NMD parent, as specified.

SB 206 (Emmerson-R) EBT cards: prohibition for alcohol and tobacco purchases

Requires the electronic benefits transfer (EBT) system to be designed to prevent use of EBT cards by recipients for the purchase of alcohol or tobacco products. Requires that its provisions not be construed to prohibit the use of an EBT card to access Supplemental Nutrition Assistance Program benefits, as authorized by federal law.

Requires that a person who is an inmate of a public institution be suspended as a member of the CalWORKs program assistance unit for the duration of his/her incarceration, but returns the person to the assistance unit without reapplying, if he/she is still eligible for CalWORKs benefits upon release. Makes the suspension of Medi-Cal benefits provisions applicable to individuals who are 21 years of age or older. Requires that a person who is an inmate of a public institution be suspended from receiving CalFresh benefits for the duration of his/her incarceration, but reinstates the benefits without the person reapplying, if he/she is still eligible for CalFresh benefits upon release.

SB 572 (Price-D) In-Home Supportive Services Employer-Employee Relations Act

Authorizes the California In-Home Supportive Services Authority to implement any or all of its last, best, and final offer, provided that they would be required to present the parts of its last, best, and final offer that conflict with existing law or require the expenditure of funds to the Legislature for approval.

SB 625 (Beall-D) Child welfare: racial and ethnic disparities

Prohibits the Department of Social Services and county welfare departments from denying services to parents or children on the basis of language or ethnicity, as specified. Requires the Department and county welfare departments to document the communication needs of each Hispanic parent and child, provide Spanish-speaking clients with services and materials in Spanish and have adequate staff to assign bilingual workers to Spanish-speaking families, as specified. Requires that children be placed in a foster home that is as linguistically and culturally equivalent to a parent's home as possible. Requires that children of Spanish-speaking families be placed with Spanish-speaking foster parents within 60 days of removal from their families and defines as "improper" placement with non-Spanish speaking families. Requires counties to include in self assessments and improvement plans data and information about efforts to eliminate racial and ethnic disproportionality in services and supports provided in the child welfare system, as specified, and other requirements, as specified.

SB 899 (Mitchell-D) CalWORKs: eligibility

Deletes California's Maximum Family Grant rule, which prohibits CalWORKs payments from being made on behalf of children who were conceived after a family begins receiving aid except in cases of rape, incest or contraception failure, as specified. Also prohibits an applicant or recipient from being required to share confidential medical information as a condition of aid eligibility or from being required to use a specific type of contraception as a condition of aid eligibility.

SB 999 (Liu-D) CalFresh: student eligibility

Requires the California Community Colleges (CCC) Chancellor's Office and the Department of Social Services to establish detailed guidelines identifying categories of students that may qualify for federal exemptions that would allow them to receive CalFresh benefits, and recommends that the California State University Chancellor's office, and the University of California President's office do the same. Requires CCCs to provide specific documentation to students who may qualify for an exemption. Authorizes a county that elects to participate in the CalFresh Employment and Training program to enter into an agreement with a CCC or a California State University campus to establish an Employment and Training program, as specified.

SB 1002 (De León-D) Low-income individuals: eligibility determinations

Requires the Department of Health Care Services to seek any federal waivers necessary to use eligibility information of certain individuals who have been determined eligible for the CalFresh program to redetermine their eligibility for Medi-Cal. Similarly requires the Department of Social Services to seek any federal waivers necessary to use eligibility information of individuals who have been determined eligible for the Medi-Cal program to determine or redetermine their eligibility for CalFresh. Requires the Department of Social Services (DSS), in collaboration with key stakeholders, to establish and periodically revise statewide CalFresh customer service standards and performance goals. Requires DSS to measure annually the progress made toward the execution of the standards and goals, and to make that information publicly available. Requires DSS to develop a data management tool that includes specified data, to make public the data from this management tool and to update it at least quarterly within 60 days following the end of each quarter. Requires DSS to use data from the tool to measure the progress made towards the standards and goals and makes related findings and declarations.

Requires the state to submit a request to the United States Department of Agriculture, on or before 12/31/14, to waive the requirement excluding the basic allowance for housing from countable income in the calculation of eligibility and benefit level for CalFresh. Requires the waiver to be implemented within six months of being granted. Requires participating counties to defer from the CalFresh Employment and Training Program (CalFresh E&T) a person who is currently serving in the U.S. Armed Forces or is a veteran who has been honorably discharged from the U.S. Armed Forces. Requires a veteran applying for CalFresh benefits who is required to register to work, but who is exempt from mandatory placement in the CalFresh E&T, to be provided with a referral to local veterans assistance and job training agencies and be given the opportunity to participate as a volunteer in CalFresh E&T if the county participates.

AB 578 (Dickinson-D) Crisis nurseries: study

Requires the Department of Social Services to implement a two-year pilot project in the counties of Sacramento and Yolo for the purpose of evaluating the effectiveness of crisis nurseries in lowering the incidence of child abuse in those counties. Conditions implementation of the pilot on voluntary participation by all crisis nurseries in those counties and private funding for one-half of the cost of the project.

