AB 569 (Chau-D) Real property: divided lands

Provides that, notwithstanding prohibitions in the Subdivided Lands Act, an individual interest in a stock cooperative or a limited-equity housing cooperative may be sold or leased subject to a blanket encumbrance if certain conditions are met. Provides that a limited-equity housing cooperative or a workforce housing cooperative trust shall be exempt from the requirements of the Subdivided Lands Act if, alone or in any combination with other specified entities, a state or federally chartered credit union or a state or federally certified community development financial institution directly finances or subsidizes at least 50% of the total construction or development cost or $100,000, whichever is less, of the housing cooperative.

AB 1360 (Torres-D) Common interest developments: electronic voting

Authorizes homeowners associations to conduct elections using electronic voting systems in addition to the existing paper-based balloting system, and allows each voting member of an association to opt into using the electronic voting system if they so choose. Permits an association, or an electronic balloting service provider acting on behalf of an association, to conduct elections by electronic voting only if, among other requirements, each voting member is provided with specified information.

AB 1669 (Wagner-R) Speed limits: Orange Park Acres

Allows Orange County, when setting speed limits on the public streets within the common-interest development of Orange Park Acres, to use equestrian safety as a safety-related factor in order to decrease posted speed limits by five miles per hour from the 85th percentile speed.

Requires a resolution or agreement under a common interest developments procedure for resolving internal disputes between a homeowners' association and a member be written and signed by both parties, and authorizes a member and an association to be assisted by an attorney or another person at their own costs during the dispute process.

Establishes conditions under which residents of common-interest developments and tenants in rental housing may engage in personal agriculture. SB 1 (Steinberg-D) Sustainable Communities Investment Authority

Allows a local government to establish a Sustainable Communities Investment Authority and direct tax increment revenues to that Authority in order to address blight by supporting development in transit priority project areas, small walkable communities, and clean energy manufacturing sites. Provides that an Authority that collects tax increment revenues must dedicate no less than 25% of the allocated tax increment for affordable housing purposes.

Makes various reforms to the activities of redevelopment agencies in fulfilling requirements to increase, preserve and improve low- and moderate-income housing.

SB 391* (DeSaulnier-D) California Homes and Jobs Act of 2013

Establishes the California Homes and Jobs Act of 2013 to provide funding for affordable housing. Beginning 1/1/14, imposes a $75 fee on every real estate instrument, paper, or notice that is required or permitted by law, excluding real estate instruments, papers, or notices recorded in connection with a transfer subject to a documentary transfer tax. Allows the money, upon appropriation by the Legislature, to be used to support the development, acquisition, rehabilitation, and preservation of housing affordable to low-and moderate-income households.

SB 854 (Senate Budget And Fiscal Review Committee) State and local government

Abolishes the California Housing Trust Fund, and transfers the remaining balance, assets, liabilities, and encumbrances to the Housing Rehabilitation Loan Fund. Abolishes the School Facilities Fee Assistance Fund, and designates the General Fund as the successor fund for any loan repayments. Both of the abolished funds are administered by the Department of Housing and Community Development. Identifies the Department as an eligible recipient of up to $11 million in Proposition 1C funding, for the rehabilitation and deferred maintenance of state-owned migrant centers through the Office of Migrant Services.

SB 862 (Senate Budget And Fiscal Review Committee) Affordable housing

Provides a continuous appropriation of 35% of the cap-and-trade funds for investments in transit, affordable housing, and sustainable communities. Of this, 20% is for affordable housing and sustainable communities, with half of this funding going to affordable housing projects that demonstrate a reduction in greenhouse gases.

SB 1129 (Steinberg-D) Redevelopment: successor agencies

Amends several statutes governing redevelopment agencies' (RDAs) dissolution. Makes several changes to the statutes governing the dissolution of RDAs. Among other things, (1) authorizes an RDA successor agency to use the proceeds of bonds issued in 2011 for the purposes for which the bonds were sold, if those purposes are consistent with a specified "sustainable communities strategy;" (2) deems an agreement entered into by an RDA prior to 6/30/11 that commits funds to state highway infrastructure improvements as an enforceable obligation; and (3) revises the process for disposal of former RDA properties through a long-range property management plan by eliminating a requirement for compensation agreements governing the distribution of property proceeds.

SB 1404 (Leno-D) San Francisco redevelopment: successor agencies: housing

Confirms that replacing 5,842 housing units that the former Redevelopment Agency (RDA) of the City and County of San Francisco destroyed and did not replace is a statutory obligation that remains under statutes governing redevelopment agencies' dissolution. Allows the successor agency to San Francisco's RDA, with approval from its oversight board, to replace all of the demolished housing units. Grants the successor agency, in addition to the powers that state law grants to each successor agency, the authority, rights, and powers of the RDA of the City and County of San Francisco, exclusively for the purpose of fulfilling the replacement housing obligations.

