States the intent of the Legislature to pass legislation that appropriates $2 million from the General Fund to be used exclusively for support of the Employment Development Department employment service programs and related administrative costs attributable to the freezing weather conditions that occurred in January 2007. Provides that the credit is equal to 40% of wages paid to qualified employees, not to exceed $2,400 per employee per year. Provides that the credit replaces deductions otherwise available for the affected wage payments.

Enacts the Agricultural Employer and Employees Health Care Coverage Act requiring the California Research Bureau to conduct a comprehensive study of the availability of health care coverage to agricultural employees. Requires the Bureau to convene a working group of affected California stakeholders, in collaboration with the Senate Office of Research, and to report to the Legislature by 1/1/09 with recommendations to ensure that agricultural employees in California are provided health care coverage and that agricultural employers who provide health care coverage to their employees are allowed to lower their health care costs.

SB 486 (Maldonado-R) Avocados
Establishes the California Avocado Pest and Disease Prevention Act of 2007, and creates a committee of four producers, four handlers, and one representative form the University of California, appointed by the Secretary of the Department of Food and Agriculture from nominations received from the California Avocado Commission. Requires the committee to recommend to the Secretary of the Department of Food and Agriculture, the adoption of regulations establishing terms and conditions for handling avocados in California to prevent the introduction and spread of pests and diseases.

AB 1021 (Berryhill-R) Apple pest: pest and disease prevention
Requires the Secretary of the Department of Food and Agriculture to appoint an 11-member committee of the California Apple Commission, and a scientific advisory panel, for the general purpose of preventing the further introduction of identified pests and diseases. Provides that no person shall ship apples into the state unless that shipment is accompanied by a certificate attesting to the shipment's compliance with department regulations. Provides that it is a crime to handle apples from designated areas the committee finds to be infested with apple destroying pests and diseases.

AB 1530 (Lieber-D) Pesticide poisoning
Requires a laboratory that performs cholinesterase testing on human blood, as specified, to electronically report specified information on every person tested to the Department of Pesticide Regulation (DPR). Requires DPR to share the information in an electronic format with the Office of Environmental Health Hazard Assessment (OEHHA) and the Department of Public Health on an ongoing basis for the purpose of complying with other related reporting requirements, as specified. Requires DPR and the local county agricultural commission to investigate the incidences of cholinesterase inhibitor-related illness. Requires DPR and OEHHA to report on the effectiveness of the medical supervision program and the utility of laboratory-based reporting of cholinesterase testing for illness surveillance.

Prohibits the Secretary of the Department of Food and Agriculture from undertaking a pest eradication project, or providing for the application of a pesticide in an urban area to effectuate an eradication project, unless the Governor proclaims a state of emergency.

AB 2765 (Huffman-D) Pest eradication: aerial use of pesticide: public hearing
Provides that the Secretary of the Department of Food and Agriculture or county agricultural commissioner, when the Secretary proclaims an eradication project in an urban area that includes potential aerial application, before the aerial application of a pesticide, to conduct at least one public hearing to consider all alternatives to aerial application. Requires the Secretary to seek an evaluation of human health risk and environmental risk jointly prepared by the Department of Pesticide Regulation and the Office of Environmental Health Hazard Assessment including findings and recommendations relating to the proposed use of a pesticide by serial application. Expands information contained in the public notice to include specified information of each active ingredient and inert material in the pesticide formulation.

Memorializes the Department of Food and Agriculture, the Department of Pesticide Regulation, the Office of Environmental Health Hazard Assessment, and any other applicable state departments and agencies involved in the light brown apple moth eradication effort of the need to address the unresolved health, scientific, and efficacy issues concerning the 2007 light brown apple moth eradication effort. Requests those departments and agencies to respond to existing concerns by providing the public with independent analysis of specified impacts on public health and the environment, to provide information on how they intend to respond to the citizen health complaints arising from their 2007 light brown apple moth eradication activities, and to provide the public with independent analysis to ensure that the elements of the Department of Food and Agriculture's 2008-2009 Light Brown Apple Moth Action Plan to eradicate the light brown apple moth are not harmful to human health and the environment and with the properties of the new pheromone-based pesticide to be aerially sprayed. Requests the Department of Food and Agriculture, the Office of Environmental Health Hazard Assessment, and any other applicable state departments and agencies involved in the light brown apple moth eradication effort to publish a formalized plan on health effect monitoring and tracking. Requests the Department of Food and Agriculture to explain whether it intends to adopt certain recommendations relating to air testing for health effects.

SB 200 (Florez-D) Food safety
Prohibits the serving of meat from downed cattle, as defined, to pupils as part of a school meal or otherwise. Requires establishments subject to required inspection under existing law to install video surveillance in the areas of the establishments where livestock and poultry are present, makes it unlawful to tamper with video surveillance or the resulting recordings, and requires that state officials have access to the live feed from the video surveillance, as specified. Requires the Department of Food and Agriculture to make the appropriate notifications within 24 hours. Makes it a crime to treat livestock inhumanely by taking any of specified actions.