Otherwise, requires counties to accept requests in a manner necessary to ensure that participants are able to request the supportive services they need.

Requires the system to be designed so that users are informed when the EBT system is down and funds are not accessible, as specified. Requires users of the EBT card to be informed of where they can use their cards to withdraw funds without fees, and other information regarding fees. Specifies that the Department of Child Support Services is prohibited from being held liable for authorizing a direct deposit of child support payments into an account that is not a qualifying account.

AB 1653 (Garcia-D) CalWORKs: victims of domestic violence

Requires the Department of Social Services to establish a standard, statewide notice to inform all applicants and recipients of the CalWORKs program that victims of abuse have a right to request a waiver of program requirements. Requires the county to waive, for applicants or recipients, program requirements when those requirements would encourage the individual to return to the abuser, or would be detrimental to or unfairly penalize the individual or his/her family, and to waive the welfare-to-work requirements for an applicant or recipient if the county determines that good cause to waive those requirements exists, as specified. Requires the county to waive program requirements under specified circumstances and requires counties to inform all CalWORKs applicants and recipients of their rights and how to secure a waiver.

AB 1930 (Skinner-D) CalFresh: student eligibility

Provides that, for the purposes of determining eligibility, certain educational programs, as determined by the Department of Social Services (DSS), shall be considered employment training programs, thereby qualifying a student participating in one of those programs for an exemption to the prohibition on enrollment into the Supplemental Nutrition Assistance Program, unless prohibited by federal law. Requires DSS, in consultation with representatives from other specified organizations, to establish a protocol to identify and verify all potential exemptions and participation in educational programs that qualify a student for an exemption. Also requires DSS to seek and obtain federal approval, as specified, prior to publishing guidance or regulation, if the United States Department of Agriculture requires federal approval.

AB 2001 (Ammiano-D) Homeless youth: child welfare services

Requires the Department of Social Services to establish a working group to develop policy and practice recommendations to ensure that homeless, unaccompanied minors have access to appropriate placements and services through the state's child welfare system. Requires a county child welfare agency, upon temporary placement of a homeless youth in a homeless youth shelter, to provide case management services, identify appropriate long-term housing placement opportunities and wraparound services for the youth, and make a recommendation as to whether the youth should continue to receive long-term intensive support services, as specified.

AB 2382 (Bradford-D) CalWORKs: eligibility: truancy

Revises CalWORKS requirements by deleting the requirement that the aid grant of a family be reduced if the county determines that an eligible child under 16 years of age is not regularly attending school and authorizes, if the county determines that a child is not attending school, it must inform the family of how to enroll the child in an appropriate school and screen the family to determine its eligibility for family stabilization services and requires the county, if applicable, to document that the family was given this information and was screened for those services. Allows the county to consider the needs of a child in the assistance unit who is 16 years of age or older in computing the grant to the family for any month in which the county is informed by a school district or a county school attendance review board that the child did not attend school if at least one of several circumstances is present. Provides that a child whose needs are excluded from computing the family grant remains eligible for services that may lead to school attendance.

Also requires each local program to contract with nonprofit organizations, as specified, and to consult with the local children and families' commission if the target population includes homeless youth from zero to five years of age.

SB 663* (Lara-D) Sexual assault: victims with developmental disabilities

Revises the definition of certain sex offenses, including rape, sodomy, and oral copulation, to apply if the victim is developmentally disabled, and either (1) the person lacks the legal mental capacity to give consent when compared to a reasonable person who does not have a developmental disability and this fact is known or reasonably should be known to the person committing the act, or (2) the defendant is a caretaker or a care provider. Creates an exception to the hearsay rule for certain out-of-court statements made by a person with a developmental disability (1) if the declarant is a victim of a crime, (2) if the statements describe a specified sex offense performed with, by, on, or in the presence of the declarant, (3) if the statements describe any act of child abuse to which the declarant was subjected or which the declarant witnessed, or (4) if the statements describe a specified sex offense or an act of domestic violence, and specified other criteria are met.

SB 738 (Yee-D) Sexually exploited and trafficked minors

Provides that a child may come within the jurisdiction of the juvenile dependency court if the minor is a victim of human trafficking, a victim of sexual exploitation, or receives food or shelter in exchange for sexual acts, or is paid to perform sexual acts, and the parent or guardian failed or was unable to protect the child. Also requires the training for administrators of group home facilities, licensed foster parents, and relative or nonrelative extended family member caregivers to include instruction on cultural competency and sensitivity related to providing adequate care to a sexually exploited and trafficked minor. Requires the California Child Welfare Council and Health and Human Services Agency to convene an interagency workgroup, as provided. Requires the workgroup to provide recommendations and updates to the State Plan to Serve and Protect Sexually Exploited and Trafficked Minors.
