States the intent of the Legislature to pass legislation that appropriates $2 million from the General Fund to be used exclusively for support of the Employment Development Department employment service programs and related administrative costs attributable to the freezing weather conditions that occurred in January 2007. SB 713 (Lowenthal-D) Farmworker housing assistance
Repeals the current farmworker housing assistance program and, instead, merges the farmworker housing tax credit program into the low-income housing tax credit program. The $500,000 currently devoted to the farmworker housing tax credit program shall be set aside in the newly combined program exclusively for farmworker housing projects. Allows partnerships participating in the low-income housing tax credit program to determine how state low-income housing credits earned between 1/1/08 and 1/1/15 are to be distributed among their members. Current state and federal law require that such credits be allocated in proportion to each partner's economic interest in the partnership.

Provides certain agricultural employers affected by the January 2007 freeze with a tax credit equal to 40% of wages paid to employees through 1/1/09. Provides that the credit is available to qualified agricultural employers with operations in a county included in the state of emergency declared by the Governor as a result of the extreme low temperatures and freezing conditions that began on 1/12/07. Provides that the credit is equal to 40% of wages paid to qualified employees, not to exceed $2,400 per employee per year. Provides that the credit replaces deductions otherwise available for the affected wage payments.

Enacts the Agricultural Employer and Employees Health Care Coverage Act requiring the California Research Bureau to conduct a comprehensive study of the availability of health care coverage to agricultural employees. Requires the Bureau to convene a working group of affected California stakeholders, in collaboration with the Senate Office of Research, and to report to the Legislature by 1/1/09 with recommendations to ensure that agricultural employees in California are provided health care coverage and that agricultural employers who provide health care coverage to their employees are allowed to lower their health care costs.

SB 556* (Wiggins-D) The Light Brown Apple Moth
Creates, until 1/1/10, the Light Brown Apple Moth (LBAM) Program within the Department of Food and Agriculture (DFA). Creates an account within the food and agriculture fund and provides those funds shall be available for expenditure without regard to fiscal year, and permits DFA to allocate funding for local assistance to agencies designated by a county board of supervisors. Requires DFA to annually review the progress made by each local agency in eradicating the LBAM, and make recommendations, as needed, to improve individual local agency eradication efforts. Requires an annual legislative report to be submitted on January 10, beginning in 2008. Requires eradication activities conducted, pursuant to these provisions, to comply with all applicable laws and be conducted in an environmentally responsible manner. Makes legislative findings and declarations.

AB 1021 (Galgiani-D) Apple pests
Establishes the California Apple Pest and Disease Prevention Act of 2007. Requires the Secretary of the Department of Food and Agriculture (DFA) to appoint a committee of the California Apple Commission, and a scientific advisory panel, for the general purpose of preventing the further introduction of identified pests and diseases. Provides that no person shall ship apples into the state unless that shipment is accompanied by a certificate attesting to the shipment's compliance with DFA regulations. Provides that it is a crime to handle apples from designated areas the committee finds to be infested with apple-destroying pests and diseases.

AB 1530 (Lieber-D) Pesticide poisoning
Requires clinical laboratories that perform cholinesterase testing on a specimen of human blood, for the purpose of determining pesticide levels, to electronically report specified information about the test to the state Office of Environmental Health Hazard Assessment, as specified.

AB 1604* (Caballero-D) Pesticides: fumigant alternatives
Makes legislative findings and declarations regarding agriculture, air pollution, health risks from pesticide use, and the facilitation of less polluting and toxic pest control methods. Requires the Department of Pesticide Regulation (DPR), by 1/1/09, to develop and implement a fumigant alternatives program that will provide incentives for agricultural producers to adopt soil pest control methods that do not utilize either restricted use pesticides or other pesticides responsible for substantial volatile organic compound (VOC) emissions. Provides that no later than 1/1/10, the annually updated VOC use and emissions inventory of commercial structural and agricultural use pesticides which is prepared by the Director shall include mechanisms to track and report on adoption of non-fumigant soil pest control methods used by agricultural producers, as specified.

AB 1713 (Assembly Agriculture Committee) Agriculture
Relates to the funding of pesticide use enforcement, and makes inoperative on 7/1/08 the current distribution to counties of Motor Vehicle Fuel Account funds which are for the partial reimbursement of county expenses incurred in carrying out various agricultural programs. Revises the distribution of the Motor Vehicle Fuel Account funds operative 7/1/08 to statutorily appropriate a minimum of $16.75 million annually to the Department of Food and Agriculture and to counties for pesticide use enforcement, uniform operation of agricultural policy and administration of programs supervised by the department, pest detection and trapping programs, and for emergency detection, investigation, or eradication of agricultural plant or animal pests or diseases. Requires counties that receive funds for agricultural programs to meet eligibility criteria, including maintenance of effort, before receiving those funds.

SB 140 (Kehoe-D) Fuels: renewable diesel fuel
Requires, within one year after the Air Resources Board makes a specified determination, that at least 2% of the total volume diesel fuel sold or offered for sale in the state contain renewable diesel fuel, and two years thereafter, that at least 5% of the total volume of diesel fuel sold or offered for sale in the state contain renewable diesel fuel. Requires the Department of Food and Agriculture to enforce any diesel fuel specifications adopted by the Air Resources Board, pursuant to the bill.

SB 452 (Cogdill-R) Family-owned farms: employment: workers' compensation
Excludes from the definition of "employee" any person who provides services on a family-owned farm, as defined, and is employed without financial compensation by his/her parent, spouse, child, grandparent, aunt, uncle, or first or second cousin. Requires the Department of Industrial Relations to prescribe a form to be filed by a family-owned farm for purposes of claiming an exemption from the provisions of the workers' compensation system.

Requires the California Integrated Waste Management Board to convene a working group to draft regulations, that shall be adopted by the Board no later than 7/1/09, providing procedures for emergency disposal of animal carcasses during a state of emergency, and requires the Department of Food and Agriculture to also adopt regulations based on the draft regulations prepared by the working group no later than 7/1/09.

Authorizes the counties identified in the Central Valley Rural Crime Prevention Program and the Central Coast Rural Crime Prevention Program to participate in the California Agricultural Crime Prevention Program. Provides that funds appropriated to counties that were authorized to participate in the former Central Valley Rural Crime Prevention Program shall be equal to those provided under that program and shall be distributed according to a specified schedule. Provides that funding for participation of the counties that were authorized to participate in the former Central Coast Rural Crime Prevention Program shall include, but is not limited to, appropriations from local government and private contributions and shall be equal to that provided to each of the counties under that program, and that funding for participation in the California Agricultural Crime Prevention Program for the Counties of Butte, Colusa, Glenn, Humboldt, Imperial, Napa, Riverside, Sacramento, San Bernardino, San Diego, Sonoma, Ventura, and Yolo shall be provided as it becomes available.