SB 452 (Cogdill-R) Family-owned farms: employment: workers' compensation
Excludes from the definition of "employee" any person who provides services on a family-owned farm, as defined, and is employed without financial compensation by his/her parent, spouse, child, grandparent, aunt, uncle, or first or second cousin. Requires the Department of Industrial Relations to prescribe a form to be filed by a family-owned farm for purposes of claiming an exemption from the provisions of the workers' compensation system.

Authorizes the counties identified in the Central Valley Rural Crime Prevention Program and the Central Coast Rural Crime Prevention Program to participate in the California Agricultural Crime Prevention Program. Provides that funds appropriated to counties that were authorized to participate in the former Central Valley Rural Crime Prevention Program shall be equal to those provided under that program and shall be distributed according to a specified schedule. Provides that funding for participation of the counties that were authorized to participate in the former Central Coast Rural Crime Prevention Program shall include, but is not limited to, appropriations from local government and private contributions and shall be equal to that provided to each of the counties under that program, and that funding for participation in the California Agricultural Crime Prevention Program for the Counties of Butte, Colusa, Glenn, Humboldt, Imperial, Napa, Riverside, Sacramento, San Bernardino, San Diego, Sonoma, Ventura, and Yolo shall be provided as it becomes available.

Requires the Department of Food and Agriculture to establish and oversee a program to provide additional funding to applicants to the federal Environmental Quality Incentives Program. Clarifies the definition of olive oil, repeals current licensure provisions, conforms olive oil definitions, grades and labeling requirements to international standards, authorizes the addition of vitamin E to specified olive oil, permits a consumer to re-use a clean olive oil container, can, or drum, and makes legislative findings and declarations.

SB 1060 (Ridley-Thomas-D) 6th Agricultural District Assoc.: California Science Center
Creates the Exposition Park Authority, with a board consisting of 11 members designated or appointed, and specifies the duties and responsibilities of the board, and, among other things, gives the board (1) the jurisdiction and control over, and responsibility for, the management and operation of any and all real and personal properties located in Exposition Park that are owned by the state, (2) the authority to employ a park manager, and (3) the authority to exercise any and all powers formerly held by the Los Angeles Memorial Coliseum Commission. Requires the board to sell the parcel of property that the Los Angeles Memorial Sports Arena occupies and to establish an advisory board, as specified, that shall meet regularly with the park manager to improve communication and coordination among facilities and to consult with and advise the park manager on issues relating to the operations of Exposition Park. Provides that the California Science Center (CSC) shall be governed by a nine-member board of directors who shall be appointed by the Governor. Specifies that the CSC, through its board and executive officers, shall have jurisdiction only over those matters directly pertaining to the management and operation of the CSC. Requires the CSC, through its board and executive officers, to coordinate museum events and activities with the park manager. Terminates the Los Angeles Memorial Coliseum Commission, as specified. Provides that the Exposition Park Authority Board, among other things, shall assume all rights, obligations, and duties of the commission. States that these provisions are severable.

Changes the makeup of the 11-member California Seed Advisory Board from nine labelers and two public members to seven labelers, two individuals receiving or possessing seed for sale in California, and two public members. Clarifies that all agriculture or vegetable seed labelers must annually register with the Department of Food and Agriculture to sell seed in California.

Extends by two years to 1/1/11, the sunset on provisions that exempt from the California Endangered Species Act, prohibitions against the killing of candidate, threatened or endangered species, the accidental killing of these species that occurs on a farm or ranch in the course of routine and ongoing agricultural activities.

SB 1623 (Yee-D) Rice industry
Defines the terms handle and process for purposes of rice production and distribution, and changes the definition of the term "handler" to persons selling or offering rice for sale. Deletes fidelity bond requirements for agents designated by the California Rice Commission (CRC) to handle assessments and instead requires these funds to be accounted for in a manner prescribed by the CRC. Repeals and recasts the CRC and Department of Food and Agriculture duties related to investigations and violations. Allows the department and the CRC to collect reimbursements for enforcement costs associated with these provisions.

The reimbursement is intended to cover administrative costs incurred by suppliers filing a refund claim for the 18 cents per gallon that they had paid for diesel fuel.

Requires the State Water Resources Control Board and Regional Water Quality Control Board, in considering any aquifer storage and recovery project under Porter-Cologne, to determine the drinking water to be injected and stored by that project to be protective of public health, and the storage of that water a beneficial use of groundwater, if the project proponent demonstrates that the project meets specified criteria.

(5) Allows the Harbors and Watercraft Fund to be used for Quagga mussel eradication and containment programs.

Requests the Department of Public Health to review public health concerns relating to the use of chloramine as a drinking water disinfectant and to conduct studies, particularly human health studies, as appropriate, to provide necessary public health information to further clarify the human health effects of chloramines.