AB 523 (Ammiano-D) Department of Housing and Community Development: loans

Allows the Department of Housing and Community Development to reduce the interest rate on any loan it has issued to a rental housing development under specified conditions. Allows the Department to change the current interest rate for any loan for which it receives a loan extension request associated with an award of federal or state low-income housing tax credits made on or after 1/1/14 to the federally determined applicable federal rate; and requires the developer to use additional tax credit equity generated by this change for rehabilitation of the development.

Extends, from 1/1/11 to 6/28/11, the date by which an entity that has assumed the housing functions in the winding down of redevelopment can designate the use of, and commit, indebtedness obligation proceeds that were issued for affordable housing purposes. Allows, upon the issuance of a finding of completion by the Department of Finance, a successor agency to use redevelopment bond proceeds issued between 1/1/11 and 6/28/11.

Establishes the Sustainable Communities for All Program, to begin operations on 1/1/15, with the goal of equitably implementing SB 375 (Steinberg, Chapter 728, Statutes of 2008) by providing transportation and housing choices that allow lower-income Californians to drive less and reduce household costs.

AB 1080 (Alejo-D) Community Revitalization and Investment Authorities

Authorizes local entities, either individually or collaboratively and excluding schools and successor agencies, to form a Community Revitalization and Investment Authority. Requires participating entities to direct property tax increment revenues to the Authority to invest in improvements in specified project areas that are characterized by low household income, high unemployment and crime, and deteriorated public infrastructure and structures.

Authorizes the Department of Housing and Community Development (HCD) to extend or restructure a "qualified unpaid matured loan" under the same terms and conditions that apply in existing law regarding active HCD rental or homeownership loans. Requires qualified loans be in material compliance with all terms and conditions, as determined by HCD, other than having reached the due date of its promissory note without being paid. Authorizes a matured loan that is not in full compliance to be transferred to another borrower approved by HCD.

SB 411 (Wolk-D) Building standards: water meters: multiunit structures

Requires that a water purveyor that provides water service to a newly constructed multiunit residential structure or newly constructed mixed-use residential and commercial structure that submits an application for a water connection after 1/1/17, measure the quantity of water supplied to each individual dwelling unit as a condition of new water service and permits the measurement to be by individual water meters or submeters, as defined. Requires the owner of the structure to ensure that a submeter installed for these purposes complies with laws and regulations governing the approval of submeter types or the installation, maintenance, reading, billing, and testing of submeters, including, but not limited to, the California Plumbing Code.

AB 585 (Fox-D) Homeless veterans' assistance pilot program

Requires the Department of Veteran Affairs (CalVet), by 7/1/16, develop a list of unused or underutilized non-residential real property owned by the CalVet, including those on or near existing CalVet facilities, and propose one or more uses of those properties that will benefit California veterans and to make a preferred recommendation for use of each property, as specified. Requires CalVet when developing the list to consider its inventory of properties as an integrated system, and address how prospective uses of the properties could complement each other.

AB 998 (Fong-D) Interagency Council on Homelessness

Creates the California Interagency Council on Homelessness and requires various state agencies to meet quarterly to coordinate efforts on homelessness. Creates the Council, whose mission is to construct cross-agency and community cooperation in responding to homelessness, and to identify and apply for increased federal funding to respond to homelessness. Specifies the Council appointments include five state agencies and six other representatives: two from law enforcement or local government, two people who have been homeless, and two stakeholder organization representatives. These six are appointed by the Legislature.

AB 1037 (V. Manuel Pérez-D) Employee Housing Act: agricultural land use

Designates as an agricultural land use any employee housing consisting of no more than 36 beds in a group quarters, 12 units or spaces designed for use by single families or households, or 48 units or spaces operated by a governmental or nonprofit agency and designed for use by single families or households.

AB 1636 (Brown-D) Water conservation

Prohibits a city or county, during a drought emergency declared by the Governor, from enforcing a law or ordinance requiring a resident to water his/her lawn. Provides that a requirement imposed by a governmental entity or a public utility to limit, restrict, or conserve water during a drought emergency declared by the Governor does not constitute a diminution of rent or value of a premise or property.

AB 1929 (Chau-D) Special needs housing for persons with mental illness

Requires the California Housing Finance Agency, with the concurrence of the Department of Health Care Services, to release unencumbered Mental Health Services Fund monies dedicated to the Mental Health Services Act housing program upon the request of the respective county, and requires these counties to use these to provide housing assistance, as defined, to identified target populations, including persons with a serious mental disorder.

Requires all new multiunit residential buildings permitted on or after 1/1/15, to be constructed in a manner to permit measurement by a county, municipal, or other public water system or the owner or operator of water use by each unit and to have installed separate submeters for each unit. Requires an owner or operator of a building subject to that construction requirement to seek reimbursement for water usage by the units based on a specified economic allocation methodology.
